Here’s what we do know about the nine jurors:

  • A 37-year-old man who works for New York Public Library, has a bachelors degree in accounting and a masters in library sciences. He’s married with one child.
  • A 65-year-old physical therapist who lives in the Bronx with his wife and four children. He says he gets his news from CNN.
  • A 26-year-old man who was born and raised in Manhattan, dropped out of college to work and now does security for a retail company. He says he gets his news from social media.
  • A 46-year-old Bronx native with a high school education who doesn’t watch news and works as a janitor and as a sales associate in clothing retail store.
  • A 31-year-old man from the Bronx who works in security and told the judge he has no children “that I know of.” He said he avoids news but listens to podcasts occasionally.
  • A 55-year-old woman from Westchester County who works as a collections coordinator for a health-care facility. She lives with her significant other and has a son.
  • A 60-year-old Rockland County man who is married with two kids and works for a hospital in Manhattan. He said he doesn’t watch any particular news channel.
  • A 62-year-old woman who works in a high school and whose husband works in a factory. She said she gets her news from CNN.
  • A 66-year-old woman who is retired from the health care industry. She lives in the Bronx with her retired husband and says she watches local TV news.

Judge Kaplan: We'll have opening statements now. To me, opening statements are like movie trailers. Sometimes they are an accurate advertisement, sometimes not. Who's opening for the plaintiffs? Ms. Crowley.
Crowley: I'd like to take you back to 1996...

Crowley: Ms. Carrolll was leaving Bergdorf Goodman's. She ran into Trump, who she knew. He asked her to help him choose a gift, lingerie. They were in the dressing room. He pulled down her tights and sexually assaulted her

Crowley: Ms. Carroll got away. She told two friends. Later she swore them to secrecy, after threats. Eventually silence became impossible. In 2017 she began a book, it turned into a memoir. She included a chapter about Trump's assault

Crowley: Donald Trump's response to the book was explosive. From the White House, he said, She's not my type. We know what that means: too ugly to assault. He branded her a liar and a fraud.

Crowley: I am proud to represent Ms. Carroll in this trial. This is a roadmap. Donald Trump assaulted her in 1996, then defamed her. You'll hear about it all. Donald Trump responded with vicious lies meant to destroy her. You'll hear from others - her friends...

Ms. Carroll came from Indiana, sold her first piece of writing at 36 & moved to New York. She wrote for SNL in the mid 90s. She had "Ask E Jean"

Crowley: You'll hear Ms. Carroll testify. She finished filming her TV show in Fort Lee NJ then went to Bergdorf. She headed to the exit on 58th Street - Donald Trump was coming in. This was pre Apprentice. Trump recognized her, she was a well known writer

Crowley: Trump said, Hey! You're that advice lady! Ms. Carroll said, "Hey! You're that real estate tycoon." She agreed to help choose a present. He suggested lingerie on the sixth floor. It was empty. Trump picked up a body suit and told Ms. Carroll to try it on

Crowley: You may ask, Why on earth would Ms. Carroll let Donald Trump lead her into a dressing room? She blamed herself. But at the time, she thought the random encounter was funny. She didn't see him as a threat. But she was wrong. Trump banged the door closed

Crowley: He was a big man, had easily 100 pounds on her. He jammed his hands up, into her. He forced his p*nis inside her. It lasted a few minutes, she fled. You're going to hear from her. She will describe it all. I expect you will find it credible and convincing

Crowley: She's going to admit she doesn't recall the day or month. But she thinks it was a Thursday, in the Spring. She had no coat. Let me be clear. It does not rest solely on her testimony. There is more. You'll hear from Bergdorf employees of the time

Crowley: She ran out onto 5th Avenue. She pulled out her cell phone - yes, they had them in the 90s - and called her friend, Ms. Birnbach. She told Ms. Birnbach about her tights being pulled down, being penetrated. She told Ms. Birnbach to never speak of it again

Crowley: Ms. Carroll told Ms. Martin, who advised her to stay quiet, that Trump was too powerful. Ms. Carroll was born in 1943, the Grin and Bear It generation, her sister will tell you. We have another expert on that, Dr Lebowitz.

Crowley: Ms. Carroll was interviewing women about their experience with men. At that time, allegation arose against a famous Hollywood movie producer. It was time to share things that had happened to her. She made a list. She held off including Trump....

