Judge scolds Trump's lawyers, asking "why on Earth" they didn't object to Stormy Daniels' testimony

As he had on Tuesday, the judge acknowledged that he did not approve of certain parts of Daniels' testimony.

However, he didn’t seem to approve of Necheles’ performance either, questioning why the defense wouldn’t object to Daniels' allegations on Tuesday that Trump did not use a condom when they had sex.

“Why on Earth she wouldn’t object to the mention of a condom, I don’t understand,” Merchand said, The Washington Post reported.

I always found it weird that a known germophobe refused to wear a mask during a pandemic.

So him not wearing a condom is totally believable to me.

Why would any adult woman carry a condom if she thought she was just meeting the married celebrity TV star for dinner?

If Trump is a germophobe, why did he brag about grabbing women by their genitals on the Access Hollywood tape?

In another carefully calibrated ruling, Merchan will permit prosecutors to use emails from Trump campaign officials referencing the notorious Access Hollywood recording in which the former president spoke about grabbing women by their genitals.
 
He was just pandering to his base with that one. He probably immediately threw on a mask when he was off camera. MOO

We know that's untrue because it was widely reported that after he came home from the hospital while still having an active case of covid, he refused to wear a mask in the white house. According to Cassidy Hutchinson's book, it's because it interfered with his makeup and people would see the bronzer rubbing off on the mask.
 
I shall have my DVR set to record the former president now defendant’s testimony in this trial. So that it can be used to determine its relevance in light of the other evidence. (And I don’t mean the tweets, statements, or posts outside court or not on the court record.)

I think there is testimony in this trial that we are not hearing in some MSM.



As they noted in opening statements, neither Trump nor the Trump Organization could just write a check to Cohen “with a memo line that said reimbursement for *advertiser censored* star payoff.”

The Trump Organization controller at the time, McConney is breaking down how they allegedly “cooked the books.”

At a January 2017 meeting with CFO Allen Weisselberg, McConney testified that he was given a copy of Cohen’s bank statement showing his $130,000 wire to Stormy Daniel’s lawyer.

His personal handwritten notes from that meeting detailed the math that eventually led to Cohen’s $35,000 monthly payments over a year.

He also testified that he never saw a legal retainer agreement for Michael Cohen, a blow to the defense which said in opening statements that the payments were for legitimate legal work.

*Trial continues (Day 12) (@ 9:30am ET) – NY - *Donald John Trump (76/now 77) was indicted (3/30/23), formally arrested, charged & arraigned (4/4/23) with 34 felony counts of falsifying business records in the 1st degree & conspiracy in connection with hush money payments to two women [Stephanie Clifford aka adult actor Stormy Daniels & former Playboy model Karen McDougal] before the 2016 presidential election. Plead not guilty. Warrant vacated, released on own recognizance. New York County
New York: Submitting false invoices or checks. All 34 counts against Trump are felony charges (class E) instead of misdemeanors.
Trial began on 4/15/24 with jury selection & ended on 4/19/24. 12 jurors & 6 alternates. [Jurors: 7 men & 5 women/6 Alternates: 5 women & 1 man].
Trial began on 4/22/24. Trial is expected to run 4 days a week [Mondays, Tuesdays, Thursdays & Fridays].
New York Supreme Court Judge Juan Marchan presiding. Manhattan Attorney General Alvin Bragg. Prosecutors are Susan Hoffinger, Joshua Steinglass & Matthew Colangelo. Defense attorneys Todd Blanche, Emil Bove, Susan Necheles & Gedalia Stern.
Trump is required to attend each day in person — although the judge could grant permission for special absences. Trump has vowed to attend court during the day & travel to campaign events at night.

5/9/24 Thursday, Trial Day 11: *Michael Cohen will begin his testimony in the Trump hush money trial Monday. He is expected to be on the stand for several days.
*The prosecution said that they plan to call two more witnesses & could rest their case by the end of next week.
*State witnesses: Madeleine Westerhout [Executive assistant & Trump’s personal Oval Office gatekeeper]. Back on stand for direct. Daniel Dixon [of Broward County, Fla. has worked at ATT, a telecom company, as the lead compliance analyst for the last 6 or 7 years. In his role, Dixon helps analyze query records & helps LE with records obtained by ATT. He testified on phone records from Michael Cohen's primary phone]. Jenny Tomalin [has worked at Verizon for 18 years & has been a senior analyst for executive relations since 2017. She said that her duties include appearing in court to testify about records. She was used to enter evidence from Verizon phone records]. Georgia Longstreet, who has already testified in this trial, has returned to the stand. [Longstreet, a paralegal who had worked on Trump's case for about a year & a half, is answering more questions from the prosecution about social media posts related to the case. She continues to authenticate posts & has also testified about text messages]. Jaden Jarmel-Schneider [is a paralegal in the NY DA's office & was assigned to Trump's case. He testified that he helps with setting up subpoenas & analyzing records for the case, including records from Michael Cohen's phone calls, emails & calendar invites].

Cohen is testifying about key Trump and Pecker 2015 meeting and plan to place negative stories about opponents​

Michael Cohen is now testifying about the 2015 meeting with David Pecker and Donald Trump.
"Yes ma'am," Cohen said when asked about whether they met in 2015. They met in "Mr. Trump's office on the 26th floor."
"What was discussed was the power of the National Enquirer in terms of being located at the cash register of so many supermarkets and bodegas that if we can place positive stories about Mr. Trump that would be beneficial," Cohen said.
"And if we can place negative stories about some of the other candidates that would also be beneficial," Cohen added.
Prosecutor Susan Hoffinger asked whether Pecker offered anything else. "What he said was that he could keep an eye out for anything negative about Mr Trump, and that he would be able to help us to know in advance what was coming out and try to stop it from coming out," Cohen says.
Hoffinger confirmed with Cohen that Pecker via American Media Inc. executed that plan.
 
Cohen testified that in June 2016 that he received a call from David Pecker and Dylan Howard. They said she was a Playboy Playmate and had a story she was looking to sell to news outlets about her alleged relationship with Trump, Cohen said.

Cohen testified that he thought the impact on the campaign could be “significant,” and that he told Trump “immediately after I got off the phone with AMI.”

Cohen said he asked Trump about whether he knew McDougal, and Trump responded, 'She’s really beautiful.'”

Cohen said, “Okay, but she’s shopping a story.”

Trump asked Cohen to make sure the story didn’t get released.

Cohen said when he first heard about Stormy Daniels' story regarding Trump in 2011, he went to Trump's office and told him about the conversation he had with Dylan Howard and asked Trump if he knew who she was.

Cohen said Trump told him that he did know Daniels, and Cohen relayed the story about the 2006 golf outing in Lake Tahoe. Cohen said Trump instructed him to "take care of it."

Trump also told Cohen that he and Ben Roethlisberger met her and that she preferred Trump to “Big Ben," Cohen testified. Although Cohen asked Trump whether he had an encounter with Daniels, Trump would not answer him directly, saying only that she was “a beautiful woman.”
 
Hoffinger asks about a 12/6/2016 recorded conversation with Trump about purchasing life rights to McDougal's story and other AMI stories—it was the only conversation Cohen recorded of Trump.It was so I could show it to Pecker, so that he'd know he would be paid.

When he's convicted does he finally see the inside of a jail cell?

Money keeps people out of jail and prison.

I wish it would be true - but I am going to say - No - he won't go to jail cause he is going to appeal the decision & "somehow" stay out of jail - you know - he is after all a presidential candidate.... :(
