The Weaverville suspect charged in the murder of a Mills River man was indicted by a McDowell grand jury on charges stemming from the aftermath, according to court records.


Phillip Michael Stroupe II, 39, of King Road in Weaverville, faces one count each in McDowell of felony fleeing to elude arrest, reckless driving to endanger, resisting a public officer, possession of a firearm by a felon, possession of methamphetamine and possession of a stolen motor vehicle.

The first-degree murder trial for Phillip Michael Stroupe II is scheduled to begin July 23, 2018, at the Henderson County Courthouse. The judge will hear pre-trial motions during the week of May 28, 2018.

“The only pending motion at this time is the defendant’s request to change the county where the trial is held," in a news release. "There will be other motions filed, perhaps by both sides, that will be addressed by the judge on May 28 of next year.”

The defendant’s father, who also faces charges related to the case, remains in the Henderson County jail.

Stroupe II will be back in court Dec. 11, 2017, during the administrative session of Superior Court. He is being held in custody on no bond.

Phillip Stroupe II, a 39-year-old Weaverville resident with a lengthy criminal record, was the subject of one of the area's biggest crime stories of 2017. His fate may be decided as early as next year: Prosecutors are seeking the death penalty.

District Attorney Greg Newman — who represents Henderson, Transylvania and Polk counties — said a hearing to go over pretrial motions is set for May. He said he plans to call the case for trial in July.
Stroupe, who police said killed 68-year-old Thomas Bryson while on the run from authorities, faces more than 15 charges in five counties: Henderson, Buncombe, Yancey, Transylvania and McDowell.

The most serious charges will be tried in Henderson.

A judge agreed on Tuesday to postpone the capital murder trial of Phillip Michael Stroupe II for three months to give prosecutors and defense attorneys more time to review new evidence.

Judge W. Robert Bell of Mecklenburg County granted the continuance after Stroupe's defense team said it needed more time to review evidence both sides had recently received, court officials said. The trial is now set for May 6. Bell denied defense motions asking the court to disqualify the district attorney’s office because it had recently hired an attorney who had represented Stroupe’s father.

Bell granted a safe-keeping order based on a request from District Attorney Greg Newman to transfer Stroupe back to the state prison in Raleigh. The defendant, charged with the murder of Thomas A. “Tommy” Bryson in July 2017, had been returned to Henderson County to prepare for trial.
In his request for more time, Public Defender Paul Welch repeated his earlier arguments that the defense needed more time to prepare to defend a client on trial for his life. The time constraints that existed last May remain, Welch said.

A four-year saga came to an end in Henderson County Superior Court on Tuesday, as Phillip Michael Stroupe II was sentenced to life in prison without the possibility of parole after pleading guilty to the kidnapping and murder of Thomas Andrew Bryson in July 2017.

Two felony charges against Phillip Michael Stroupe Sr. have been dropped,... [snip] Stroupe Sr. was charged with accessory after the fact of kidnapping and accessory after the fact of first-degree murder. Murray confirmed that both were dismissed and that Stroupe Sr. has no more pending charges.