Crowley: An excerpt was published in New York Magazine. Trump responded he never met her, he threatened that she will pay dearly. He said, She's not my type. Using the most powerful platform on Earth. Many believed him.

Crowley: Then in October 2022 on Truth Social, Donald Trump called Ms. Carroll's story a con job and a hoax. She lost readers and fans. You're going to hear that Ms. Carroll is not the only woman he this to. You're going to hear him on a hot mic...

Crowley: You're going to hear Trump saying, When you're a star, you can do anything. You can grab them by the p*ssy. This was not locker room talk, it what he did. You'll hear from 2 other women he assaulted. One on a plane in 1979 - Trump also called a liar.

Crowley: You'l hear from a People magazine reporter who went to Mar-a-Lago in 2005 who Trump pushed against the wall. In 2016 she shared her story - and Trump called her a liar and insulted her appearance. "Go look at her," he said. "I don't think so."

Crowley: You're going to hear Trump lie, in a deposition. He said he never bought gifts at Bergdorf. It's a lie. Trump has said, I never met her. That's a lie too.

Crowley: The question is whether Donald Trump was lying in his October 2022 Truth Social post. At the end of the trial we'll speak to you again.

Tacopina: Just buckle in and listen to their story. The opening statement is supposed to be a promise - not a politician's promise. Let's talk about the lack of details. E Jean Carroll can't tell you the date, the month, the season, not even the year

Tacopina: She doesn't want to give Donald Trump the opportunity to provide an alibi. There's no date. Instead she says she was raped on some unknown day, 27 or 28 years ago. 8 or 9 year before that, they were at a gala. Trump was with John Johnson, Channel 11

Tacopina: E Jean Carroll says they took escalators up to the sixth person, but she didn't see a single other person. Not a soul. It was like the Walking Dead. She says Donald Trump picked up a piece of lingerie. The dressing room are usually locked. Not now though

Tacopina: She says Mr. Trump lunged at her, that the noise was so loud that anyone on the floor would have heard it. How did she react? She laughed, she says. Her story continues: Donald Trump violently raped her up to 3 minutes. She, on high heels, pushed him off

Tacopina: She somehow held on to her purse. She never screamed. She wrote the escalator down, seeing no one. She walked out of the store. She can produce no objective evidence. No record of injuries. No doctor or therapist. No video preserved

Tacopina: She went on CNN and talked to Anderson Cooper about this rape. You'll see her basking in the spotlight. She became a celebrity and loved every minute of it. The story became the center of her life and of her life style

Tacopina: She called him a rapist. Of course he exploded. Evidence will how E Jean Carroll is in fact lying. While at a party, she met an attorney called George Conway, a lawyer and critic of Donald Trump who spoke to her about suing-

Tacopina: You'll hear that if Donald Trump is faced with so many lawsuits, he won't be able to run for President. But the stories don't match up. Him calling her a liar is the truth. She suffered no harm - the contrary

Tacopina: I don't want to detract from the focus on her story. He says some snarly things. That's understandable. You have to decide if you believe the story or not. At the end, decide on the evidence, not politics. If you do, she will not be able to deceive you

The two opening statements are a study in contrasts. Carroll’s attorney describes the testimony he will present and facts already public re:Trump (his insulting and threatening tweets, and lies). Trump’s attorney attacks Carroll’s character…liar, what she is doing is an affront to justice, exploiting rape victims for money, basking in the spotlight, loves being a celebrity, came up with this to sell a book, to hurt Trump politically and inject herself into the spotlight. Did Trump write his opening statement?

"Earlier, the jury of three women and six men was chosen from a pool of about 100 people who were questioned about whether they could set aside their political beliefs and views of the #MeToo movement to decide the case fairly.

They were also asked if they supported Antifa, Jane’s Revenge, Redneck Revolt, the Ku Klux Klan or other extremist groups. Perhaps disappointingly for Trump and Carroll, no one in the jury pool said they followed them on social media or had read their columns or books. But nearly half had watched Trump presenting The Apprentice television programme."

I'd be a bit worried if I was one of the jurors.
I don't think it would take too much digging to figure out who at least a couple of them are.

