The coronavirus pandemic is causing further delays in the sentencing of a man who has pleaded guilty to killing a young woman and leaving her body in Greenwich in early 2019.

Javier Da Silva, 25, was due for sentencing Nov. 4 for his role in the death of Valerie Reyes, 24, a bookstore worker from New Rochelle, N.Y., whom he had briefly dated in the past.....

Last week, Da Silva’s lawyers asked for the sentencing to be postponed, due to the public-health restrictions set to limit the spread of the COVID-19 pandemic.

Judge Vincent Bricetti approved the adjournment and set deadlines for the sentencing submissions from Da Silva’s lawyers and federal prosecutors to be filed in January. The submissions spell out the legal background in the case and why a defendant should or should not be held to the maximum prison sentence allowed, and whether certain conditions should be imposed.

(Which carries a potential penalty of death or life in prison. Prosecutors have not yet indicated if they will seek death if he is convicted). Held without bond.

4/12/19 Update: The negotiations have not been completed and we plan to continue our discussions. The prosecutor has been given another month for negotiations, into early May.
8/16/19 Update: Plea negotiations are still in progress. Next status hearing on 8/28. 8/28/19: Next hearing on 9/25.
9/25/19 Update: Federal investigators are compiling more evidence for the case. Court papers & officials say discussions have been ongoing regarding a possible plea-deal to resolve the criminal case without a trial. Next hearing set for Dec. 18, 2019.
12/18/19 Update: Judge gives a one month extension however lawyers "must give a timeframe for a resolution" in January, but indicate a resolution will not come until at least after Jan. 15. 2/5/20: Da Silva entered a plea of guilty Wednesday in U.S. District Court. Da Silva faces 30 years to life in prison on a federal charge of kidnapping. He will be sentenced May 21. 5/21/20 Update: Sentencing has been delayed due to COVID-19 to August 9. 8/6/20 Update: Sentencing has been continued due to the COVID-19 to 11/4/20.

Court documents reveal details of 'violent struggle' in apartment before Valerie Reyes died

GREENWICH — As the sentencing nears for the man who killed a young woman and disposed of her body in Greenwich nearly two years ago, court records indicate a more violent struggle took place on the night of her death than previously revealed.

When he is sentenced Jan. 27 in U.S. District Court in White Plains, N.Y., Javier Da Silva, 25, faces 30 years to life in prison for his role in the death of Valerie Reyes in the early morning hours of Jan. 29, 2019.

Da Silva made a statement to Judge Vincent Briccetti during a court appearance when he entered his guilty plea to a charge of kidnapping on Feb. 5, 2020, exactly one year after her body was found.

“On Jan. 28, 2019, in New Rochelle, N.Y., after a violent struggle in her apartment while Valerie Reyes was still alive, I bound her feet and hands and placed tape over her mouth and placed her in a suitcase and went to Greenwich, Connecticut.”

Da Silva said he made the statement with the help of his lawyers. “My above actions, which I knew to be illegal, resulted in the death of Ms. Reyes,” he continued.

The scheduled court date of Jan. 27 has been put off until June 4 for Javier Da Silva, 25, for his role in the death of Valerie Reyes, 24, a bookstore worker from New Rochelle, N.Y.
UGH what!!! waiting until June now? can't they figure out a way to do this virtually? her poor family waiting on the conclusion to justice for Valerie!!! :(

WOW! he plead guilty 17 months ago and we're still waiting on sentencing! September!
At the very least judge says no more delays after that, and expected to be sentenced to at least 30 years so ill calm down now. lol

Has Da Silva been in police custody this whole time or out on bail? Just wondering if the postponements could be twisted into "time served"?

Entering a plea of guilty is the least he can do... that poor family has to wait 3 more months for justice to be served. That word justice seems to have lost all its meaning :(

Lawyer: Killer of Woman Who Was Found in Suitcase Remorseful

A man who killed a New York woman whose body was found in a suitcase that was dumped in Connecticut is remorseful and understands he must serve a long prison sentence, his lawyers said in new court documents.

Javier Da Silva’s lawyers filed the documents Wednesday in federal court in White Plains, New York, in a bid for leniency. Da Silva is facing 30 years to life in prison at sentencing, scheduled for Sept. 23.

The U.S. attorney’s office for the Southern District of New York declined to comment on Da Silva’s sentencing documents Thursday. The office is expected to submit its sentencing recommendation next week.
