Two months before a forest service worker found Heather Mallory's body, police set up a wiretap on her husband's cell phone, the man now on trial accused of murdering her.

After the wiretap was set up, police talked to just about everybody in Brian Cole's life except him, giving the impression they had found Mallory. Cole got wind of it and police listened to see how he would react.

The wiretap audio recorded by Portland investigators in April 2010 was played in court Wednesday. It captured Cole’s conversations with his mother, stepfather and Mallory’s father, Steve.

“When Mr. Cole was challenged, he would change his story,” Weinstein said. The detective added that in his 20 years of experience he never came across a suspect or person of interest who would change his story when pressed for details as Cole did.

The jury deliberated from noon 6/27 and announced a verdict at 1:00 6/28. All 12 jurors agreed Cole killed his wife. Formal sentencing will be 7/20. Sentencing guidelines are life in prison with possibility of parole after 25 years.

Justice has finally arrived for Heather.
