GUILTY OH - Ember Warfel, 21 mos, found dead in crib, 29 July 2015

It sounds to me like he and his parents know he is suicidal once out of jail.

However, as an adult, can he sign himself out at anytime since it is a voluntary commitment? Since he was doing cocaine prior to his arrest, it might be he will decide to sign himself out and seek drugs for an OD. JMO.

Also, on the autopsy of Ember, would a disorder not show up in her brain?
 
Seeing that poor child I don't understand how or why someone could do that, it's heartbreaking.

MEDINA, Ohio -- A Medina County judge set a trial date for the man accused of leaving his daughter's dead body in a crib for a month, despite the fact her cause of death remains undetermined.

Eric Warfel, 35, is scheduled to stand trial May 23, nearly 10 months after a cable company worker discovered 1-year-old Ember's body in her crib.

Judge Christopher Collier set the trial date following a status hearing Wednesday in Medina County Common Pleas Court.

Ember's autopsy has been completed but the Medina County Coroner has not yet ruled on a cause of death, Medina County Prosecutor Dean Holman said.

Experts are performing more scientific tests in an effort to determine how she died, Holman said.

The Medina County Coroner's Office did not immediately respond to a request for comment.

The trial was scheduled to begin in January, but it was postponed since the autopsy wasn't finished.
 
So it's been 7 months now, and the autopsy is still not complete? I wonder what happened.

What's everyone thinking? Foul play or not? Baby Ember did look like she had some medical issues, and her grandpa confirmed that. We haven't heard what issues though, or if they contributed towards her death. Did she die naturally, and her father had a mental breakdown and just couldn't deal with it? Did he neglect her medical needs until she died, and then he didn't want to get in trouble? Or did he kill her?

I'm guessing that the sister's testimony will be very important. She may have actually seen what happened to Ember, and even if not she'll be able to tell how daddy was acting afterwards. Probably pretty erratically, since he was also taking cocaine at the time.

I guess it's probably just a simple case of a drug addict neglecting his child until she died, and then failing to even report the death... I don't know though, he looks like a doting father in his pictures and I kind of want to believe that.

Warfel's trial is set to begin at 1 pm in Medina. He was arrested back in July after his daughter's body was discovered under pile of trash.

Warfel is currently charged with tampering with evidence, a third-degree felony; gross abuse of a corpse, a fifth-degree felony; three misdemeanor counts of endangering children; and two counts of possession of cocaine, a fifth-degree felony.

The child endangering counts involve incidents when Warfel allegedly left his 7-year-old daughter alone on two occasions. Once, the girl left the apartment and was walking around crying the evening of June 18, the day before her sister died. She was found by neighbors, who stayed with her nearly an hour before Eric Warfel could be found. One neighbor testified at trial...

Warfel told them he had started using cocaine earlier that year after regaining custody of his two children and paid for it using money his parents gave him every month.

Warfel told police he found his daughter dead early June 19 and tried to revive her. When that failed, he placed a crucifix in her crib and closed off the room, only going back in one more time. Lynn said Warfel said he and his living daughter would stay in motels when he had the money due to the smell of Ember’s decomposing corpse...

Recent court documents state a sample of Ember Warfel’s hair tested positive for cocaine and additional testing is being conducted to see when she presumably ingested the drug.

Defense attorney Michael O'Shea said Warfel's failure to report her death is not enough evidence to support charges of abuse of a corpse and tampering with evidence.

"You have to actively violate [those statutes]," O'Shea said. "You can't passively do it. There's a plethora of case law out there that says so."

But prosecutors said Warfel's actions violated state law. The prosecutors also said they believe Warfel failed to report the death because he wanted to avoid an investigation.

"It's the state's contention that the defendant did not call or notify anyone of the death because he didn't want an autopsy," Medina County Prosecutor Dean Holman said. "He didn't want an investigation."

I'm probably wrong but someone who can live with a dead child in their house for more than a month doesn't seem to be in his right mind. If he killed her and knew what he did was wrong I believe he would hide her somewhere buried or not. Maybe a better place for him would be a mental institution?

A Medina County judge ordered a 3 year prison sentence for Eric Warfel — a 34-year-old Medina man convicted of leaving the body of his 20-month-old daughter in her crib for more than a month after her death.

Warfel was sentenced on one count of tampering with evidence, a third degree felony, and two counts of cocaine possession, both fifth degree felonies. During sentencing, the tampering with evidence charge was merged with a fifth degree felony, gross abuse of a corpse.

He also received time on three counts of endangering children, all first degree misdemeanors.

The sentence is less than the amount suggested by Medina County Prosecutor Dean Holman, who asked the judge for a 5 year sentence Friday morning. Warfel could have faced up to six years in prison on the charges.
 
Wow. I guess that is all the justice system could prove. Or he must be mentally deficient. To leave a dead body rotting in a house would smell awful and be found out, just like it did.
