Yes she is-they presented it yesterday in court.

Again??? Isn't this at least the 3rd infraction since he was arrested?? How many passes is this guy gonna get?

A judge says some of the statements made by a Rochester psychiatrist will not be able to be used in his trial. Judge Christopher Ciaccio is referring to statements from William Lewek made to investigators at the Public Safety Building.

However, the decision says statements Lewek made at his home will be allowed in court along with comments the doctor made at the before Lewek asked for an attorney at the PSB. According to court documents, while speaking with police, Lewek asked if he "should have a lawyer?" to which the officers replied "No" and "It's up to you."
 
He's taken a plea deal. Tampering with evidence and DWAI. Sentencing in April. Could receive 1 1/3 to 4 years. Matthew's family agreed to plea deal. On her facebook page, Kym Straton said the family was told that the drug charge was going to be hard to prove, and that a trial probably wouldn't change the outcome with regard to sentencing. She said it was one of the hardest decisions she's had to make, and she's trusting the judge to give the maximum sentence.

He could also receive up to a year for the DWAI charge but it would be served concurrent from what I understood the judge to say. Lewek could also have his license revoked from that charge & be forced to use an interlock device.
I think Kym made the best decision for her family-as she stated this could have been the best end result expected even after a trial, so this saves them from enduring through the details of Matt's last moments. <3 to those that love Matt!
