2010.05.13 Jail Audio: Tommy Croslin Implicates Cousin in Haleigh Cummings Case

Newly released audio of a conversation between Tommy & his grandmother, Hollars, implicates his cousin Joe Overstreet in the disappearance of Haleigh Cummings.

Putnam County Sheriff changed the nature of the investigation last month from an abduction to a homicide after items were discovered in the river.

Last month, Tommy Croslin and Misty Croslin were taken from their jail cells by investigators to the boat ramp at Shell Harbour where searches were taking place.

After a pre-trial hearing with Cummings, Shoemaker said they were trying to negotiate a plea deal in exchange for testimony against the other defendants

On the table in the deal, according to Terry Shoemaker, are the two "upper level" trafficking charges, each of which carries a minimum mandatory sentence of 25 years.

By working with the three lesser charges, Shoemaker said he hopes Cummings would end up with a sentence of 15 to 30 years.

Shoemaker clarified the deal being worked out is in no way tied to the search for Haleigh who is now presumed dead, according to Sheriff Hardy.

Failing the deal, Cummings is scheduled to go to trial July 19.

"For the cooperation he has been giving over the Haleigh Cummings case, I would try to argue (his sentence) down...," Werter said. "We brought him to FDLE in Putnam County and that's how they ended up at the river -- through Tommy's help. Otherwise this case would still be in a quagmire. We have the dots, it's just connecting them."

Here is an excerpt from the tape:

Hank Sr.: The idea is that whatever you know you need to tell them.
Misty: Daddy, I have!
Hank Sr.: OK.
Misty: Dad, it's not may fault they don't listen.

During the conversation, Misty also told her father that she never pointed the finger at her brother Tommy. Misty said her lie detector tests came back inconclusive because she was too nervous to answer the questions.

They talk a lot about Misty lawyer, Robert Fields, and her upcoming court dates. Misty said she trusts Fields and looks forward to getting out. <snipped>

PALATKA -- Misty Croslin, a central figure in the case of missing HaLeigh Cummings, was told Thursday in Putnam County court that she has until mid-August to make a deal with prosecutors in seven drug-trafficking cases that could send her to prison for decades.

On Thursday, the judge set a trial for Aug. 23 on the Putnam cases. Croslin has a "last chance plea date" of Aug. 16 to work out an agreement with prosecutors, LaRue said.

Judge Sets Trial Date for Misty Croslin on Drug Charges

Today in court, Putnam (?) County Court Judge Wendy Berger asked if the prosecution had any offers on the table for her; they do not.Investigators have maintained she may not be a suspect, however Croslin knows more than she's letting on about what happened that night.

The search has continued ever since then, but reintensified in April after a tip led investigators to a boat ramp near Haleigh's home in Satsuma. The tip turned up nothing.

BBM: I think there is a typo in the article because the hearing was in St. John's today not Putnam.

ST. JOHNS CO. Fla. -- Misty Croslin didn't say anything at all when she appeared in St. Johns Co. courtroom, where she's facing one of eight drug trafficking charges.

The other 7 charges are in Putnam County.

Misty Croslin - Cummings is to stand trail in Palatka August 23,2010 unless she makes a plea deal by the Aug. 16 deadline.

"I think the drug charges pretty much was a set up, Hank Croslin Sr., told Channel 4. "Misty or (Hank Croslin Jr.) wasn't drug traffickers. They just was middlemen runners. (Police) have not got none of the drug dealers out there. They just went after Misty and (Hank Jr.). It was nothing about the drugs. It was about Haleigh Cummings.

Hank Sr. said his daughter isn't guilty of these charges, even though investigators released undercover surveillance video they said proves Misty, Ronald Cummings, and Croslin Jr., did, in fact, sell drugs.

Hank Sr. said the case boils down to the Haleigh homicide investigation, and that investigators are just trying to get information out of Misty about what could've happened.

Tommy Croslin Pleas "No Contest" to Drug Charges

Doug Clifford

Hank "Tommy" Croslin Jr., 23, was in court in Putnam County Thursday morning where he entered no-contest pleas to charges of trafficking in hydrocodone and possession of hydrocodone. Circuit Judge Terry LaRue ordered a pre-sentencing investigation.

On the trafficking charge, Tommy Croslin faces a minimum sentence of 44 months in prison.

Tommy Croslin is the brother of Misty Croslin--the last person to see missing Satsuma girl Haleigh Cummings.

Tommy Croslin's lawyer James Werter said in court today, "He wants to get this behind him and move on." Later, Werter said that Tommy has told police everything he knows about the disappearance - and the presumed death - of Haleigh Cummings. Werter added that the State Attorney's Office apears to be looking for more information.

A woman who befriended Misty is facing at least 15 years in prison after pleading Tuesday to a drug trafficking charge.

Donna Michelle Brock, 44, was arrested with Misty Croslin in an undercover operation in January, pleaded no contest.

The first-degree felony carries a maximum punishment of 30 years in prison. It calls for a minimum mandatory sentence of 15 years and a $100,000 fine.

Brock stood unmoved with little change in expression as Assistant State Attorney Jackie Roys explained the terms of the plea offer.

Defense attorney Michael P. Hines said he hoped to give the judge reasons to go below the minimum mandatory at his client's Sept. 1 sentencing.

Judge Wendy W. Berger said she didn't believe she had the authority to do that but would research it.

She said she at least would be willing to consider anything Hines could offer to make sure the sentence stayed near 15 years.

Brock also agreed to testify truthfully against "any co-defendants" if the prosecution asks her.

That means Croslin, her only co-defendant.

Misty Croslin, is tentatively scheduled to go to trial August 23, 2010 on the same charge Donna Brock originally faced.

She also faces another seven trafficking charges in Palatka.

Circuit Judge Terry LaRue in Palatka told her on June 3 that Aug. 16 is her "last-chance plea date" to work out a deal with the state on those charges.

Ronald Cummings; Hank Jr. "Tommy" Croslin Jr., and Hope A. Sykes were also arrested during the January sting operation.

Hope Sykes was sentenced April 26 to 15 years in prison.

(Tommy) Hank Jr. Croslin pleaded no contest on June 3. He is scheduled to be sentenced this summer around June 21st.

Ronald Cummings is negotiating for a 15-year sentence on five trafficking charges in exchange for testimony at any future trial.

Misty Croslin is now the only defendant left who has not pled
