Convicted sex offender indicted on aggravated murder, kidnapping in missing woman's death

A convicted sex offender was indicted Wednesday on 23 charges, accused of kidnapping, sexually abusing, and murdering a missing 89-year-old woman who was found dead inside his car.

According to the indictment, Mackley is accused of kidnapping Herinck from her Northeast Portland home sometime in the day after she was last seen (Sept. 18).

Investigators then allege he sexually abused her, and "intentionally tortured" and "maimed" her during the six-day period when she was missing, ultimately killing her and transporting her remains in the trunk of his car.

Mackley has been indicted on 13 counts of aggravated murder, one count of intentional murder, four counts of first-degree burglary, two counts of second-degree kidnapping, two counts of first-degree sexual abuse, and one count of abuse of a corpse.

He is scheduled to appear on the charges on Thursday, October 4.

Mackley told jailers on Sept. 25 that he has bipolar disorder and schizophrenia. At his first court appearance last month, he bobbed up and down, made exaggerated facial expressions and appeared to be talking to himself.

After a grand jury indicted him Wednesday, he was appointed a new defense attorney who is experienced in representing clients facing a possible death sentence.

Mackley faces charges of aggravated murder, murder, first-degree burglary, first-degree kidnapping, first-degree degree sexual abuse and second-degree abuse of a corpse.

A Deputy District Attorney told the Judge that the prosecution isn't agreeing to any findings about Mackley's mental status. Rather, the prosecution was only agreeing to a delay in the arraignment.

Mackley didn’t appear at Thursday’s court hearing. His next court date is scheduled for Nov. 7.
