    "On the eve of Heather Elvis’ birthday, the missing woman’s family braces themselves for another walk into a courtroom and reliving the pain.

    “It’s been five-and-a-half years, 66 months,” Debbi Elvis said of missing her daughter Heather Elvis as she stood beside splashes of teal colored rocks and tin butterflies propped on the edges of Peachtree Boat Landing in Socastee on Tuesday. “We still don’t know any more than we did after that first few months. We know a little more, but the police department hasn’t uncovered any more.”...

    Pretrial motions for Sidney Moorer’s second kidnapping trail are set to be heard Friday at the Horry County Courthouse in Conway.

    Friday, June 21st:
    *Motions Hearing (@ ET) - SC - Heather Rachel Elvis (20) (Dec. 4, 2013) - *Sidney St.Clair Moorer (38/now 43) charged & indicted (2/27/17) with kidnapping & indicted (4/27/18) with conspiracy to commit kidnapping. Plead not guilty.
    Horry County. Will be tried in Georgetown County
    Was convicted & found guilty (8/30/17) with obstruction of justice charge for allegedly lying to investigators about phone call on night Heather went missing and received 10 years with a year served. First probation hearing on 11/27/18, board voted unanimously to keep him behind bars. Denied parole.
    6/6/19: Defense files motions: want to keep Elvis' Tilted Kilt co-workers from testifying. Also want to keep the prosecution from bringing up anything about whether Elvis was pregnant at the time of her disappearance, something that was discussed during Moorer’s initial 2016 trial. A third motion also seeks to limit the time the prosecution has to do further discovery in the case. A hearing on these three motions is set for Friday, June 21.
    6/14/19: State prosecutors asked for the trial to return to Horry County (from Georgetown County) as part of several recently filed motions by attorneys in the case. Or have jurors come from Georgetown County to Horry County for trial. Moorer, defense attorneys & state solicitors are scheduled to be in an Horry County court on 6/21.
    *Tammy Lorinda Caison Moorer (41/now 46) charged & indicted (2/27/17) with kidnapping & indicted (4/17/18) with conspiracy to commit kidnapping. Plead not guilty. Trial was on 10/8/18. Guilty of kidnapping. Guilty of conspiracy to kidnapping. Judge Culbertson sentenced Moorer to 30 years for each sentence, to be served concurrently with time served for any time served thus far (5 yrs). Not eligible for parole.

    Sidney Moorer is set to appear in an Horry County courtroom Friday morning.

    Moorer and his wife, Tammy, are currently serving time for separate charges in relation to the Heather Elvis case.

    However, Sidney Moorer was granted a mistrial in his 2016 kidnapping trial. A retrial date for those charges has not been set.

    He currently serves time for obstruction of justice. The State says he lied to police to stall the investigation in the first 48 hours.

    Earlier this year we reported the Moorer’s hired a lawyer and planned to file a federal suit against agencies involved in the case. The couples’ lawyer says the suit alleges Constitutional violations.

    According to motions filed June 6, attorneys want to keep keep Elvis' Tilted Kilt co-workers from testifying.

    The defense also want to keep the prosecution from bringing up anything about whether Elvis was pregnant at the time of her disappearance, something that was discussed during Moorer’s initial 2016 trial.

    A third motion also seeks to limit the time the prosecution has to do further discovery in the case.

    Update 11:45 p.m. - Judge Dennis Markley agreed to move the trial back to Horry County and try to pick a jury for the September trial.

    Update 11:35 p.m. - Judge Dennis Markley refused to bar evidence related to Heather Elvis’ possible pregnancy from being used during trial. That doesn’t mean he couldn’t change his ruling in the future based on what is said during the trial. The defense argued for that evidence to be banned as it was not relevant to the alleged crime.

    Update 11 a.m. - Judge Markley Dennis grew angry with the state as they argued about comments made by Sidney’ Moorer’s civil lawyer ahead of trial. Sidney Moorer’s civil attorney Eric Poston has made previous statements about Sidney’s innocence. State attorneys objected to those comments and filed charges. There is a gag order that prevents the sides from publicly speaking about the criminal case. The judge decided to continue a decision on contempt charges against Poston until a later date, so he can hire a lawyer to represent him.

    I watched but it was very hard to hear for me, and the feed would get stuck and go in and out. Thank you for the link that contained the details!

    ETA: I did manage to catch the part where Potson was excused as the contempt charges were brought about :);)

    Oh no.

    This is that same judge that sentenced Sydney the first time.

    I will not rehash all the news about him and what happened in the 1st Sydney trial. If anyone is interested you can read back when Sydney's 1st trial was happening.

    A potential bias against woman in general. Past history and how he treated the female prosecutor during Sydney's closing arguments are hints of this.

    Really? Wonder if the state prosecutor was female at the time.

    Gosh I wish this was not the judge this time around. :(
