Here is what I read....

Prosecutors then told the judge they do not intend to seek the death penalty against Antoinette Davis.

West said that after consulting with the state Attorney General's Office, prosecutors determined that a U.S. Supreme Court decision in 1982, Enmund v. Florida, would preclude the death penalty because Davis did not intend for her daughter to die.

That case established that the Constitution's Eighth Amendment prohibits death sentences for defendants in felony murder cases who did not themselves kill, try to kill or intend to kill anyone.

Well, here are the charges/cases scheduled in the Cumberland County Courthouse for 11-01-11, in Courtroom 004A, for MAM. He is not alone on this docket for this day, to be sure.

The docket of those to appear in Room 004A on that date is not published yet. Of course we must remember that just because it's docketed does NOT mean that the particular trial will be heard (or start) that day...

Since those two are scheduled for the same day, seems to me that it's very unlikely that either trial will begin on 11-01-11, unless they are to be tried together. Who knoze??

Truthfully, I am not an advocate of the DP under any circumstances- wish the justice system would instead be completely overhauled so that life in prison actually meant life. And I don't mind my taxes going toward the maintenance of even one potentially innocent person that might be on death row, or executed. Every innocent life should be protected, invho.

But man, Shaniya's case is really trying me. There is not a doubt in my mind who is guilty here. I don't need to sit through the trials to find that out. But I do need to sit through them for Shaniya.

We really do need an emotional toll thread downstairs. This is going to be rough. :grouphug:

While I 'get it' and after FCA I even know the DP is probably not the road to take for AD, how do they know she didn't intend for Shaniya to die? Because she said so? Hogwash! She knew she was handing her precious baby over to be raped to settle her own drug debt...I don't think she gave a flying fig what MAM did with her when he was done. Failure to protect should count the same as any other accomplice to murder, whether there was explicit intent or not.

Oriah, I was never pro DP but this type of crime pushed me over the edge. MAM will serve no useful purpose to anyone for the next 50 years or so in prison - just like Lucas Coe who raped and beat 4 yo baby Emma Thompson to death after inflicting her with herpes. Emma's mother (gah) failed to protect her too. There are some crimes that just can't be tolerated in society and these subhumans need to be stopped forever. Aside from preventing them from ever hurting another child, I fail to see why they should be allowed simple human pleasures like eating and breathing. I guess that sounds vindictive and heartless, I should work on that.

This is the sweetest thing I've read in a very long time...it's sickening that it has to be under such bitter circumstances.

Also, thank you to all of the devoted posters in this thread and the updates from everyone. Shaniya's last captured photo / video still haunts me...so much so that I can hardly stand to come read here...so I greatly appreciate everyone's efforts keeping everyone updated.

Please! I have no doubt in my mind that AD didnt care if her baby lived or died! She obviously isnt the type of person to want to deal with The after affects of a child being raped or having to explain to Shaniyas dad about that either. Collateral, yes I see that part as well, but giving that child up to be raped and NOT getting the DP? And I wonder why childrens lives mean nothing to these miscreants! Gah!! Oriah I'm keeping you close in my thoughts. I've mostly stayed away from this thread because it just hurts too much. Knowing how many people failed Shaniya...how many people had the chance to prevent this from ever happening (without knowing of course that rape and murder were possible). Her father, her aunt, her teachers, her grandparents, her older siblings. All these people had to know what a horrible "place" Shaniya was in and yet she remained. (Or in the case of the school, where she was removed but never transferred and fell through the crack.) Please understand IMO not all these people share the same culpability and I'm sure their lives are forever changed because of what happened to this baby girl - I just cannot imagine leaving a baby in that h*llhole.

I haven't given much thought to why MAM did what he did except because he could. AD gave MAM her permission to rape her baby ( :cry: :cry: ughhhhh :cry: :cry: ) when he saw what he had done - the damage he had caused, he had two choices: get her to a hospital or get her out of his car and shut her up. He didn't even apparently try to distance himself from the crime, he was seen on footage wearing a black sweatshirt and IIRC Shaniya was found dressed in just an adult black sweatshirt. He had his cell phones with him (with child *advertiser censored* pictures on them!), he turned them over to LE like it was no big deal. Look at his mug shot... just blatant mockery all over his face - that smirk :sick: I can't imagine what his defense will be. Maybe on some level (sick SOB that he is) this whole thing was worth it to him. I just don't know. Kudos to LE that his face was still in one piece.

AD on the other hand I have thought about. I think she was jealous of Shaniya. I don't think she felt much of anything else as far as maternal instinct because every drop of blood that courses through a mother's veins is bent on protecting their child and she surely failed in this. Did she hate Shaniya's beauty, her innocence, her youth as she saw something in Shaniya that was everything she is not?

According to BL (Shaniya's dad) AD asked him to take custody of 1 year old Shaniya. She was loved, happy, cared for and secure, privileged even. Possibly things AD never knew. Then weeks before Shaniya was murdered and for reasons I don't really know or understand - BL returned Shaniya to AD's custody. Apparently not even doing the transfer himself, IIRC. First thing AD does, is stop taking Shaniya to school.

Here's AD with a drug habit, a 7 yo and another baby on the way living in a dump with her sister, the bf and their baby. Shaniya was dumped in her lap and I honestly don't think AD was even a little bit happy about the situation. I doubt Shaniya was happy either, something that added to AD's displeasure.

Unlike a lot of people here, I don't believe Shaniya was raped in that mobile home. I believe the feces found on the porch was nothing more than ruptured sewage (there would have to be a lot of waste to get a home declared unfit). I also don't want to believe that there can be that much depravity and evil under one roof.

AD is pregnant by CC - MAM comes calling for his $200 which AD either doesn't have or refused to pay. MAM gives her the chance to "work off her debt", something that AD also declines. Somehow Shaniya's name comes up and for reasons normal people will never understand AD hands over her baby to him as payment. This happened in the very early hours of the morning. AD allowed that animal to leave her "home" with her baby, knowing full and well what was going to happen to her. $200!! Another reason I don't believe SA was happening in the "home", why hand over cash for a hotel room if you don't have to?

AD will say she last saw Shaniya at 5:30 - I found the statement that the check in video was filmed at 6:11AM. Sometime after 6:30 AD called 911 claiming Shaniya was "missing" - later pointing a finger at CC who is arrested but released after MAM is seen in the video.

I haven't found the statement but IIRC LE said they were given a tip where to find Shaniya some 6 miles or so from the hotel - I never heard who provided the tip except it wasn't MAM.

Everything that AD did from the 911 call on was to deflect her own guilt. If she cared even a little for Shaniya she would have called 911 immediately, failing that, when she did call 911 she would have given accurate information, including who Shaniya was with. She just doesn't care - MOO.

My guess is someone else told AD to call 911 when they woke up and noticed Shaniya was missing.

I get absolutely nothing from looking at this picture of AD, no loss, no sorrow, no regret, no pain. A void. Our poor baby. I'll never understand how a woman (let alone a mother) can hand over a baby (her baby!) to be sexually abused. Never. Such a betrayal.

Later in the nearly three-minute call, her voice is completely calm as she noted twice that Shaniya knew how to unlock the front door.

"I'm telling you she knows how to unlock it. I'm hoping that she didn't unlock it and walk out," Davis told the dispatcher.
