This thread is to discuss the case of George Floyd. It is not a thread to discuss racism in general.

Unless your post relates to this case specifically, it is off topic and will be removed.

Please stay on topic by discussing the trial without introducing the peripheral matters of riots and protests, BLM, all the extraneous chatter about racial inequities and other social justice issues.

We acknowledge, we understand how critical this trial is in relation to those issues, but we need to stay focused on this case and the trial itself. Yes there is overlap with those important issues, but the thread is specifically dedicated to discussing the George Floyd case and the Derek Chauvin trial and not all those other matters.

If members wish to generally speculate on how such issues may have influenced either the victim or the accused, that's fine, but please don't bring in specifics related to all those other matters and derail the thread with social justice issues that will not be resolved in this discussion.

ADMIN NOTE:

To say simply that GF possibly had fear as a black man was left as reasonable speculation that doesn't warrant dissecting it any further. IF GF had that fear, surely we can all understand where it may have originated.

Quite a few posts had to be removed due to general back and forth bickering. There is no way to edit that many posts and be able to retain context so a lot of responses got removed in the process.

As the trial of former Minneapolis police officer Derek Chauvin in the death of George Floyd headed into its second week, the Democratic congresswoman Ilhan Omar said residents remain “on edge” about the outcome.

On Sunday on CNN’s State of the Union, Omar was reminded that few trials involving police officers result in conviction, and asked: “Are you and your city prepared for the possibility of a hung jury or a not-guilty verdict?”

“The community is on edge about that,” Omar said. “We have seen justice not delivered in our community for many years. I think that there is a lot of confidence in [state] attorney general Keith Ellison and the prosecutors in this case, but we are all eagerly awaiting to see how this trial shakes out.

“It’s been really horrendous to watch the defense put George Floyd on trial instead of the former police officer who’s charged with his murder.”

Monday, April 5th:
*Trial continues (Day 6) (@ 9am for motions; trial @ 9:15am CT) - MN – George Perry Floyd, Jr. (46) (May 25, 2020, Minneapolis, arrested for forgery & killed in police custody) - *Derek Michael Chauvin (44/now 45) police officer who held his knee on Floyd’s neck for 8 minutes & 46 seconds (Note: on 10/14/20 this has been changed to 9 minutes & 30 seconds) (& non responsive for 2 minutes & 53 seconds before officer took his knee off his neck; from 8:19pm to 8:28pm his knee was on Floyd’s neck; has been fired (5/26/20) & arrested & charged (5/29/20) with 3rd degree murder & 2nd degree manslaughter. Charges changed (6/3/20) to 2nd degree murder-unintentional-while committing a felony, 3rd degree murder-perpetrating eminently dangerous act (3rd degree charge was dismissed on 10/22/20 & reinstated on 3/11/21) & evincing depraved mind & 2nd degree manslaughter-culpable negligence creating unreasonable risk. $500K bond, reset (6/8/20) @ $1.25M & $1M with conditions. Posted non-cash $1M bond (10/7/20) & has been released from jail.
Trial began on 3/8/21 with jury selection. Jury selection ran through March 23, 2021. Trial with opening statements & the commencement of the State’s case began on March 29, 2021. Experts anticipate the trial could last 2-4 weeks. Jurors: 12 & 2 alternates (9 women & 5 men). Jurors will be sequestered during deliberations. None of the other officers will be testifying at Chauvin’s trial.

Judge ruled that 2 out of 8 prior incidents with Chauvin would be coming in as "he knew better" for #3 & modus operandi evidence for #5:
Incident No. 3 — Aug. 22, 2015: On August 22, 2015, Defendant Chauvin participated with other officers in rendering aid to a suicidal, intoxicated & mentally-disturbed male. Chauvin observed other officers physically struggle with the male & one officer used a Taser on the male, to little avail. Eventually, the officers were able to put the male on the ground & place handcuffs on him. Chauvin & the other officers then immediately put the male in the side-recovery position, consistent with training. Chauvin rode with the male to the hospital for medical care. Officers involved in the response received a recommendation for an award for their appropriate efforts & received feedback from medical professionals that, if officers had prolonged their detention of the male or failed to transport the male to the hospital in a timely manner, the male could have died.
Incident No. 5 — June 25, 2017: On June 25, 2017, Defendant Chauvin went to place a female under arrest in her home. As the female walked by, Chauvin grabbed one of her arms & told her she was under arrest. The female tried to pull away & Chauvin applied a handcuff to one wrist. As the female tried to twist away, Chauvin pulled her down to the ground in the prone position & kneeled on her body to pin her to the ground. After being handcuffed, the female refused to stand, so Chauvin carried her out of the house in a prone position & set her face down on the sidewalk. Even though the female was not physically resisting in any way, Chauvin kneeled on her body, using his body weight to pin her to the ground while another officer moved the squad car closer. Chauvin then directed the other officer to apply a Hobble restraint to the female even though she was not providing any physical resistance. Chauvin’s conduct in kneeling on the female during this entire time was more force than was reasonably necessary under the circumstances. See post #385 here:

