Thao's video shows him attempting to grab a "hobble" for #GeorgeFloyd as the other three officers are on top of him next to squad vehicle. The hobble is ultimately not used. The prosecution said that may have saved Floyd's life since it would put him on his side.

Tou Thao's body worn video shows his interactions with bystanders who become increasingly upset as George Floyd goes unresponsive. At one point, Thao pushes a bystander who walked closer to him on the street. He tells everyone to stay on the sidewalk.

The witness list has not been made public for today in the trial of the three ex-MPD officers charged with violating #GeorgeFloyd's civil rights from May 2020. So, at this point we don't know who else the government will call today at St. Paul Federal Trial.

Martin also worked at Cup Foods. He had worked there about 2-3 months before the May 25, 2020 incident happened. He was working at the time of the incident. He said he saw #GeorgeFloyd earlier that day. Floyd was getting his phone fixed and they had small conversation.

Questioned by US Prosecutor Samantha Trepel, Martin said that #GeorgeFloyd appeared high, based on his reaction time to questions. Martin said it didn't look like Floyd had trouble moving. Video is being shown of their interaction in the Cup Foods at the cashier stand.

Martin says Floyd was asking about tobacco. Martin told him he'd have to "loop back around" the store and enter the separate door to get to the tobacco section. Later, Martin describes taking the $20 bill from Floyd and examining it, determining that it appeared fake.

Court resumes with defense attorney Robert Paule (who represents Tou Thao) cross-examining the prosecution’s witness, Christopher Martin, who worked (and lived above) Cup Foods at the time of the May 25, 2020 incident. Going over his earlier testimony.


Paule asking Martin about his interviews with authorities following the incident. In one interview, Martin said there was a "heavy police presence" in the area of Cup Foods.

Defense atty Paule continuing to ask Martin about his interactions with Floyd, this time when Martin and co-workers were speaking with him at the SUV. Martin said Floyd, at times, had his arms up in the air with his hands by his head.

Next witness for the prosecution is Charles McMillian, who could be heard in video telling #GeorgeFloyd "you can't win" during the arrest, telling him to comply with police.

During Derek Chauvin's state trial, McMillian provided emotional testimony.


Prosecution is running through the series of events, starting with Charles McMillian's arrival on the scene. "I heard a commotion" and was "being nosy," he said. #GeorgeFloyd

Prosecution's Allen Slaughter continues to ask Charles McMillian about what he sees during the incident. He arrived when officers were trying to get #GeorgeFloyd into the squad and stayed while Floyd was in the prone position.

As video shows him pleading to let #GeorgeFloyd breath, Charles McMillian is emotional and said he had a friend die in a squad car in Robbinsdale, and he didn’t want that to happen again.

Court goes in sidebar. After, judge tells jury to disregard that answer.

Charles McMillian, when asked what his concerns were at that time, answered that he was concerned that #GeorgeFloyd was going to die. He stayed at the scene until the ambulance arrived. He said he didn't see the officers treat Floyd at any time before that.

Prosecution asks for a break. Judge grants it. Court goes into an early afternoon break.

Defense attorney Earl Gray now cross-examining Charles McMillian. Asking about what he heard as officers attempted to get #GeorgeFloyd into the squad vehicle. Agreed that he heard one of the officers, Lane, say he'd roll down a window if Floyd got in.

Defense atty Gray asking what Charles McMillian "didn't see" during incident. He agrees that he remembered Tou Thao searching for a "hobble" but doesn't recall officers saying an ambulance was on the way. Doesn't recall an officer's request to roll Floyd over.

In redirect from prosecution, Charles McMillian asked if #GeorgeFloyd was violent toward the officers. McMillian said he wasn't. Also said he didn't see Floyd resisting.

Next up: Prosecution calls up Jena Scurry, 911 dispatcher for Minneapolis. She's been a dispatcher for 8 years.

Federal prosecutor LeeAnn Bell running through background/procedures of 911 dispatch work with Jena Scurry.

Jena Scurry was working 911 dispatch during the #GeorgeFloyd arrest/murder. She received a 911 report concerning the incident shortly after 8 p.m. on May 25, 2020.

Chauvin/Thao were initially assigned to the scene, but it was reassigned to Kueng/Lane.

Jena Scurry says, if 911 dispatchers are told someone is having trouble breathing/not breathing, they would add “rescue” to the incident. Rescue includes firefighters that can be pretty much anywhere in Minneapolis in 4 minutes.. Scurry says she didn’t hear of breathing problems.

In many/most cases, 911 dispatchers don't have access to video sources. In this case, there was a traffic camera showing the scene. Jena Scurry said she remembered seeing #GeorgeFloyd and officers on the sidewalk. Next time she looked, the back doors of the squad were open.

911 dispatcher Jena Scurry later could see the squad car moving back and forth, like there was something shaking the vehicle. Then she later saw #GeorgeFloyd on the ground with the officers.

Jena Scurry said she thought the video was frozen when she looked back because the officers were still on top of #GeorgeFloyd in the same position.

Scurry said she was concerned something was "wrong" since the scene wasn't changing, and additionally because there was no updated information coming in. She said she "took it upon herself" and called the sergeant in charge to see if additional assistance should be sent.

After questioning about the timeline, defense attorney Earl Gray notes that it took about 7 minutes for the ambulance to arrive at the scene after a "code 2" was called for a mouth injury. Scurry agrees.

When asked if Cup Foods is a high-volume area for police calls, Scurry said she's not sure and would need to look at that information.
