MN - George Floyd, 46, died in police custody, Minneapolis, 25 May 2020 #4 - Trial Day 1

3/29/21 Monday, Trial Day 1: All 14 jurors showed up. #15 is being let go. Parties will argue a state motion filed late Friday about what can be said opening statements about Floyd's 'intent.' Jurors was brought in around 9:30am. Judge gave them instructions. Jerry Blackwell, special prosecutor gave opening statements for the State & Eric Nelson for the defense. Blackwell showed the 9 minutes of Floyd's arrest to jurors. Blackwell showed jurors this screenshot explaining who each bystander is & what they will testify to. Blackwell - No evidence that Floyd knew the $20 was counterfeit. Eric Nelson: the evidence will show Mr. Floyd died from a bad heart, drugs & other things. You will find Mr. Chauvin not guilty.
State witnesses questions asked by Prosecutor Matthew Frank. 1) Jena Scurry, 911 dispatcher & who alerted a supervisor that something was awry in the incident. Played 911 dispatch call for jurors. Prosecution played some CCTV video from elevated city security cameras directly across from Cup Foods. Exhibit #11 is basically the vantage looking down from the Speedway signage at 38/Chicago intersection. Jurors watched CCTV footage of the scene. Officers try to place Floyd in the driver's side backseat. While trying to pull him through from the passenger backseat, during the struggle, Floyd ends up hanging part way out so officers pull him out to the street. Cross examined by Nelson. Questions by Pro Steve Schleischer: 2) Alisha Mariee Oyler, worked at Speedway gas station. She took seven cell phone videos. 3) Donald Wynn Williams II. Was a bystander & has a place about a block away from Cup Foods, worked in private security & a bouncer & a MMA fighter. The media center lost wifi, all feeds coming out of there were lost. The judge adjourned court for the day stating he needed to give the public access. Court done for the day. Williams will be back on the witness stand at 9:30am. Trial continues on 3/30/21.

*Charged (7/22/20) with 6 counts of aiding & abetting taxes-false or fraudulent returns-filed with commissioner & 3 counts aiding & abetting taxes-failure to file return, report, document. – Omnibus hearing on 6/30/21.

The second day of Derek Chauvin's trial in George Floyd's death is set to begin Tuesday with further questioning of a professional mixed martial arts fighter who stumbled onto the scene of the 46-year-old Black man's final moments.

Chauvin could be convicted of all, some, or none of the charges. Minnesota's sentencing guidelines recommend about 12.5 years in prison for each murder charge and about four years for the manslaughter charge.

That's exactly what it looked like, since Floyd had no pulse, was completely lifeless, and Chauvin kept up the pressure on his neck for about 2 or 3 more minutes, after he appeared to be dead. Then they just flopped his lifeless body onto the stretcher and took him away. Apparently they only told EMT that he had a "medical event." I wonder if they had said he didn't have a pulse, if EMT would have worked on him at the scene. I always thought they tried to stabilize patients right at the scene before loading them into the ambulance.

I posted a link earlier that said that Lane performed CPR on George in the ambulance. I wonder what that was about. The EMTs didn't perform the CPR?
Perhaps they were doing some other measures in trying to resucitate George. Shocking his heart, maybe, trying to get it to restart? Or perhaps there is something else they do for a compression injury.

Chauvin removes his knee when medical personnel arrive, but chest compressions do not begin until a worker instructs Lane to perform CPR on Floyd in the back of the ambulance.
New George Floyd video show medics waiting three minutes before performing chest compressions

Lane joined emergency responders in the ambulance and began performing CPR on Floyd at the request of emergency personnel, but Floyd was pronounced dead at the hospital that evening.

Lane, his partner Kueng, and Chauvin knew he didn't have a pulse. (Lane's partner Kueng checks at 18:03 and says "I can't find one"..and Lane and his partner then get off of GF at that time...and other times in video below they check) EMT knew he didn't have a pulse. That's the first thing they did when on EMS got on scene as shown in video below toward the end. (Can be seen more clearly on the bystander video which we've seen)

The reason they loaded and left so quickly, and told them they were going to a few blocks away was because at 20:15 it was said by LE "lets' get him out of here", probably due to the gathering crowd MOO. The video posted upthread toward the end shows Lane in the ambulance and what was done to finally give mechanical compressions at 59:13:00. It also shows that as Lane leaves, he comes back to the ambulance and the mechanical compressions that were going on had ended at 1:04:35.

