Listen to him, imagine a bit deeper voice, and picture him in about 15 years....

Plus he seems to take care and be very thoughtful with his decisions like JDS.

PS- But JDS would not have put up some of the witness BS that has happened in this trial, I think.

I dont at all - this judge is very wordy and narrates every step and every ruling. Stephens has a slow drawl but uses very few words. IMO

It is my recollection that both SM and KM talked of the ropes in the beginning as a sex play gone too far prop. Why hasn't the rope been found. It wasn't on the body when the other two weak links showed up and when they were going with Plan B it included the rope so one would think they would want it to be found so it completed their story. Just my opinion.

Im listening to Barths cross examination of the doctor again because I missed a bit of it earlier.

Barth is woefully unprepared for this witness. It sounds like he read up on some medical literature, without consulting an expert, and came to his own conclusions and drew his own inferences without any medical competency. And he thought that was going to be sufficient to dismantle this doctors testimony.

The defense had depositions and statements from all of these witnesses, and an expert report from the doc. Defense knew that multiple witnesses would testify to seeing a ligature mark on Lizzis neck and swollen, purple face; knew Kat would testify that Seth strangled L with a rope; knew the doctor would testify that the descriptions are consistent with ligature strangulation and inconsistent with smothering. Yet, the defense rolled forward with their theory that Kat smothered Lizzi by sitting on her.

Makes me wonder if Seth is controlling the defense strategy and theory. Maybe his tarot cards told him this was the way to go, because I cannot fathom any attorney recommending this strategy.

Their first story to Roberta and Paul was that Seth blacked out and didnt know what happened, although he kept exclaiming that he had gone too far. There was no talk of ropes and sex play.

Their first story to the police was that Lizzi didnt show up. They got rid of the ropes and Lizzis clothes and body and phone and gps and everything connected to the murder - including the ropes - because they wanted to have nothing connecting them to Lizzi so they could claim she was never there.

Thats why they didnt find the rope. And that is why they didnt find Lizzis body as well.

In most or a lot of murder cases you don't have the actual murder weapon. I suppose that it was disposed of in one of the many place's that SM and KM came across. If that is what they actually used, since we have no body nothing is exact. We mainly have Kat, Seth, Roberta, and Pauls description.

As far as LE searching all of the dumpster's, you can't search all of them around the whole town. Perhaps the defense should have questioned where this rope was.

I almost (not quite) feel sorry for Barth and how desperate he is to find a way that Lizzi could have a swollen purple face from suffocation. Hes way over his head - suggesting that suffocation can cause brain death/dysfunction and that could lead to heart dysfunction, specifically one half pumping while the other half stops functioning which causes a red face.

Dr. Jennie Duval of the state medical examiner's office was the last witness prosecutors called. She said she based her analysis of how Lizzi Marriott died on witnesses describing a swollen and reddish face, saying that was "very consistent with a ligature strangulation."

Defense attorneys challenged that analysis. The defense plans to call an expert witness next week to support the theory that Lizzi Marriott was suffocated by McDonough during a sex act involving bondage.

There isn't a witness on this planet that can overcome the handwritten letters and changing stories of this defendant other than the defendant. I am hoping that they are worried enough about it to put him on the stand. I don't think anyone testifying to what an outstanding individual he is can overcome what has already come out. lease:lease:lease::tantrum:

I've got a feeling that the DT is pretty confident, so I don't think there's a chance we'll see him up there. Hoping I'm wrong...

OT anyone know if the trial of the 'Salt Mom' will be televised? She poisoned her son with table salt through a feeding tube. He was five years old. I thought of Munhauser (sp?) by Proxy. She had him in and out of hospitals all the time. Personally I don't think this 'illness' arises to the level of insanity but I think it would be interesting.

well, there's good news and bad news imo.......the good news :loveyou:is that the state FINALLY knew when to shut up because that medical examiner was one fine witness for their case and a helluva good way to wind down :clap:.....she was awesome and held up quite nicely under cross and i pray made a BIG impression on the jury......lease:

the bad news is that i've canceled all the bridal registries and the wedding is off!!! :dramaqueen:while usually a steadfast proponent of smartazzedness......today barth did not make any headway in his delivery and dare i say it......showed his hiney :behind:......therefore, i'm returning all the gifts and will no longer be addressed as queen bee barth.....mr. bee is very relieved

oh how i do look forward to monday and the defense case beginning......i still think barth is an outstanding attorney and as a spectator i am anticipating great things from him then.........:giggle:
