LE believe they were dead on May 16, 2019) – *Michael John Wolfe (52) “father of Billy” – sought for questioning since 5/23/19, arrested (5/24/19), charged (5/28/19), originally indicted (6/6/19) & arraigned (6/21/19) with 2 counts of aggravated murder, 1 count 1st degree murder/constituting domestic violence & 2 counts of 1st degree kidnapping. Indictment amended (10/25/19) to 1 count of aggravated murder (for Billy) being dismissed (on 3/20/20), but charged with 1 count of aggravated murder, 4 counts of 1st degree murder & 2 counts of 1st degree kidnapping. No plea entered yet. Held without bond.

12/27/19 Update: Defendant was allowed to wear street clothes. Judge takes motion to dismiss count 1 under advisement. Next status hearing on 2/10/20. 2/7/20: Judge Easterday denied the motion to dismiss the Aggravated Murder charge. 2/10/20: DA to respond to defendant's motion to dismiss by Feb 21. Defense to reply by Feb 27. Defense said they would be ready to go to trial in 12 to 18 months. Hearing on motion to dismiss set for Mar 3, 2020.
3/20/20 Update: Judge dismissed Count 1: aggravated murder (Billy), as court rules no death penalty. Next Status Check hearing on 5/4. Motions hearing on 4/5/21 which will take all day & trial set for 4/6/21 scheduled for 3 weeks. 5/1/20: Appointed Counsel in the Supreme Court.

Just a reminder from the Statesman Journal, this is what District Attorney Brad Berry said back in June 2019:

Separately, the district attorney’s office asked for Judge Ladd Wiles to be removed from the case.

"I believe the State cannot have a fair and impartial hearing or trial if these matters are held before the Honorable Ladd J. Wiles," Berry wrote in a June 10 affidavit.

The request was approved, and Judge John Collins is now on the case.

Berry said it wasn’t uncommon for the defense to say they didn’t want a certain judge. "We have our reasons," he said. "We don’t do it very often."

The Oregon Courts website shows some recent activity. Two new hearings have been scheduled for March. These hearings have been assigned to judge Cynthia Easterday. The week long evidentiary hearing has also been reassigned from Judge Wiles to Judge Easterday. These are encouraging developments.

Thursday, march 11th:
*Motions Hearing (@ 8:30am PT) - OR – Karissa Alyn Fretwell (25) & William “Billy” Alan Fretwell II (3) (last seen May 13, 2019, reported missing May 17, 2019, Salem; found June 15, 2019 approx. 10 miles west from Yamhill on Weyerhauser property off Turner Creek Rd. LE believe they were dead on May 16, 2019) – *Michael John Wolfe (52/now 53) “father of Billy” – sought for questioning since 5/23/19, arrested (5/24/19), charged (5/28/19), originally indicted (6/6/19) & arraigned (6/21/19) with 2 counts of aggravated murder, 1 count 1st degree murder/constituting domestic violence & 2 counts of 1st degree kidnapping. Indictment amended (10/25/19) to 1 count of aggravated murder (for Billy) being dismissed (on 3/20/20), but charged with 1 count of aggravated murder, 4 counts of 1st degree murder & 2 counts of 1st degree kidnapping. No plea entered yet. Held without bond.
Trial was set to begin on 4/6/21 continued to 9/13/21 (6 weeks)

Proceedings: attorneys Gentry & Sweeney by phone – defendant by video - DDA Lynch & Winter appearing in person for the state - victims by phone - set status check 8/12 @ 8:30am. Status Check to schedule further motions. Motion hearing on 10/8 which is scheduled for 2 days & 4/5/21 all day. Trial still on for 4/6/21.
8/12/20 Update: Hearing was held. Parties Present: Plaintiff: State of Oregon, District Attorney: Yamhill County District Attorney, Defendant, Privately Retained: Dianna J. Gentry, Court Appointed: Patrick John Sweeney. Attorneys waived defendant's appearance-telephonic; reset motions & trial-no dates given at this time-submit motions within 6 weeks, response 3 weeks & reply 2 weeks-set status hearing. Next Motion hearing on 10/8/20 for 2 days & status check hearing on 10/15/20 to set motion dates. Motion hearing on 10/8 & status hearing on 10/15 & trial on 4/6/21 have all been cancelled. Motion for trial continuance-granted. Next motion hearing on 4/5/21 @ 9am which will last all week. Trial is set to begin on 9/13/21.

3/5/21 Update: Telephonic hearing on 3/11/21 to set new motions hearings.

Remember the history.
Review the screen shots from the court website that were posted a few months ago. As originally scheduled, judge Ladd Wiles was scheduled to preside over the week long motions that are scheduled in April. As explained in the Salem statesman journal, District Attorney Brad Berry demanded that Judge Ladd Wiles be recused from the Wolfe case. This is documented early on the Oregon Courts website. As the Oregon Courts website evolved over time, Judge Easterday replaced Judge Wiles for the week long motions hearing in April. Now a series of hearings have been scheduled then cancelled. Cancel reason is to reschedule the week long motions hearing. We haven't seen this hearing rescheduled, yet. Judge Easterday might not be able to preside over the new hearing date. As a result, Judge Wiles might preside over the motions. Criminal cases are usually won or lost during the motions phase during which it is decided what evidence that the jury will be allowed to see and hear. It will also be decided what witnesses might be qualified or disqualified as expert witnesses. This could be a disaster.
