Man accused in 1992 murder ruled not competent for trial

YOUNGSTOWN — Samuel Legg III, 51, will remain in a Columbus mental hospital, Judge John Durkin ruled Wednesday after a mandatory six-month hearing on Legg’s mental health.

Last October, the judge ruled that Legg could not be restored to competency to stand trial for the murder of Sharon Kedzierski of Florida, whose body was found behind a former truck stop in Austintown in 1992. Durkin sent Legg to Twin Valley Behavioral Healthcare in Columbus. Legg lived in Ohio and Arizona.

A recent evaluation indicated there had been no change in Legg’s mental status, and he is unable to understand the nature and objectives of the criminal proceedings against him, is unable to assist in his defense and remains a mentally ill person subject to a court order.

Legg will be evaluated again in two years and have another hearing before Durkin.

Wood County Common Pleas Judge Matthew Reger ruled Monday that Samuel Legg III is incapable of assisting in his own defense and will continue to be held in a psychiatric facility.

9/16/20 Update: Legg will remain in state custody in Franklin County, where he is under treatment in an effort to make him competent enough to stand trial in Medina County. Medina County Common Pleas Court Judge Joyce Kimbler ruled Wednesday that prosecutors have at least an additional 6 months to restore Legg to competency. Legg is facing two rape charges in Medina County as well as two murder charges in Wood & Mahoning counties & an out-of-state murder charge in Illinois. At Wednesday's hearing, Legg's attorney argued that under Ohio law, if a defendant hasn't been restored to competency after being at a mental hospital for one year following a court order, the charges have to be dismissed. Legg was ordered to Twin Valley Behavioral Healthcare in September 2019. Judge Kimbler found that Legg, by refusing to take part in the hospital's treatment program, had stopped the running of the one-year restoration period. She found that the time period should be extended by 6 months & could be extended even longer if Legg continues to refuse to take part in his treatment, and ordered the hospital, through the state of Ohio, file monthly reports regarding Legg's cooperation with his treatment. Legg has been diagnosed with neurosyphilis & schizophrenia, according to the Ohio Attorney General's Office. Next hearing in February of 2021. Man found responsible for 1997 rape in Medina County

MEDINA COUNTY, Ohio (WOIO) - A man who authorities suspect as a serial killer has now been found responsible for a 1997 rape that happened in Medina County.

Samuel Legg, a former truck driver, was identified as a suspect in 2019 thanks to a sex assault kit testing initiative.

On Nov. 18, nearly 25 years after the alleged crime, Medina County Judge Joyce Kimbler found Legg responsible for two counts of felony rape.

However, due to mental illness, Legg is deemed unfit to stand trial, according to court records.

The same DNA evidence that linked Legg to the rape also connected him to four homicide investigations, authorities said, including those of his 14-year-old step-daughter Angela Hicks as well as Sharon Kedzierski.

According to court records, Legg will remain committed to a hospital in Columbus for up to 10 years.

5/19/21 Update: A recent evaluation indicated there had been no change in Legg’s mental status, and he is unable to understand the nature & objectives of the criminal proceedings against him, is unable to assist in his defense & remains a mentally ill person subject to a court order. Legg will be evaluated again in two years & have another hearing before Durkin. Judge John Durkin ruled Wednesday Legg will remain in Twin Valley Behavioral Healthcare in the Columbus mental hospital. Next hearing Notes for Court on 4/17/23 @ 7am.

Will eventually be extradited to Illinois to face the charges. The warrants were filed on 7/29/20 when the case was opened. They are for Murder/Intent to Kill/Injure & Murder/Strong Prob Kill/Injure.
8/23/21 Update: Wood County Common Pleas Judge Matthew Reger ruled Monday that Samuel Legg III is incapable of assisting in his own defense & will continue to be held in a psychiatric facility. And not competent to stand trial in a 1996 Lake Township homicide. Legg had previously been diagnosed with neurosyphilis & schizophrenia, according to the Ohio Attorney General's Office & was ordered to return to Twin Valley Behavioral Healthcare, where he'd been in custody.
OH - *Victoria Jane Collins (27) (found behind the Union 76 truck stop in Lake Township on Dec. 20, 1996) - *Samuel William Legg III (26 @ time of crime/53) indicted & charged (8/20/20) with 2 counts of aggravated murder, murder, 1st degree rape & 1st degree kidnapping. Wood County
Legg's DNA was linked to her death.

YOUNGSTOWN — Mahoning County Common Pleas Court officials have sent a notice to Twin Valley Behavioral Healthcare in Columbus and asked officials to evaluate Samuel Legg III, accused of committing a murder at a former truck stop in Austintown in 1992.

Legg, 53, a former truck driver, also is accused of three other killings in Ohio and Illinois.

Judge John Durkin ruled in October 2020 that time had run out for Legg to be restored to competency to stand trial in the murder of Sharon Kedzierski of Florida. The judge also found that Legg needed to be confined to a state mental-health hospital and remain under supervision of the judge indefinitely.

After six months there, the judge ruled that Legg needed to remain there for at least two more years. But it has been two years since that evaluation and ruling, so it is time for Legg to be evaluated again. It will result in another hearing before Durkin in the coming weeks.

Legg was later linked to the 1997 rape of a girl in Medina County, the 1997 murder of a woman in Western Illinois and the 1996 murder of a woman in Wood County near Toledo. Those jurisdictions also had pending cases against Legg at the time Legg was ruled to be not competent to stand trial.

Mahoning County Assistant Prosecutor Mike Yacovone said the other jurisdictions appeared to be waiting to see the outcome of the Mahoning County case to determine what their next step may be.
