The trial of accused serial killer Michael Madison, scheduled to begin July 21, could be delayed for several months as an appellate court decides the issue of a court-ordered psychological exam.

Earlier this month, the Ohio 8th District Court of Appeals refused a request by Cuyahoga County prosecutors to place the issue on an accelerated docket. Prosecutors and defense attorneys also have yet to file briefs on their respected arguments.

That means it could take months for the issue to be resolved. A decision on whether the trial is going to be pushed back is expected in the coming days.
 
A judge has granted a motion by defense attorneys that prevents prosecutors from comparing an Ohio man who faces a capital murder trial for killing three women with notorious Cleveland serial killer Anthony Sowell.

Michael Madison’s trial is scheduled to begin April 4 in Cuyahoga County Common Pleas Court. Defense attorney David Grant said Tuesday that he made the request, which a judge granted last week, anticipating that prosecutors might make the comparison, which he called “irrelevant and prejudicial.”

“We don’t want that language used in front of a jury,” Grant said.

Trial for Ohio man charged with killing 3 women set to begin
More than 2 ½ years after Madison was indicted on multiple charges of aggravated murder, kidnapping and rape, jury selection for his trial is set to begin Monday in a Cleveland courtroom. He faces the death penalty if convicted.

Jury selection is expected to stretch into next week, and prosecutors have lined up at least 50 witnesses that could take an additional three weeks to question. Madison's attorneys aren't commenting on what evidence or witnesses they plan to present, but attorney David Grant said last week that if Madison is convicted, the defense team will work to save his life during the mitigation phase of the trial.

In Ohio, a jury can recommend the death penalty, but the ultimate decision is left to the judge.

Jury selection continues in trial of accused East Cleveland killer
CLEVELAND, Ohio -- Jury selection in the trial of accused serial killer Michael Madison is expected to last until at least Monday, according to court officials.

Prosecutors and defense attorneys on Wednesday evening were still individually questioning 75 potential jurors, the first of three steps before picking 12 jurors and six alternates.

Assistant Cuyahoga County Prosecutor Anna Faraglia delivered opening statements Friday by telling the judge of the final days of the lives of Shirellda Terry, 18, Angela Deskins, 38, and Shetisha Sheeley, 28 who were killed between October 2012 and July 2013.

Defense attorney David Grant did not dispute that Madison killed the three women, but he characterized his client as a drug addict who lived a tormented life and who was prone to fits of rage. Faraglia said that Madison confessed to killing Sheeley and putting Terry's body in a garbage bag...

The jury visited the area around Madison's apartment after opening statements concluded, including the garage, the field and the basement where the three bodies were found.

Defense attorney David Grant called the outburst "unsworn testimony" and asked Cuyahoga County Common Pleas Judge Nancy McDonnell to grant a new trial.

McDonnell asked the 12-person jury to disregard the outburst and denied Grant's motion of a new trial. Grant said later that the outburst could provide the foundation of an appeal if Madison is convicted.

Girlfriend of accused East Cleveland serial killer described 'deep scratches' on his face
The girlfriend of accused East Cleveland serial killer Michael Madison's told a jury Thursday that he showed up at her house with scratches on his face around the time police believe he killed 18-year-old Shirellda Terry.

Mahone said she asked him what happened when he showed up at the door with deep, fresh scratches on his face that July.

"He said he got into a fight and a girl jumped in and scratched his face," Mahone said. Madison told her that he got in a fight while taking his car to a repair shop.

In the days that followed, Mahone said that Madison's apartment began to smell like sewage. Madison told her that he thought an animal died, and he lit incense throughout the apartment in an attempt to cover up the smell.

Less than two weeks later, police found Terry's body inside Madison's garage, along with evidence that he had kept the body inside a hallway closet.

A jury will now decide the fate of an East Cleveland man who admitted to police that he killed three women and disposed of their bodies near his East Cleveland apartment...

Assistant Cuyahoga County Prosecutor Christopher Schroeder portrayed Madison as a man with multiple faces; one who charmed his way into the lives of his victims, but also a hateful man who harbored spite for both his mother and the mother of his two children.

Madison's defense attorney, David Grant, characterized his client as a confused and tormented man with a drinking problem. He challenged the jury to question the prosecutors' claims that the slayings were part of a meticulously planned series of kidnappings and killings.
 
Assistant prosecutor Chris Schroeder told the court Madison had left the women "in the vicinity of his apartment where he could look down on his trophies".

The trial heard the convicted sex offender - who was a marijuana dealer in his run-down neighbourhood - had charmed the women to earn their trust.

But Madison harboured a hatred for the women in his life, including his mother and the mother of his two children, prosecutors said.

One former partner testified that he had told her "he can't stand the female species".

Despite his apparent hatred for his mother, Madison was arrested at her Cleveland home.

Prosecutors said Madison deserves to die for murdering 38-year-old Angela Deskins, 28-year-old Shetisha Sheeley and 18-year-old Shirellda Terry, whose bodies were found in July 2013 wrapped in garbage bags near the East Cleveland apartment building where Madison lived. A medical examiner ruled that Deskins and Sheeley were strangled, but couldn't determine how Terry died.

Authorities said Madison confessed to killing two of the women after his arrest, but couldn't recall having killed the third. His attorneys conceded at trial that he had killed the women.

The same jury that convicted Madison now will decide his fate, with the judge having the final say. In Ohio, a judge can reject a death sentence, but can't impose one if a jury doesn't vote for it.

EAST CLEVELAND, Ohio-- A father*of one of the women *killed by Michael Madison, attacked*the serial killer during sentencing Thursday afternoon.

Michael Madison, the*man convicted of killing three women and wrapping their bodies in garbage bags,*had just been sentenced to death and victims' family members came up to speak. When Van Terry, father*of Shirellda Terry, came up, he said, "I guess we are supposed to find it in our hearts to forgive this clown... who has taken my child," then he turned around, and*jumped on*Madison. *Authorities and other people inside the courtroom grabbed him and took him out.

The judge followed*a jury's recommendation that Madison, 38,*should be executed for aggravated murder and kidnapping. The judge could have instead chosen life in prison with no chance of parole.
