This thread is to discuss the case of George Floyd. It is not a thread to discuss racism in general.

Unless your post relates to this case specifically, it is off topic and will be removed.

ADMIN NOTE:

Please stay on topic by discussing the trial without introducing the peripheral matters of riots and protests, BLM, all the extraneous chatter about racial inequities and other social justice issues.

We acknowledge, we understand how critical this trial is in relation to those issues, but we need to stay focused on this case and the trial itself. Yes there is overlap with those important issues, but the thread is specifically dedicated to discussing the George Floyd case and the Derek Chauvin trial and not all those other matters.

If members wish to generally speculate on how such issues may have influenced either the victim or the accused, that's fine, but please don't bring in specifics related to all those other matters and derail the thread with social justice issues that will not be resolved in this discussion.

Thanks !!

ADMIN NOTE:

To say simply that GF possibly had fear as a black man was left as reasonable speculation that doesn't warrant dissecting it any further. IF GF had that fear, surely we can all understand where it may have originated.

Quite a few posts had to be removed due to general back and forth bickering. There is no way to edit that many posts and be able to retain context so a lot of responses got removed in the process.

ADMIN NOTE:

Members have been previously advised not to trash the witnesses. They are not there for our enjoyment or entertainment and there is no need to publicly disparage them or belittle them.

Keep it classy folks !!

Thank you.

ADMIN NOTE:

We're getting pretty close to some thread reply bans being issued in this discussion.

It is not necessary to respond to and debate every single post. State your opinion and move on without bickering or trying to win a debate.

Thanks !!

Prosecutors are expected to rest on Tuesday after finishing some procedural matters, calling no more witnesses.

Once the defense takes over, Chauvin attorney Eric Nelson is expected to have his own experts testify that it was Floyd’s drug use and bad heart, not Chauvin’s actions, that killed him. Closing statements are expected Monday.

The defense hasn’t said whether Chauvin will take the stand.

4/12/21 Monday, Trial Day 11: Each morning of the trial the judge has set aside 9am CT/10am ET for any motions/issues with attorneys. Motion hearing: Defense attorney Eric Nelson argues a sixth use of force expert Seth Stoughton would be cumulative. Same analysis that others have gone through: Steiger, Mercil &Chief have already testified to as to use of force. As prosecutions wants to play video again. Schleicher says this expert is an academic & he takes an academic. Judge Cahill: "Well, the court concern, we're pretty clear before is that motions in limine, we're not going to call every cop & ask him, What would you have done differently & basically I think the State has almost done that.” Judge rules state expert Seth Stoughton can testify on limited basis regarding national policing standards & related use-of-force violations he found during Floyd's deadly arrest. Judge Cahill has now moved onto potential testimony of Floyd companion Morries Hall outside the presents of jurors. Cahill says he plans to put him on witness stand tomorrow to see if Hall does indeed plan to invoke his 5th A privilege & not answer attorney questions. Defense attorney Nelson tells Judge Cahill the state doesn't intend to offer Hall any immunity in the case. Hall spoke to investigators, denying he gave Floyd drugs on day of Floyd's death. Seems Nelson wants state to offer some level of immunity to get Hall on stand. Nelson is asking sequestration of the jury as a result of the Brooklyn Center shooting & overnight unrest. Nelson asks that the jury be voir dire again to ask if they know about what happened yesterday, if it will impact their decision making process & that they be sequestered. Cahill: I'm going to deny the motion to sequester the jury & for additional voir dire. This is a totally different case & I realized there's civil unrest & maybe some of the jurors did hear about that. Judge Cahill just told the court, he plans to have closing arguments a week from today, on Monday, April 19th. That will give jury next weekend to get affairs in order, pack bags over weekend & then begin their deliberations after closings.
State’s witnesses: Blackwell on direct: 36) Dr. Jonathan Rich, Chicago area cardiologist. Nelson on cross. Re-direct & re-cross. Judge denies defense motion to compel prosecutors as to why they are not offering Morries Hall immunity. Also if Hall invokes 5th & refuses to testify, the defense CANNOT bring in Hall's past interview as none of the Q&A is admissible. 37) Philonise Floyd, younger brother of George. No cross by Nelson. 38) Seth Stoughton, former police officer & now a criminal law professor re use-of-force expert. The State played the part of the body camera video where Chauvin tells Floyd "it takes a heck of a lot of oxygen" in response to Floyd's distressed talking. They played another clip & you hear Officer Lane saying Floyd’s not responsive to paramedics. Stoughton notes that bystanders are pleading with officers, Ofc. Keung checks Floyd’s pulse before saying he can’t find a pulse. Stoughton says you hear Chauvin say “huh” & Keung clarifies. Nelson on cross. And re-direct.
Judge Cahill tells jurors they expect to move to defense’s case tomorrow. Says they might be done by the end of the week & potentially take Friday off. He tells them his preference is to have closing arguments on Monday. In recess now until 9:15 a.m. tomorrow, 4/13/21.
Morries Hall had a hearing this morning in Redwood County unrelated to the ChauvinTrial. He appeared via Zoom in jail clothes. Redwood Co. Charges: On 10/16/19 Ct 4 - Controlled substance crime - meth Ct 5 - Controlled substance crime - meth, heroin, fentanyl, tramadol (other drgs) Ct 6 - Controlled substance crime - cocaine Ct 7 - Possession drug paraphernalia.
*Charged (7/22/20) with 6 counts of aiding & abetting taxes-false or fraudulent returns-filed with commissioner & 3 counts aiding & abetting taxes-failure to file return, report, document. – Omnibus hearing on 6/30/21.

Live link for today
(ETA: 9:31 Commentators are live now discussing. Two women of Asian descent have sat in Chauvin's family seat on two different days. Just noticed that the placeholder for the below video has the face blocked out for the woman in red in back. As to M. Hall aka 5th amendment guy that fled the state to Tx after GF died... Statement to investigators cannot be show, it's unclear if he will be testifying... and per commentator is left hanging. Cannot find S. Hill who was other passenger)

ETA #2. 9:40 They (Washington Post) just changed photo on the placeholder and no longer is the woman with blocked out facial area.

Can someone refresh my recollection as to "where we are at" at the moment in relation to the "5th amendment guy"?

TIA

according to this morning’s news:

Morries Hall-man with George Floyd on day he died-to take the stand - KTOE

Morries Hall is expected to take the witness stand today. Hall plans to invoke his 5th Amendment right against self-incrimination. Defense attorney Eric Nelson argued that if Hall does not offer testimony, his interview with investigators after Floyd’s death should be admitted into evidence. Judge Pete Cahill however ruled…

“None of the statements in the question and answer statement are admissible.”

They are putting him on the stand knowing he will say nothing atall? Can Nelson ask for a mistrial due to this? Seems a waste of time getting him up there just to plead the fifth, Nelson will be talking to himself...
