Wednesday, January 17th:
*Trial continues (Day 2) (@ 9:30am ET) - New YorkE. Jean Carroll vs. Donald John Trump. Amended complaint against Trump seeking new damages of at least $10 million, based in part on comments Trump made during a CNN town hall on 5/10/23.
U.S. District of Manhattan 1:20-cv-07311/defamation suit/1:22-cv-10016/damages
U.S. District Judge Lewis A. Kaplan presiding. Trump’s attorneys Alina Habba & Michael T. Madaio, defense attorney Shawn Crowley.
These defamation charges were postponed by Judge Lewis Kaplan on 3/30/23. Carroll's first defamation lawsuit against Trump was filed in November 2019. But that case has been put on hold while Trump argues that a federal law protects him from being sued for defamation for comments he made while president. And was amended to Trump’s comments made on 5/10/23.
Trial began on 1/16/24 with jury selection. 9 jurors selected.

Carroll is slated to testify Wednesday in the trial, which is expected to last a few days. Trump’s lawyers have also indicated he plans to testify, although Trump has changed his mind on testifying before in other trials. Trial continues on Wednesday, 1/17/24.

VERY testy exchange between Habba and Judge Kaplan after Habba again asked for adjournment so Trump can attend funeral. Kaplan: "The application is denied. I will hear no further argument on it." Habba attempted to speak.Kaplan: "None. Do you understand that word?
Sit down."

Habba: "I don't like to be spoken to that way, your honor." She continued to ask for an adjournment, at which point Kaplan cut her off again: "It’s denied. Sit down."

Carroll is now testifying

Carroll testified that she used to be known as a writer, and as a result of Trump's comments, "now I’m known as a liar and a fraud and a whack job.”

Trump is watching her, sitting hunched over, with his arms on the defense table.

After an objection by Habba, Kaplan admonishes her. "First of all, when you speak in this courtroom, you'll stand up

After Habba says she intends to question Carroll about a topic previously deemed off-limits, Judge Kaplan scolds her again: "The last I heard, Ms. Habba, I do not need announcements from counsel about what they intend to do."Habba stared to speak.Judge Kaplan: “Sit down.”
With the jury out of the room, Carroll's lawyer Shawn Crowley is complaining that Trump is muttering loud enough that the plaintiff's table can hear him. Crowley says Trump is saying Carroll's testimony is false and suggesting she has "suddenly gotten her memory back."

Trump has been vocal throughout Carroll's testimony so far, even slamming the table in anger at one point. At another, the judge asked Trump's attorney, Alina Habba, to sit down, to which Trump said, "nasty guy."

Kaplan threatened to kick Trump out of court after Carroll counsel complained again about Trump's commentary. Kaplan: "Mr. Trump has the right to be present here. That right can be forfeited." He continued: "Mr. Trump, I hope I don’t have to consider excluding you from the trial"

After Trump threw his hands up in the air and said, "I would love it," Judge Kaplan continued: "I know you would," Kaplan said. "I know you would. You just can’t control yourself in this circumstance, apparently."

Trump attacks judge on Truth Social after judge threatens to throw him out of court​

After the judge threatened to remove Trump from the courtroom, the former president railed against Kaplan on his Truth Social account.

"I feel an obligation to be at every moment of this ridiculous trial because we have a seething and hostile Clinton-appointed Judge, Lewis Kaplan, who suffers from a major case of Trump Derangement Syndrome," he wrote.

Trump said that the judge was reported to be "extraordinarily hostile" toward him in the first trial involving him and Carroll.

"I should have gone, if for no other reason than to witness and speak up against the abuse carried out by this Judge," Trump said, who also complained that the judge wouldn't delay the trial, which the former president is not obligated to attend, for Melania Trump's mother's funeral on Thursday.

During Habba's cross-examination, Kaplan admonished her for reading a document that wasn't in evidence.

Kaplan said the court was going to break until 3:30 p.m. and he told Habba that during that time, she might want to refresh her memory about how to enter a document into evidence.

Habba grilled Carroll about deleting messages she received that contained death threats. Trump's attorney asked Carroll if she currently possesses all of the messages that related to death threats and Carroll said that she deleted them early on because she said she had no idea how to deal with them.

Habba questioned why Carroll didn't provide the messages to anyone, including the police or lawyers.

She then asked for a mistrial based on the deleted messages, which Kaplan denied.

I see Alina Habba also received disparaging remarks from a FL judge when trump lost his lawsuit against Hillary Clinton in early 2023.
“This case should never have been brought. Its inadequacy as a legal claim was evident from the start,” US District Judge Donald Middlebrooks wrote in his scathing 46-page order. “No reasonable lawyer would have filed it,” he continued.

Former member of Ivanka Trump's communications team ends up in jury pool for Donald's civil lawsuit against journalist E. Jean Carroll​

One woman said that she used to work for Trump's daughter Ivanka on her communications team in 2017 - but said it won't impact her ability to be fair.

NYDailyNews reporter Molly Crane-Newman said: 'A woman says she worked for Ivanka Trump's company doing communications work in 2017/18 and also says it won't impact her ability to be fair to both sides.'

The former staff member's identity and position was not disclosed, and it is unclear if she was one of the nine people chosen to be a part of the jury.

For contempt and would spend a night in jail and/or a significant
Fine--But not Trump-- he does whatever he wants-- judges use

You're right, but he WANTS to get thrown out. He even said he'd love it. More ammunition for him to paint himself as the victim to his followers.

I think in that case that marks would have been on the back of his hand.

Weird that they apparently weren't there at his rally the night before.

I took a fall recently that resulted in a couple of nasty fabric burns. The marks almost look like they did at first.

They also look to me kind of like burns he might have gotten from picking up something hot, but that's just from life experience and not any medical knowledge.

I hope we find out.

Looks to me like he grabbed a hot pot handle or something. Not that he cooks, but something cylindrical and hot, the marks seem to match where the hand would contact when grabbed. Maybe the wrong end of a curling iron?

Or, it could be ketchup. :-)
