Monday, Sept. 17th:
*Supreme Court back in session - SC - Heather Rachel Elvis (20) (Dec. 19, 2013; never found) - Tammy Caison Moorer (41/now 45) charged & indicted (March, 2017) with kidnapping & indicted (April 27, 2018) with conspiracy to commit kidnapping.
*Sidney StClair Moorer (38/now 42) charged & indicted (March, 2017) with kidnapping & indicted (April 27, 2018) with conspiracy to commit kidnapping.
8/30/17: Sidney StClair Moorer accused of obstruction of justice charge for allegedly lying to investigators about phone call on night Heather went missing and found guilty 8/30/17 rec'd 10 years with year served. Eligible for parole Oct. 13, 2018, parole hearing would be 45-60 days after this date.
4/27/18: Both indicted on conspiracy to commit kidnapping.
7/25/18 Update: State files (7/13/18) Joinder Motion to try both defendants in one trial. March, 2017 GJ indicted Sidney for kidnapping & obstruction of justice and Tammy for kidnapping. On April 27, 2018 and additional indictment against both for conspiracy to commit kidnapping. Tammy's trial is set for Oct. 8, 2018, pending motion outcome.
8/18/18 Update: Motions included changing the trial’s location, preventing testimony about headlights, allowing testimony related to an unavailable alibi witness and to lift a gag order. All motions denied. Judge Steven John previously placed a gag order on the case, which prevents attorneys and those involved from talking about it publicly. Moorer also planned an attempt to dismiss the case based on alleged violations of attorney-client privilege and violating Moorer’s speedy trial rights. Culbertson also shut down those efforts. In Culbertson’s ruling, he did note that his decision does not apply to issues that may occur during trial.
9/5/18 Update: Had pretrial hearing: The state asked Judge Benjamin Culbertson to lift the gag order, but Culbertson said because he was not the judge who put the gag order into play, he had no jurisdiction to remove it. Moorer’s defense team presented a number of motions, including having the charges severed, a request for a change of venue for the trial, and a motion to suppress statements Tammy Moorer made about Heather Elvis or statements about the Elvis family made during phone calls or on social media. Judge Culbertson denied all motions except the suppressed statements motion, saying he would hold on making that decision and would continue the motion. A motion by state wants to file is to try Tammy and Sidney Moorer together. Judge says he understands states request to try both defendants together, but as it stands right now he has no control over State vs. Sidney Moorer case.
9/6/18 Update: The Supreme Court returns to session on Sept. 17. If the state’s high court ultimately decides to try the cases under one judge, it could push back Tammy Moorer’s Oct. 8 trial start date. Culbertson said that issue would be addressed if the Supreme Court rules in the state’s favor.
