Circumstances of Recovery
On the morning of March 11, 2024, an unresponsive unclothed infant was discovered on Second Street (U.S. Route 522 ) in close proximity to the intersection of Lincoln Way East (Pennsylvania Route 16). Despite immediate medical intervention, the infant was pronounced deceased at the scene. The infant was born less than 24 hours prior to discovery and is estimated to be 36-37 weeks gestational age. Preliminary findings indicate the situation is being treated as suspicious.

The county coroner believes the baby was in the ninth month of gestation. However, there was no evidence to suggest the infant was still alive when the remains were left.

Regardless, in most states, not reporting a death or disposing of a body in this manner is a crime, right? Do you know if it is a crime in PA? TIA

Cross References. Section 5509 is referred to in section 3307 of this title.

§ 5510. Abuse of corpse.

Except as authorized by law, a person who treats a corpse in a way that he knows would outrage ordinary family sensibilities commits a misdemeanor of the second degree.

§ 4303. Concealing death of child.

(a) Offense defined.--A person is guilty of a misdemeanor of the first degree if he or she endeavors privately, either alone or by the procurement of others, to conceal the death of his or her child, so that it may not come to light, whether it was born dead or alive or whether it was murdered or not.

At the time, the Fulton County Coroner’s office had not yet disclosed whether the child was stillborn or ever born. Now, the coroner says, the baby appeared to have been born less than 24 hours before being discovered, and was estimated to be between 36 and 37 weeks, or about 9 months, of gestational age at the time of birth.

-----------------------------------------------

An autopsy was performed at Forensic DX, in Windber, Pennsylvania on March 11, and the cause and manner of death are still under investigation pending those results.

if the baby was in fact 36 weeks then 4 lbs isnt that hard to believe. they gain a pound a week in the last month so it could be 8 at 40 weeks.
