Ivanka Trump asked a New York appeals court to pause the $250 million fraud trial of her family and its business empire as she appeals a judge’s order requiring her to testify in the case next week.

The request to stay the entire trial came at the tail end of a Thursday court filing arguing that Ivanka Trump will face “undue hardship” if forced to testify — in part because she is scheduled to appear “in the middle of a school week.”

I am headed back to the office after yet another long day in court that ended with a bang, not a whimper. But what was today’s latest skirmish about Judge Engoron’s principal law clerk really about? Controlling what we, the media, say and write tonight—and depriving the AG’s team of a major dunk on Eric Trump.

Let me explain. Andy Amer of the AG’s office was focused on a 2021 conference call about Trump’s statement of financial condition that one participant, Patrick Birney, testified was convened to apprise Don Jr. and Eric of a change in the valuation methodology for their golf courses

That call, however, was not only just over 2 years ago, but as Amer pointed out, took place well after the AG’s investigation was underway and nearly two years after Eric Trump gave his first of two depositions related to this case.

At that first, October 2020 deposition, Eric Trump took the Fifth more than 500 times, a fact that the attorney general highlighted in a Jan. 2022 court filing.

And that’s where Amer was headed. He was going to show that especially once Eric perceived that he was at sufficient risk that he had to plead the Fifth hundreds of times in fall 2020, his lack of recollections as to how they handled later statements of financial condition (and related valuation changes) was not credible.

That’s likely where we would have ended the day but for vociferous objections from Cliff Robert & then Chris Kise, who, in supposedly trying to shut down that line of questions sideswiped the judge’s principal law clerk.

Predictably, that enraged the usually droll Engoron, and we were off to the races about a potential expansion of the gag order, the legitimacy of the notes the judge and his clerk exchange, and whether Kise’s First Amendment rights trump (no pun intended) the clerk’s right to safety.

Lawyers joke if the law’s not on your side, argue the facts. If the facts aren’t on your side, argue the law. And if you’ve got neither, pound the table and yell. That’s what happened today with the added factor that Trump’s team timed their outrage to strip the AG’s team of a last, devastating word today.

Don’t buy it. As Amer himself said with a grin, today was a great day for the AG’s team, even if Don Jr.’s joviality and Eric’s stinginess disguised that at times. More on why later….

Poor dear. I bet that's never happened to another woman with children who can barely afford to be apart from the children's nanny for a day.

You know what? I don't give a rip what tactics she takes to avoid serving as witness. I'm not interested in business frauds enough to follow civil cases closely. The only reason I care about this fraud case is because the GOP is pushing the main defendant as candidate for our highest office in the country whose citizens, I once thought, valued honesty and integrity.
If he weren't running for president, this would be just another case among the dozens and dozens he has already faced. (Were all the previous lawsuits against him political too? ;) )

Que the news stories showing her on vacation or whatever during the week without her kids. Side-show distraction that gets people talking about something other than the family's fraud.

The defence may try to gaslight us about attacks on the clerk, but it’s dangerous. ( Will nobody rid me of this troublesome priest?) They know that.

BBM. The question I have is: why are Republican politicians still supporting Trump? He lost the 2020 election. State audits proved it.

It is voters who value honesty and integrity, but one political party has made it abundantly clear, they don't care about voters' opinions.

In the civil case, Ms. James has filed a lawsuit against Trump & two of his children accusing them of "astounding" fraud & deception.
New York is seeking $250 million in financial penalties & asked the court to ban Trump, Donald Trump Jr. & Eric Trump from serving as an officer or director in any corporation registered or licensed in New York. James also requested the court ban the former president & his business from acquiring real estate in New York or from applying for loans from any New York financial institution for five years. James's civil case accuses Trump of lying from 2011 to 2021 about asset values at the Trump Organization, as well as his own net worth, in order to obtain better terms from lenders & insurers.

After Trump lawyer Chris Kise made a reference to Judge Engoron's law clerk, the judge said: "If there is any further reference to anyone on my staff, I would consider expanding the gag order to include the attorneys." Eric Trump will return for testimony on Friday.
Bench Trial continues on Friday, 11/3/23.
11/2/23 Update: Ivanka Trump asks to pause NY fraud trial, says testimony during "school week" creates undue hardship. 11/3/23 Update: A New York appeals court has denied an emergency request from Ivanka Trump to stop her testimony at her father's civil fraud trial. Ivanka has lost her bid for an interim stay of her testimony & remains on the trial scheduled for 11/8/23.

Eric Trump was "intimately involved in lying about the values of properties ... to make his father appear richer," while Donald Trump Jr. "continued to lie" by certifying his father's financial statements despite being confronted with misstatements, James alleged.

"They pretend that they were not involved in their family's fraudulent business. But the facts tell a very different story," James said in the video.
