5/10/22 Tuesday, Trial Day 17: State wants 104 hearing for defense witness of Dr. Warford. Specifically regarding her qualifications to 2 defense questions.
Defense witnesses: Shana Grenlake, product designer & knows Nancy. 104 Hearing of Dr. Patricia Warford, license psychologist. Judge denies State’s objections to the 2 questions, finds her qualified to answer.

Haven't been watching this one as much as I wouldve liked to but this recent exchange I saw was interesting.

Being asked outside of presence of the jury, witness asked about the conversation she had with NB about NB buying a gun.
She said "I would say early 2017, the best I could remember?
Asked "early 2017?"
She replies "to the best of my recollection"
Defense then asks her if they had a conversation yesterday and "did you say it was late 2017?"

Later State asks "so you don't recall saying 'i don't, I'm not certain it was in 2017 at all', outside of the presence of the jury ? "
She answers "Did I say 'I wasn't sure when in 2017' or 'it wasn't 2017 at all' ??"
State replies "(repeating that she supposedly said) 'It wasn't 2017 at all.' "
She replies "I guess I thought I said it differently..."
State replies "OK. uhm, but you're not sure when, like couldn't tell you what month or anything?
She replies "it was very in passing" while slightly shaking her head.....

I was a bit surprised the Defense didn't object to this or have it read back. I've listened to this exchange a couple times now and the exact sentence that the State is saying that she said - and trying to use it it catch her in a lie or an inconsistent statement - was not at all what she said....
She said once it was "late 2017" and today "early 2017" but she never said verbatim "it wasn't 2017 at all" like the State is saying she did. Did I tune in and just happen to catch this little blunder or has the State been sloppy throughout? Mischaracterizing and misstating a witness' statement seems pretty not-so-great....

104 hearing for Linda Smith, friend of Nancy’s 10 years, writing partners.
Defense witnesses: Linda Smith. Darla Lukenbaugh, writing partner in 2 groups (met in 2005). Kimberly Tuttle-Kirk, owns a fire arms range & store. Delilah Ahrendt, romance writer, knows Nancy from writers group (almost 20 years) & culinary cook, Dan was her teacher. Jessica Smith, recalled, Nancy’s friend for 10 years.

Trial continues on 5/12/22. Will have a 104 hearing for defense witness Tony Hall for attorneys/Judge only @ 9am & jurors back @ 9:30am. There will be NO court for jurors on Friday, 5/13/22.

(afternoon session): Barbara Dawson, owned cooking store & knows Nancy thru catering & Dan worked at her cooking store. Recalled: Joshia Roloff, digital forensics examiner. Wendy Warren, knows Nancy (since 18-20 years ago at a writers conference; Nancy was catering.

There will be NO court for jurors on Friday, 5/13/22. For tomorrow will discuss defense’s motion to have some witnesses testify thru WebEx. State agrees with their witnesses to testify thru WebEx. Friday hearing re State’s witness of Susan Jacobs, a “sort of” jail house informant. Judge will rule on this. Trial continues on Monday, 5/16/22 for Day 20.

Fascinating trial day today. . . counsel arguments and testimony - jury not present - regarding potential rebuttal witness 'jailhouse snitch' Anndrea Jacobs (currently serving federal prison sentence).
From what I've heard thus far, I don't think the judge will allow Jacobs to testify. Hopefully, he'll rule later today.

Eastern Oregon Medical Practice Employee Pleads Guilty to Tax Crimes, Bank Fraud​

PORTLAND, Ore.—The former office manager and bookkeeper for a La Grande, Oregon medical practice pleaded guilty today for devising a scheme to defraud her employer, announced U.S. Attorney Billy J. Williams.
Anndrea D. Jacobs, 49, pleaded guilty to filing a false personal income tax return, falsely impersonating an IRS employee, aggravated identity theft, and bank fraud as a joint resolution for two criminal cases.

"In that interview, among many things that Ms. Jacobs said, was she did talk about how Ms. Brophy disclosed to her — to be fair, seemingly accidentally, maybe — disclosed to Ms. Jacobs that she held her arms apart, Ms. Brophy held her arms apart like a wingspan, and said, 'I was this far away when the shooting happened.' She then corrected herself, Ms. Brophy did with Ms. Jacobs, and said, 'well, I mean, it happened this far away,' something like that. Ms. Jacobs reported that it became very awkward between the two, so awkward in fact that Ms. Jacobs decided to change the subject," said Multnomah County Senior Deputy District Attorney Shawn Overstreet.

Circuit Court Judge Christopher Ramras declined to rule on the matter immediately — and later asked for written arguments from the attorneys to be submitted by May 11.

Defense attorney Kristen Winemiller told Ramras there was “no way” the trial could conclude by May 20 if the judge allowed Jacobs to appear as a rebuttal witness after the defense rests.

“To respond to this would require a significant investigation,” Winemiller said. “It’s just simply too late, after they’ve rested, to bring in another witness of this magnitude.”

The ongoing trial of romance novelist Nancy Crampton Brophy went on pause on Friday while prosecutors and Crampton Brophy’s defense team presented arguments about whether to allow the state to bring in a former cellmate of Crampton Brophy’s as a rebuttal witness, although Judge Christopher Ramras ultimately said he would wait until Monday to announce his decision.

PORTLAND, Ore. (KOIN) — On Friday, instead of holding another trial date for Nancy Crampton Brophy, the defense brought people to the stand to question the validity of a witness who shared a jail space with Brophy.

The witness in question is Anndrea D. Jacobs, who was sentenced in January 2021 to federal prison for tax crimes and bank fraud and was in jail at the same time as Brophy from January 2021 to March 2021, according to the court.

Defense took the bait and worked themselves in a frenzy to exclude the bunkie. They worked themselves into such a frenzy, they threw a tantrum about how exhausted they are.
Big win for the prosecution. They really don’t need the bunkie, but they’ve got defense to self-immolate. AND they’ve been pretty much able to not say a whole lot, kick back all day, and catch their breath.

Not only that, defense alienated about 20 local attorneys from every possible attorney niche. They evidently subpoenaed a batch the day before and ordered them to bring thousands of pages of confidential documents. The attorneys, natch, brought their own attorneys….

The prosecutor seems so Joe Average, he’s very disarming. He stabs defense witnesses from nowhere, and every time, he has a different kind of jab. All while kinda bumbling around. It’s a weird kind of genius.

One very self-important romance writer was all excited for cross. Licking her lips. Prosecution: “No questions.” The witness was dumbfounded lol. Jaw drop. Made her seem completely irrelevant, which she was.

One defense witness, who had clearly been coached to a script (all NB’s relatives said the same thing, with the same language and phrasing) blurted in cross, “I wasn’t expecting that question…”

The prosecutor also lets things drop, seemingly in passing. Yesterday, we heard NB has not been sedate in prison: she’s bad-tempered and assaulted another prisoner. It’s unclear whether this will be believed on the witness stand or not, but no matter. The prosecutor threatens he will be free to insert this in rebuttal, because there’s been all this defense testimony about NB’s saintly behavior and fantasy-level relationship with DB.

The State doesn't need her, but will take her if they can get her. In the meantime, they've caused Defense to exhaust themselves. It's brilliant.

Nancy is also a lying liar who lies (consider the whole marriage sham)....

My recollection is that this witness did indeed go vague when prosecution asked for date verification. It's been typical for the character witnesses. When asked for definite, they suddenly are not quite sure.....
The State has been very detailed and precise.
