Sex offender ruling won't have immediate local effect
Just a few months before a federal judge declared Minnesota's sex offender program unconstitutional, a sex offender facing commitment in Benton County argued just that.
Kerry Lenz, 56, was convicted of kidnapping and raping two strangers two weeks apart in 1989 in Benton and Stearns counties. The petition seeking to commit him included details of several other sexual offenses he committed, some of which led to criminal convictions in North Dakota.
Lenz's attorney argued that the state statute that allows for civil commitment was unconstitutional as it pertains to Lenz's case. A Benton County judge disagreed and in April committed Lenz to the program that last week was ruled unconstitutional by U.S. District Court Judge Donovan Frank.
