Attorney Matt Chandler representing the victim's family updated KOAT with the latest.

"ET is back with the family. She's happy. She's been medically cleared and healthy. And so we're really thankful for that in that reunification," Chandler said.

Back in Lubbock, Texas, the 5-year-old who was shot in the head is still recovering at the hospital.

"Each day is getting better. And she's coherent. She's having conversations with the family, doing things the little five-year-old girls want to do the best that she can. She's trying to stay positive. But she still has a lot of questions," Chandler said.

"The family is obviously they're focused on not only the recovery of (5yo) and the care of baby ET, but they're also planning to bury, you know, loved ones, with Taryn and Harley. It's going to take a lifetime to get through this," Chandler said.

KOAT reached out to the U.S. Attorney about when Collins should arrive back in New Mexico, but we have not heard back.

No word if he will also be facing state charges in New Mexico as well.

(It is good to see that the 5-year-old is improving, but heartbreaking to think about what she witnessed.)
 
Happy to hear the kids are physically recovering, but hoping the oldest will never have to testify. That's a heartbreaking thing to even think about. Perhaps her head injury, resulted in memory loss - that would be a blessing in so many respects.

ALBUQUERQUE – Alek Isaiah Collins, 26, appeared before a federal judge in Albuquerque this morning for arraignment on an indictment charging him with kidnapping of a minor and discharging a firearm in furtherance of a crime of violence in connection with the double homicide of two female victims in Clovis, New Mexico. Collins was detained pending trial, which has not yet been scheduled.

The suspect in a kidnapping, and double murder in Clovis is prevented from releasing details about the case.

A federal judge on Thursday granted a motion by the prosecution to prevent Alek Collins from "disseminating materials produced to him in discovery to any third-party, to include any and all information included in the United States’ discovery file that would violate the (four) victims’ rights to privacy in this case, including but not limited to: any personal identifying information of the four Jane Does, including their photographs."