MOO

When someone says they can’t breathe whilst you have your knee on their neck you move it and restrain in another way. If GF was already handcuffed why the need for such brutal force? When a grown man is pleading for his mother and telling you he’s going to die, and you keep your knee in place applying pressure to his neck while he is completely sandwiched between your knee and the ground, if someone has to repeat 27 times that they can’t breathe and you do NOTHING you are a murderer, plain and simple. DC intended to cause harm because he was warned no less than 27 times by George himself and who knows how many times by onlookers that he was going to kill him if he didn’t stop. Yet he carried on, in an act of defiance and a power trip. I don’t care whether GF had drugs in his system or a fake $20, he did not deserve to die in such an inhumane way.

Feed is live. We have the seal... Judge said 9:30 central time start today. (and per Niner above too) That's about an hour from now, but they again may start a few minutes early if jurors are there?

Yes, I have no doubt they knew how dangerous that maneuver was and Chauvin knew the risk he was taking. The mayor banned it in 2019, but the union police chief argued that it was necessary and he would keep training officers who wanted training.

There is a video in an earlier thread showing the proper way to use the maneuver (although it's now banned) and it shows the officer kneeling on the suspects neck for just seconds, then they roll him over and stand him up immediately. There's no reason they could not have done that, especially since Floyd was already handcuffed.

Chauvin made a conscious decision to continue his actions, knowing full well he was causing harm.

We're getting a slightly early start at #DerekChauvinTrial Day 2. Judge Cahill has set an 8:30am motions hearing on an issue of whether some state witnesses who are considered minors will be entitled to some privacy protections when they testify in open court today. @FOX9

One of the minor witnesses is the person that filmed the now viral video. She was a minor at the time. Will we get to hear her testimony? The judge will rule this morning. She's pictured in the royal blue pants.

On the record 5 minutes ago with judge, and discussing the motions of minors that they don't want to be heard or seen, and want them to be exempt from requirement. State filed this motion that minors at the time are exempt from audio and video both. And if court demands that they use audio, do without their name... or at least no last name/use initials.

Media coalition Rep suggests that when introduced to have the audio off when names are said. On the specific female " DF " witness, the girl who had the viral video is now no longer a minor. She has no problem with ID'ing herself.

(Court already said no video is OK, but State motion wants audio nixed for 4 of the witnesses they plan on having) 2 of the 4 were minors at the time, but are now adults.

Judge RULES ... ID of ALL FOUR of them will be off audio. Then audio comes back on.. can be referred to as first name. He will continue to suppress all 4 for video feed. He said that media will hear their names (assume that media will honor not publishing names, although judge didn't admonish them not to)

He talked about the power surge problem to the server yesterday as to why they ended early. (Feed to family upstairs knocked out). Media has kindly offered up a backup to the court so this doesn't happen again, court accepted the offer. :D

We are now again in recess. Judge said back at 9:15 or 9:30 (he was iffy) central time.

#DerekChauvinTrial - Media coalition spokesperson addressing the judge asking to allow audio at the least for minor witnesses saying it's important for public access. She agrees using initials or first names only.

Media attorney tells the judge she doubts Darnella Frazier, the person that took the viral video, is requesting to remain anonymous as she's done plenty of media/social media posting plus she has now turned 18.

Judge denies state's motion and will allow audio broadcast of minor witnesses, he says with one exception, that when they state and spell their names, that will be no audio.

TESTIMONY RESUMES: Donald Williams was just asked under direct examination if either he or any other bystanders threatened the safety of police at scene of #GeorgeFloyd deadly arrest. He says, no one did. Remember, defense argues that crowd was a "threat." #DerekChauvinTrial

Eric Nelson stepping up to cross examine Donald Williams, the MMA fighter who called out #DerekChauvin chokehold at the scene of the deadly arrest. Williams has taken several deep breaths here, seems like testifying over the last 2 days has taken a toll on him.
