NY - $250m fraud against Former President Donald Trump, Trump Org., Eric, Donald Jr., Sept 2022, Trial 2 Oct 2023, #2

  • #181
Why doesn't anyone call him or his lawyers on these irrelevant statements?

That's nice, the loan is in full conformance (assuming it is).

That is not what he's been charged with and is entirely beside the point.

Grr!

(MOO)
It's right up there with "the bank didn't complain," implying it's okay to break laws.

Trust me, when I realized I couldn't edit, my very first thought was, "Oh, man, people are gonna think I actually believe that stuff" and a cold wave washed over me.
Based on your other posts, I knew it was a mistype...:)

Monday, November 13th:
*Bench Trial continues (Day 27) (@ 10am ET) – NY - New York vs. Donald J. Trump (76/now 77), Donald Trump, Jr. (45) & Eric Trump (38/now 39) & the Trump Organization, Inc. (Allen Weisselberg (75/now 76) & Jeffrey McConney) are being sued by Letitia James, the New York Attorney General, who is leading a civil investigation (which cannot result in criminal charges filed on 9/21/22) & has spent years looking at whether the company committed various acts of fraud over several decades. In the civil case, Ms. James has filed a lawsuit against Trump & two of his children accusing them of "astounding" fraud & deception.
New York is seeking $250 million in financial penalties & asked the court to ban Trump, Donald Trump Jr. & Eric Trump from serving as an officer or director in any corporation registered or licensed in New York. James also requested the court ban the former president & his business from acquiring real estate in New York or from applying for loans from any New York financial institution for five years. James's civil case accuses Trump of lying from 2011 to 2021 about asset values at the Trump Organization, as well as his own net worth, in order to obtain better terms from lenders & insurers.
Lawsuit against: Donald John Trump, Donald Trump, Jr, Eric Trump, Allen Weisselberg, Jeffrey McConney, The Donald J. Trump Revocable Trust, The Trump Organization, Inc., Trump Organization LLC, DJT Holdings LLC, DJT Holinds Managing Memer, Trump Endeavor 12 LLC, 401 North Wabash Venture LLC, Trump Old Post of Fice LLC, 40 Wall Street LLC & Seven Springs LLC.
All charges against Ivanka Trump were dismissed in June, 2023.
Bench Trial began on 10/2/23. Prosecutors rested their case on 11/8/23. Defense begins on 11/13/23. (could last until 12/22/23 per Judge).
The lawsuit’s remaining 6 counts allege similar acts of fraud (that Trump inflated his assets on statements of financial condition that he submitted to banks & insurers for personal gain).
Judge Arthur F. Engoron presiding / NY State Attorney General Leticia James & senior enforcement counsel Kevin Wallace, Defense attorney Christopher Kise & Jesus Suarez & Alina Habba for Trump, Weisselberg & the rest of the defendants for Trump Org. / Clifford Robert of Robert & Robert PLLC for Donald, Jr. & Eric.
Trump fined $5,000 on 10/20/23 for violating his gag order & on 10/25/23 Trump fined $10,000 for violating his gag order 2nd time. Both paid on 10/30/23 per Alina Habba.
Judge Arthur Engoron on 11/3/23 has expanded a gag order prohibiting Trump’s attorneys from making any further comments about confidential communications between the judge & his staff inside or outside of the courtroom. The judge said violating the order would result in “serious sanctions.”

Additional info: 11/8/23 Update: NY AG Letitia James has rested her case against Trump & his adult sons & Trump Organization executive state attorney Kevin Wallace told the court. Judge Engoron confirmed that he will address motions for a directed verdict -- as well as motions regarding the defense's expert testimony -- during a half day of court tomorrow. "We don't have any witnesses for tomorrow," Trump attorney Chris Kise told the judge. The defense's case is expected to start in earnest on Monday.
NY AG James is arguing that four of the defense's expert witnesses are no longer relevant. In a filing made today, James argues that Judge Engoron's partial summary judgment decision & subsequent changes to the state's case have made make the testimony from the four experts irrelevant. State lawyers plan to make an oral motion to preclude the expert testimony.
11/9/23 Thursday, Bench Trial Day 26: Motions hearing. Trump's defense team has moved for a directed verdict in the trial, arguing that NY AG Letitia James failed to meet the evidentiary standard necessary for the case to continue. The attorney general's office, in response to the defense's request for a directed verdict on the basis that the state failed to show that a bank or insurance company complained of fraud on the part of the Trump Organization, conceded that none of its witnesses were asked directly during the case whether they would have moved forward with a loan to the Trump Organization had they known about the fraudulent valuations alleged by the NY AG. Judge Arthur Engoron did not immediately rule on the defense's motion for a directed verdict that would end the trial early. Instead, the judge simply said the arguments were being "taken under advisement."
Trump attorney Chris Kise grew visibly frustrated as today's proceedings moved on to arguments over the state's motion to preclude testimony from four of the defense's expert witnesses that the state argues are no longer relevant to the case.

Judge Engoron has denied a motion from the NY AG to preclude four expert witnesses from testifying for the defense when the defense presents it case starting on Monday. The state had sought to preclude the four experts’ testimony on the grounds that, following the testimony of the state’s witnesses, the four defense witnesses were no longer relevant to the case. In making his ruling, Engoron reiterated his finding from his earlier summary judgment order that Trump made at least ten internally contradictory claims in his statements of financial condition. “You can’t have a correct statement with these kinds of errors,” Engoron said. Kise told the court that Donald Trump Jr. will be the first witness to testify in the defense’s case on Monday.

Bench Trial continues on Monday, 11/13/23 with defense presenting their case.