4/2/21 Friday Trial Day 5: Each morning of the trial the judge has set aside 9am CT/10am ET for any motions/issues with attorneys. No motions this morning. Judge: We are ahead of schedule & will take tomorrow afternoon. Out about 12:30pm.
The state asking Judge Cahill, if there's a conviction, for an upward departure on sentencing, meaning the judge has the discretion to increase the sentence if certain factors apply. Since Chauvin has no prior convictions, the top count would only bring 12.5 yrs, state wants more.
State witnesses: 18) MPD Sgt. Jon Edwards, training officer & assigned to night shift & responded to & secured scene. No cross. 19) MPD Lt. Richard Zimmerman, he is the direct supervisor in Homicide & made sure crime was secured & for other officers to looked for witnesses. Nelson on cross. And re-direct. And done for the day - jury excused until Monday, 4/5/21 @ 9:15 to 9:30am; there will be a motions hearing in the morning.

*Charged (7/22/20) with 6 counts of aiding & abetting taxes-false or fraudulent returns-filed with commissioner & 3 counts aiding & abetting taxes-failure to file return, report, document. – Omnibus hearing on 6/30/21.

Opening Statements
1) 911 MPD Dispatcher Jena Scurry (not to be confused with 911 call taker or fire dispatcher)
2) Speedway gas station cashier All*sha Oy*er
3) MMA guy D*nald W*lliams (prosecution only today)

Day 2
3) witness - From Yesterday, defense follow up etc with MMA guy D*nald W*lliams - he called 911
4) witness - Darn**la - was minor at the time and now 18 - she did the "viral video" that the world has seen and had little cousin with her in green shirt
5) witness - Little cousin in green (not posting any info here at WS... due to minor)
6) witness - Aly*** who was wearing white shirt and blue jeans in group shot.. knows witness #4 from school and knows another person there she drove there with ( young female K**lyn at scene with large bag on shoulder who is #7 witness) She drove up after FG was on ground -took 3 videos.
7) witness - K**lyn (?sp) Arrived with #6 witness. Minor, 17 year old. Friend of #6 Aly***. She circled her photo of standing on the curb.. had large beige bag on shoulder next to MMA guy.
8) witness - 27 yo Lady firefighter/EMT GH who was in all black with white headband that day, with CPR training (wearing uniform in court) from Minneapolis who was on a walk who took video and did 911 call. She was 7th person to arrive on the curb with others watching . The judge chewed her out at the end of today for "arguing with the court" and arguing with attorneys.

Day 3

15) Eerek Smith - Ambulance/EMS who did pulse and compressions
16) Jeremy Norton - Captain/EMT at firestation #17 who responded to scene/2nd scene
17) David Pleoger - MPD Sgt. who took call from dispatcher complaint, went to scene, went hospital.

Day 5 - Friday
18) Sgt Jon Edwards - MPD who took over shift from Pleoger
19) Richard Zimmerman - MPD Investigator for critical incidents;prior to turning over to BCA upon death of GF

Chief of Police will testify today according to the local streams last Friday! He fired all the officers the day after the incident. He’s going to be a great witness for the state I think. Curious to see how Nelson is going to handle that. “Your job is mostly administrative, right?” “ You’re not on the streets day to day patrolling?” “Are you even required to do the basic defensive training that all officers do?”

I found Richard Zimmerman to be an excellent witness, took no loyalty to either party and stuck with the truth.... and truth speaks for itself

Thing is, Zimmerman has had less conflict because he isn't aggressive, doesn't rock up gung ho over a $20 bill. There is the difference IMO.
Cared enough to arrive at the scene and look for the truth, cared more than DC.

I know we’re far off from the defense’s case but ran across this about one of the defense experts:


NEARLY TWO YEARS before George Floyd was pinned under the knee of former Minneapolis police officer Derek Chauvin, Anton Black was pinned to the ground by police outside his home in Greensboro, Maryland.

On September 15, 2018, body camera footage captured the 19-year-old struggling under the weight of multiple officers, laboring to breathe and crying out for his mother.

Black’s mother watched her son die in front of her. He used his last breaths to shout “I love you.”

Dr. David Fowler, who was the chief medical examiner of Maryland for nearly two decades, classified Black’s death as an accident. Now, he is an expert witness for Chauvin’s defense and is expected to offer testimony as to how Floyd died last year.

The forensic pathologist, who resigned from Maryland’s medical examiner office in 2019, is one of several parties being sued by the Black family for wrongful death and civil rights violations.

I think I missed Nelson using the word ceremonial. Was he implying Zimmerman didn't have enough experience in the field? Or making arrests? Somehow I can't see Zimmerman yelling, "Get your (blankin) hands on the wheel!" In the manual it says officers are not to use harsh language or profanity. Not that I doubt they do once in awhile. I think Lane was very nervous.

It was included in the question about when he has to wear a uniform. Typically Lt Z is plain clothes