I had the same thought that a PI could figure out some of the jurors. Or even any good WSer worth their salt for that matter! Not that we would! :D

So, the accuser/victim has the dress from the assault, from 1993, with DNA on it from the perpetrator, Donald Trump?

That is 30 years ago. She saved the dress, intact, not washed, with the DNA? That seems to be a problem, as there is no chain of custody, from the date of the alleged assault. Unless she reported the assault to LEO at the time, and the dress has been kept in evidence by LEO, since that date.

Kenneth Starr didn't seem to have much concern over chain of custody with regard to Monica Lewinsky's dress.

I'm not sure if that would count as precedent though.

*Trial continues (Day 2) (@ 9am ET) - New YorkE. Jean Carrol’s battery, emotional distress, rape & a 2nd act of defamation (for Trump's comments on Truth Social in October) lawsuit against Donald John Trump.
The lawsuit for defamation & under a New York law which allows alleged victims of sexual assault to sue over alleged crimes outside the usual statute of limitations.
Trump lawyers: Joseph Tacopina, Alina Habba & W. Perry Brandt. U.S. District of Manhattan/U.S. District Judge Lewis A. Kaplan.
Carroll has sued Trump for defamation & for rape, saying Trump turned a friendly encounter at a luxury Manhattan department store in late 1995 or early 1996 into a violent rape.
Trial began on 4/25/23 with jury selection. 9 jurors (3 women & 6 men).
Trial expected to last 5 to 10 days.
Defamation charges postponed by Judge Lewis Kaplan on 3/30/23. Carroll's first defamation lawsuit against Trump was filed in November 2019. But that case has been put on hold while Trump argues that a federal law protects him from being sued for defamation for comments he made while president.

4/25/23 Tuesday, Jury Selection Day 1/Trial Day 1: Judge Lewis Kaplan brought in 48 jurors for voir dire. Before calling them in, he told both parties & their lawyers to "refrain from making any statements that will incite violence or civil unrest," echoing concerns he raised when he mandated using an anonymous jury. The judge decided last month that the jury would be anonymous to protect them. Judge tells prospective jurors the panel will be anonymous "to protect all of you from unwanted attention, from harassment, from invasions of your privacy & ensure that nothing happens that could interfere with your ability to fairly & impartially decide the case." Not all of the potential jurors voted in 2016 & 2020, though, the Judge was finding out. But some did give money to candidates like Barack Obama, Hillary Clinton or Joe Biden. None of the potential jurors say they've been to a Trump rally or believe the 2020 election was stolen.

Judge Kaplan to jurors: Mr. Trump has not been charged criminally for the conduct Ms. Carroll alleges. She alleges battery & we are not talking about the little bunny that powers your radio. Battery is the unjustified touching of another person [etc]. An unwanted peck on the cheek could be battery. Ms. Shawn Carroll is alleging rape-it is a form of battery. You may have heard of the statute of limitations. Last year New York revived the ability to bring a suit for sexual misconduct. The trial will take 5 to 10 days.

The timing makes one ponder for sure. What would prompt a woman to disclose an assault that she kept quiet for so many years?

I would speak out if I saw that the assailant was about to be working with children, or vulnerable people who would be at risk.

I would speak out if I was getting up in years and felt that the public should hear the truth before my voice is silence forever.

I would speak out if the assailant was heading for an office where people would have trust in his integrity. However, this could be very difficult because I know that I would not be believed, I would be despised and denigrated. It may even mean that my life could be at risk. I might not have the courage.

I am not sure that she would have taken DT to trial at all, if he hadn't then denigrated her further when she wrote about the rape in her memoir.

She is a courageous woman. I can only imagine the harassment she is receiving from those who like to attack anyone who takes DT to court for his criminal activities.

Regarding opening statements yesterday:

Tacopina is not saying whether Trump will take the stand in his defense; if he does not, then the defense team has only one witness, Dr. Edgar Nace, a psychiatrist.

While Crowley kept a calm demeanor as she laid out Carroll's claims, Tacopina at times appeared to be genuinely angry, his hands gripping the lectern and his voice rising.

It’s day 2 of the civil trial of E. Jean Carroll against former president Donald Trump. The jury will hear from the first witness, a Bergdorf Goodman employee, and then Carroll will take the stand.