11/10/23 Update: The mortgage on Trump’s Manhattan tower at 40 Wall St. has been transferred to a special servicer Rialto Capital. The Financial District building has been on watchlist status since February as costs & vacancies increased. “Contact has been made with the borrower & a pre-negotiation letter is being reviewed,” according to a filing Friday on the building’s commercial mortgage-backed security. Also Friday, the owner of the Trump International Hotel Waikiki in Hawaii said it will rename the property, buying out a licensing agreement with the former president’s company & joining a brand in Hilton Worldwide Holdings Inc.’s system.

Junior is on the stand again today.

Lisa Rubin

"Jr. is now describing the 'buckets' of work within the Trump Org.: development & management of residential and commercial buildings (which he says distinguishes them from other developers), hotels both owned and managed, and licensing."

I'm sure Jr means "projects" when he uses the word "buckets," but my mind went to the definition of "bucket" on Wall Street as a scam where you take money by duping investors and then use the money for gambling. It's not a term used anymore that I know of, but that's where my mind went, as someone who has an interest in financial history. ;)

Barry was appointed to the U.S. Court of Appeals for the Third Circuit in 1999 by then-President Bill Clinton. She largely avoided the spotlight that was constantly pointed at her brother, first as a television host and business personality and then as the president of the United States.

She spent two decades on the Philadelphia-based appeals court before retiring in the midst of a civil misconduct investigation related to her family’s alleged tax-dodging schemes.

Her retirement in 2019 ended that probe, which centered on whether Barry violated judicial conduct rules by participating in the schemes reported in a bombshell New York Times investigation.

Is there going to be any recess for the death in the family?

Before we break for lunch, Judge Engoron politely skewers Trump Jr. on his understanding of history. The castle at Aberdeen may have been built in the 12th century, but that was not “before America was discovered.”

Court is on a break from Donald Trump Jr.’s testimony; meanwhile, news broke earlier this hour that his aunt, former federal appellate judge Maryanne Trump Barry, has passed away at 86.

But despite the loss, Trump Jr. is back on the stand with no change in affect.

Jennifer Weisselberg — who had cooperated with the Manhattan DA and NYAG criminal investigations into the Trump Organization's finances — was evicted earlier this year and lost all visitation rights for her kids:

At least one former law enforcement official who worked in the Manhattan DA’s office with Jennifer on the cases involving Allen Weisselberg and the Trump Organization is sympathetic to her claims. The official, who asked to remain anonymous, told me she was “quite reliable on certain subjects” and acknowledges that “she’s been through an awful time.” He adds, “It’s very credible that they’re retaliating against her” for helping with those cases, but he allows that it’s also possible that Jennifer brought some of her misfortune upon herself with questionable decisions.

Jr put on a slide show as evidence.

"Donald Trump's testimony in the defense's case has so far centered around a slide show being presented by the defense, entitled "The Trump Story," that paints a timeline of Donald Trump's real estate acquisitions .... which Trump Jr. acknowledged was created by his marketing team ...

As he narrates the slide show, Trump Jr.'s testimony resembles a lecture on real estate, sprinkled with details about his family's properties ... "

Maybe they're using the trial to sell the businesses or get new backers.

I think Trump senior is in charge, directing the legal team, using all his old moves. I don't think he quite gets what he is up against. It's a risky move to have Don Jr and Eric, (and Ivanka?) testify again, so unless they have something super useful to say, I don't see the point. Don Jr's testimony didn't seem to be useful.

Is the pressure of all his legal problems starting to get to Trump? I know about his reputation, but it seems like he is becoming almost unhinged, calling people vermin, talking about putting prosecutors in mental hospitals-is he normally this bad or do you think he is unravelling?

-is he normally this bad or do you think he is unravelling?
snipped

From my observation, he's always been this bad. He was a "birther" who spread lies that Obama was born in Africa, to come up with one example. That was years ago. He hasn't changed - this is who he is.

Maybe it's worse because power got to his head and because he's now backed into a corner. And, because his fans cheer.

We've already seen some segments feeling sorry for the old guy like the poor thing is losing his mind. Maybe he is declining, but....this is who he is and has been. imo

This is all I can see about today's hearing:
  • In a video statement posted to social media, New York Attorney General Letitia James said that the testimony of Donald Trump Jr. yesterday failed to refute any of her case against Donald Trump and his adult sons.
“After spending a full day walking through a marketing presentation to sell us all on the greatness of the Trump Organization, the defendants did not make a single point to refute the case we brought against them,” James said of Trump Jr., who led off the defense’s case.

  • As court got underway this morning, Judge Engoron — who has said he has received harassing messages regarding his role in the trial — did not address Trump’s sharing of a post on his Truth Social platform calling for his arrest.
The former president yesterday shared a user’s post calling for the “citizens arrest” of Engoron and Attorney General Letitia James “for blatant election interference and harassment.”

  • Donald Trump’s lawyers abruptly stopped the testimony of their first expert witness — who was expected to testify for a full day or two — after Judge Engoron limited the topic areas of his testimony.
Steven Witkoff, a real estate investor and longtime friend of Trump’s, was brought into court by the defense team to testify that Trump’s Doral golf club was undervalued in Trump’s financial statements.

  • Taking the witness stand as an expert witness for the defense, accountant Jason Flemmons offered testimony in support of Donald Trump’s approach to valuing his Mar-a-Lago property, which has been the subject of debate throughout the seven weeks of the trial.
Flemmons argued that Trump’s approach to valuing his assets gave him latitude to consider his property’s future revenue streams. That approach, according to Flemmons, could result in “wildly different values” between the numbers listed on a personal financial statement and a tax assessed value.
