FREEHOLD - It’s been more than three years since Keith Caneiro and his family were found murdered on the grounds of their smoldering Colts Neck mansion after it was consumed in what authorities said was an inferno intentionally set by his older brother.

Still, Paul Caneiro has yet to go to trial in what has been described as the greed-motivated slayings in November 2018 of his brother, sister-in-law, and young niece and nephew.

The case has been slowed by the COVID-19 pandemic, the sheer volume of evidence collected in the case and the pandemic’s impact on the accused’s ability to review that evidence while being held without bail at the Monmouth County Jail, especially during periods of lockdown due to outbreaks of the virus.

At a hearing last week, Caneiro’s attorney, Patrice Bearden, said there are literally terabytes of electronic evidence that have been collected in the case by the prosecution and shared with the defense.

Bearden, first assistant deputy public defender for Monmouth County, asked Superior Court Judge Joseph W. Oxley at Wednesday’s hearing to order prosecutors to pinpoint what in the mountains of evidence they intend to use at trial. The state opposed Bearden’s motion. Oxley said he would rule on the request on Feb. 3.

At last week’s hearing, Bearden asked the judge to order the prosecution to “outline what they intend to use out of this volume of terabytes of information."

Decker responded that most of the recent electronic evidence turned over to the defense “is an extraction of the computer of Mr. Caneiro." Decker added that the defendant should know what was contained on his own computer.

Opposing Bearden’s motion, Decker said the state in October 2020 filed a “notice of intent to offer certain evidence." He said that was a detailed, 12-page roadmap of the state’s case.

Decker said that in his 18 years practicing criminal law, “I’ve never personally provided that much specificity to the defense."

Bearden said it is the responsibility of the defense team to go through all the evidence turned over to them.

“Without a roadmap … we have to go through everything," she said. “We have to figure out what may be relevant."

She said her client “has his own independent right to review that discovery."

But, “the jail has not historically given him adequate time" to do that, she said.

Caneiro previously had been given four to five hours a day for a 30-day period to review the electronic evidence in the law library at the jail, Bearden said.

Now he is only afforded one hour a week to review the evidence, Bearden said.

The law library, where he had been reviewing the evidence, was limited to having only one inmate there at a time when the jail went into lockdown in recent weeks because of COVID, she said.

Bearden said she is seeking to restore the four to five hours a day her client previously was afforded to review the evidence.

Oxley acknowledged that the time allotted to inmates to review evidence has been hampered by the omicron variant of the virus.

The judge said he wants an estimate of how much more time Caneiro will need to review the evidence before the case goes to trial.

“It’s the court’s desire, in light of the age of the case, that we start to think about realistic trial dates," Oxley said.

He added that everyone would prefer a trial to be “sooner rather than later."

I just saw the headline -- "discovery by dump truck." That was pretty cheeky for the defense to ask the prosecutor for a "road map" to her case! MOO
 
Sounds to me like someone doesn’t want to do their work on this case!
Also let’s blame the prisoner for needing unspecified time to go over every micro inch of the electronic data.
At this rate, it will be years before this case ever goes to trial! The judge needs to step up and take charge.

Plead not guilty. Held without bond.
*Indicted (7/1/19) with 2nd degree insurance fraud (from 11/6/12 to 7/9/19).
Previously charge with 2 counts of 2nd degree aggravated arson (in connection to fire set @ his Ocean Township home on the same day before fire in Colt’s Neck), and with 4 counts of murder, with possession of a firearm & possession of a weapon for unlawful purpose. Plead not guilty. Held without bond. Paul Caneiro allegedly stole $78,000 from Keith & Jennifer Caneiro. He stole the money sometime between January 2017 & the day of the murders.

9/9/19: After much delay next hearing is scheduled on 12/2/19. 12/2/19 Update: Caneiro was back in court on Dec. 2. After that, there will likely be pre-trial motions, delaying the trial for months until the spring. 4/24/20 Update: The New Jersey Supreme court ordered municipal court sessions to resume by phone or video on May 11, but also said they can resume remotely as early as Monday, as long as the parties consent. 11/23/20 Update: Next hearing on 12/2/20.

11/20/20: The wrongful death suit was filed on behalf of Vlassis Karidis of New York City, who is the maternal grandfather of Keith & Jennifer’s children. Since Sophia was the last to die, she inherited her parent’s estate & died “intestate” or without a will. That means the estate she inherited was split four ways among her grandparents. Next status conference hearing on 4/27/21.

The judge instructed the defense team to file their legal brief on the issue by April 1 and for prosecutors to file their response to it by April 29, in advance of a potential hearing on the DNA evidence. No trial date has been set.

It seems to me that PC's defense wants to suppress the DNA evidence and filed a motion for the same. In response, the court ordered the defense to file their legal brief for his review, and the state to respond to the defense by April 29.

Under a typical motion filed with the court, I think the judge has 35 days to respond but can extend the time.

Since Judge said he plans to review the appellate court decision on the Pickett case which I presume that case is about the reliability of testing DNA using genotyping software.

I think the Judge not likely to answer until June-- since the prosecutor has until April 29 to file their answer.

Nothing moving swiftly with this case -- don't see this issue treated differently. :)
