This one is a really good read.

The trial has been a little frustrating coverage-wise, but then again no cameras in court, so there's that.
With 53 witnesses called we only know about 10 names.

Probably not a lot of people are watching this trial anyways, if this thread is a clue, no interest really.

Poor little one. He suffered so much.

I hope the jury gives Cory Byrd the maximum they can, and iirc it is 25 - life.

If they let him off easy, he will kill someone else, the man is a time bomb of rage.

GOSHEN – The Appellate Division of State Supreme Court has affirmed the conviction of the man who killed Marc Bookal, the four-year-old Newburgh boy, whose body was dumped in a wooded area of Newburgh.

Cory Byrd, 34, of Newburgh, who was the boyfriend of the young boy’s mother, was convicted by an Orange County Court jury of murder and two counts of tampering with physical evidence and on March 8, 2012 was sentenced to 50 years to life in prison.

On December 14, 2009, Marc was left in the care of Byrd. He severely beat the child after the boy woke up having wet the bed and becoming sick and messed in his pants. Byrd had been out trying to buy marijuana and to sell phony drugs.

The child suffered a hematoma in his skull and intense bruising to his buttocks and ankles. Young marc died as a result of the beating. Byrd then stuffed the boy’s body into a pack-n-play bag that had held Marc’s portable crib, and then put the bag into the boy’s mother’s school backpack. Byrd took the bag with the body to a nearby wooded area and hid it under a pile of cut trees. His body was not discovered until the following March when the thaw lead a police cadaver dog to find the decomposing body.

The appellate issues were all expected: A claim that the jury's verdict was against the weight of the evidence, a claim that the 17 autopsy photos inflamed the jury's emotions and were unduly prejudicial, ineffective assistance of counsel, denial of a mistrial motion, and a claim that the prosecutor said mean things in her closing and denied Byrd a fair trial.

The Appellate Division, Second Department of state Supreme Court ruled that Byrd's claims were without merit.

Did the prosecutor say harsh things about Byrd? Sure she did. She said that Byrd acted out of anger and frustration because of the inconvenience and emasculation he experienced because he had to baby-sit a sick child. She said Byrd's cover story sucked. And then she outlined the litany of evidence that pointed to Byrd, small pieces of a puzzle that added up to depraved indifference murder and an effort to conceal the crime that worked for four months. So very mean of that prosecutor to use the evidence to argue her case on summation.

Byrd can still petition the Court of Appeals to hear his case, but the first appellate hurdle is past.
