GUILTY PA - Three bodies found in New Castle Home, 16 Oct 2018 *Arrests*

Just a quick update, or lack of one in this case. I have been checking the court site daily and nothing has been changed or updated. Last scheduled date still says scheduled.

Monday, August 1st:
*Omnibus Pretrial Motions Hearing (@ 1:30pm ET) - PA – Nichole Pumphrey (31), her daughter, Ameriah Emery (10) & Lawrence Cannon (31) possibly BF (Oct. 16, 2018, New Castle) – *Steven Procopio (19/now 22) arrested & charged (10/17/18) with 3 counts of criminal homicide, 3 counts of criminal conspiracy, attempted murder & gun offense. Plead not guilty. Bail denied.
Trial was set to begin on 3/7/22 continued on 4/4/22 & continued with no further dates available.

6/6/22 Update: Omnibus pretrial hearing was continued & from Judge Dominick Motto to Judge J. Craig Cox on 7/5/22.
7/5/22 Update: Lawrence County’s president judge has denied a motion in its entirety, to dismiss charges for Procopio in a triple homicide case. District Attorney Joshua Lamancusa said Tuesday that because of the judge’s ruling, Procopio will stand trial. His court-appointed defense attorney, John Bongivengo, had filed pretrial motions & a petition to dismiss the case, challenging the validity of the witness’ testimony because of her age. A key witness & the only eyewitness in the case, is a 10-year-old child who was 7 at the time of the killings. The judge, weighing her testimony at a pretrial hearing, reasoned in his written opinion with his June 28 dismissal order that the child was able to remember the details of that night & witnessed Procopio shooting Emery & Pumphrey. He also reasoned that her account in court of that night was similar to what she had told forensic interviewers at the Children’s Advocacy Center after the shooting had occurred. He also reasoned that because Procopio was only 18 & not 21 at the time of the killings, he was not permitted to carry a gun. Hearing was rescheduled on 8/1/22.
*Anthony Lavon “Mook” Cooper, Jr. (19/now 22) – Plead guilty on 1/18/22 & was sentencing to 15 to 30 years in prison.
*Jody Lynn Hammer - 4/1/19:
All charges are dismissed.

Found another article this morning - at least it gave me who the witness was after opening statements!

Anthony Cooper pleaded guilty to killing Nicole Pumphrey and Lawrence Cannon, but he didn’t plead guilty to killing a 10-year-old girl because “he knows that even on the streets, you don’t kill kids.”

That was part of the opening statement presented to a jury Wednesday by District Attorney Joshua Lamancusa in the trial of Steven Procopio, 21, formerly of Pulaski, who is charged with killing 10-year-old Amariah Henry, and as an accessory to the murders of Cannon and Pumphrey.

John Bongivengo, Procopio’s court-appointed defense attorney, countered in his opening that the prosecution does not have any hard evidence in the case, and that his client is charged with the murder of Pumphrey and the child, yet Cooper already pleaded guilty to killing Pumphrey.

New Castle police detective Branddon Hallowich was on the witness stand for the rest of the day, describing the crime scene, the investigation and the discovery of the shell casings in the house. During his testimony, Lamancusa played two of several interview tapes of Procopio, before and after his arrest, noting how his story changed about his circumstances that night. The first interview was the night of Oct. 16 before his arrest.

Procopio told police a different story from the first interview, but in both interviews he said, “I was not there when it happened.”

He told the detectives he heard from someone else that Amariah Henry was still on the stairs when she was shot. However, the police never released that information to anyone, Hallowich said.

Lamancusa said more subsequent interviews with Procopio will be played throughout the day on Thursday, intertwined with testimony from Hallowich. He said the trial is likely to extend into next week.
