    The bone, chipped and of a brownish hue, was not to be considered by the #jury for its #emotional value and the audience was told to #keepcalm by the judge.

    Three more cops take stand in Hebert trial, testify about calls made from Yekel's phone, ramming incident

    March 18, 2019

    "...Mark Englert, a former Massena Police Department sergeant, testified that he tried to stop Hebert on June 12, 2014, days after Yekel's death, and Hebert rammed his patrol car. Englert said he tried to stop Hebert on Sycamore Street and he pulled his patrol car to the left of Hebert's vehicle....

    Two state police senior investigators testified about evidence they helped obtain.

    Senior Investigator Peter Kozel said he analyzed Yekel's cell phone, which was found with her skeletal remains on Aug. 29, 2014. Kozel said he examined the phone on Sept. 11, 2014. He said there was a contact labeled "Chris," and the last time it was called was June 6, 2014 at 5:45 p.m. The last call from the phone was made June 6, 2014 at 7:41 p.m. and there were six missed calls the following day starting around 8 a.m., Kozel said....

    Senior Investigator Theodore Levison testified that he took a DNA sample from Yekel's mother, Bonnie Lamay, on Sept. 30, 2014. Lamay took the stand on Thursday, March 14 and testified that she gave the sample to investigators...."

    "...There are three witnesses left to testify...

    In opening statements, Pasqua said jurors would hear a recording of Hebert confessing to an ex-girlfriend how and why he had killed Yekel.

    Presumably that is the recording that will be played on Tuesday.

    Hebert's lawyers have said that all of Hebert's confessions were lies meant to impress other criminals that he ran with or met in prison.

    They say Yekel died of a drug overdose.

    It will be up to the jurors to decide what they believe."

    "CANTON — It was a score that went south that led to the alleged murder of Lacey L. Yekel in 2014, according to the ex-girlfriend of Christopher A. Hebert, the man accused of the crime.

    Brandy Bressard told the court she and Hebert had been in a serious relationship between late 2009 and early 2014, at one point being engaged.

    A convicted drug felon in 2013, Ms. Bressard said she stayed in touch with Hebert throughout her recovery and at one point they talked about getting back together.

    Then she received a call within the first two weeks of June 2014 from Hebert....

    Court broke for lunch until 1 p.m. and Mr. Pasqua told the court he would be playing a two-hour recording of Ms. Bressard’s conversation with Hebert following the break."

    Dr. Michael Sikirica testified that he examined Yekel's remains on Sept. 2, 2014 at Albany Medical Center.....

    The next witness is Brandy Bressard, Hebert's ex-girlfriend who secretly taped him confessing to the murder, prosecutors said. The prosecution may rest their case after her testimony."

    "CANTON -- Christopher Hebert will take the witness stand on Wednesday as the only witness for the defense in his murder trial....

    After District Attorney Gary Pasqua late on Tuesday afternoon rested the prosecution’s case, defense attorney Peter Dumas suggested the court adjourn for the day because he expects his client to go through a lengthy examination.

    "If we start with this witness, it's likely to go for a while,” Dumas said.

    "Anyone other than the defendant?" Judge Jerome Richards asked, to which Dumas replied “No

    The prosecution’s case wrapped up after hearing a recording from Brandy Bressard, who said she and Hebert dated from 2009 to 2014...."

    The trial resumes Wednesday morning at 9:30 a.m. in St. Lawrence County Court."

    "CANTON -- Jurors in the Christopher Hebert murder trial were sent home for the evening around 8 p.m. Wednesday night and will resume deliberations on Thursday morning at 9:15 a.m...

    Around 7:30 p.m., Judge Jerome Richards called the jurors into the courtroom and warned them that their deliberations could be heard outside the courthouse. He said the jurors had opened a window in the jury room for air and a court officer who had stepped outside could hear them and reported it to the judge.

    "You need to keep your volume down so no one has access to your deliberations," Richards told the jurors, who all nodded affiratively.

    Jurors around 6:30 Wednesday night asked to hear a recording of a phone call between the defendant and a woman named Julia Larock from around the time Hebert was arrested for murder...."

    "CANTON — After deliberating for nearly 7 hours over two days, a jury has come back with a verdict of guilty in the murder trial of Christopher A. Hebert, the man accused of the 2014 murder of Lacey L. Yekel.

    The jury found Hebert guilty of one charge of second-degree murder. He will be sentenced on May 6...."
