I’m beginning to wonder if the four who voted for life just found they could not vote for the DP after all and the abuse story was just the reason/excuse they hung their hats on.?.?.

I have to say this would have been me had I sat on that jury. I probably wouldn't call it an excuse, but I am vehemently against the death penalty, and could never find it within myself to put somebody to death no matter their crime. I am also of the belief that living out your natural life behind bars is a tougher punishment than death. If I had to give a justification for my decision had I been sat on the Arias jury, it probably would have been that there was a mutual level of mental abuse, and I would have also taken into account some mitigating factors such as no prior criminal convictions.

Thank you, if I understood correctly, you have confirmed my assertion in my post above with a different "justification". The difference, though, is that each juror in this case went through voir dire and were qualified to sit on this death penalty case, in other words, stated they could vote for the DP if warranted.

Had any of those potential jurors stated the BBM, they would not have been seated unless they lied about those strong views.

I appreciate your candor.
 
Did the jury hear JA claim being sexually assaulted? Did her inane DT say she was raped during opening statements?

Yes ... vague insinuations ... though not "sexual assault prior to murder" which I interpreted as "just" prior to murder ... not sure if sexual assault assertion was included in OS ... IIRC, there was insinuation on the sex tape and during JA's testibalony. HTH

I don't know if it was said during the Opening Statement, but during her direct testimony Jodi stated that on that last day she was there at his house that Travis and she were in his office and he ended up forcefully bending her over something (a chair I think) and performing anal sex on her and then ejaculating onto her back. She said she went into the first floor powder room to clean herself up afterwards.

I didn't believe a word of the story.

To me, it sounds like the 4 "jurors for life" got off track a bit. And then dug their heels in. I too cannot fathom how a juror could convict for first degree premeditated murder and then turn around and use "oh, but she was abused" to negate the death penalty. Perhaps at this point those 4 jurors can't really figure out how they did that either, and that's why they are not talking.

From what has been said, that deliberation room with filled with a LOT of emotion (probably too much) plus they were stressed out and tired. Not an ideal situation for rational decision making.

I am another one who is just darn glad they were able to come to the "guilty of first degree premeditated murder". Plus, while I do feel she deserved the death penalty, since reading about what her incarceration will entail at Perrysville, I feel a whole lot better about LWOP.
 
I'm telling you guys it all goes back to what was my long confusing post last week in sidebar thread.. there are certain people that are especially grounded in the firmest of mindset that there is truly no young woman who would enjoy, prefer, or ever initiate anal sex,. there for in that firm mindset it absolutely places Jodi in the sympathetic victim role, with Travis in the aggressive manipulator role who at minimum is verbally/emotionally abusive in his manipulating her into anal intercorse..and at worst could interpret as not only emotional abusive but physical as well in forcing her into anal intercourse..

I posted at great length about it and am convinced it is this exact preconceived firm beliefs that led to their believing no way, no how any young woman would be into anal there for she is seen as a victim of Travis' wrt their sexual relationship..

IMO with this firm mindset there is NOTHING JUAN MARTINEZ COULD HAVE DONE OR SAID DIFFERENTLY THAT WOULD BE ABLE TO CHANGE THIS TYPE OF FIRM MINDSET THAT IS ALREADY LONG SINCE INSTILLED IN THESE PARTICULAR INDIVIDUALS!
 
i guess a lot has been posted elsewhere about what the jurors have had to say.

I watched DD tonight, again with Diane. What she had to say was depressing. More and more it seems that the 4 who voted for life all thought she was abused. From what Diane said tonight it also seems to be the case that at least one of the 4 believes Travis sexually forced himself upon the killer.

I've been an advocate for this jury throughout, even after their non-verdict. I'd expected to hear that the livers believed she was mentally ill and should be spared, and that I could at least understand and respect.

But this? It makes no sense to me that any juror could believe the killer capable of premeditated 1st degree murder AND know she is a liar, yet also believe her wild lie that Travis was the sexual aggressor.

He wasn't, but even if he had been, what the heck dies that have to do with thinking she deserves to live

I don't think Travis raped her, but, imo, if someone was raped, then I couldn't blame the victim for the actions they took after that. That would be a very traumatic violation, and one could go into any number of mental states after that, I would think.

I don't believe that is the case here, though. The case here is that Jodi is a calculating, cold, manipulative person who didn't get her way, thought she had been insulted, and made Travis pay the ultimate price. Whoever could not see that in the four or five months this trial went on is blind as a bat! :twocents:

Her statement of "you sure do know how to work the booty", said in "glowing" terms, was an indication to me that she sure wasn't opposed to it. I am old(er) -perhaps not as old as the oldest juror - and I can tell you that anal sex was not unknown back in the day. It wasn't my cup of tea, but as a young woman I had a neighbor who was probably 25 years older than me who described that she and her husband used it as a means of birth control! This was before "the pill" was around.

Plus, I think there are many gay men who enjoy it.

As an aside, but while on the subject of regular anal sex, look up "anal sphincter incompetence". It is medical condition that can develop. Unfortunate, but often seen in the gay community. Anal sex is not the only thing that will cause it, but it is one of them.

I love how Mark Eiglarsh basically goes off on certain jurors thinking that a few text messages that were justifiably using very upset language equate to abuse! Juror with short hair doesn't seem to understand why those jurors didn't get that Travis had a good reason for what he said. But she always underscores that they have the right to their opinions, even when they made concessions for her age and "lack of criminal history."

From 3:11 to about 3:21, you see Jodi's hands against her face. It struck me again, as it did during her testimony when Juan was asking her "Were you crying while you stabbed Travis?" that her hands don't match her face, both in color and in size. Her hands are very white, and large, which is the case for many people, of course, But they don't seem to match the size and color of her face. Not sure why that keeps being very noticeable to me.

They talk about how Jodi's dad doesn't show remorse. He just seems like a quiet guy - and he's ill, too - that is shocked by his daughter's actions. They're off base with this one, I think. All in all, though, good interview!

But here's the problem for me: in certain times on the stand, Juan was able to catch her off guard and, in her fit to one up him would admit to certain things. There were candid things she said that, to me, should have negated the whole rape thing. "The sex was always consensual." Her words. "I was always enjoyed the sex." Said more than once. "Anytime time I said no, Travis stopped." She'd then later come back and realize her mistake and one time said, "I always consented-oh wait!-except for that one time..." before Juan cut her off, realizing she was about to spew a bunch of bull. Couple that with her very eager texts asking to be ejaculated on and for "generous facials" and to be treated like "a horny little schoolgirl" it's a little confounding and baffling to me that they would come to the conclusion that she was ever raped by Travis.

However, I have listened to a few snippets of juror 6 (Nancy!) on Dr. Drew, and I never got the impression that's what was hanging the jurors up. It doesn't even sound to me like the whole physical abuse Travis even factored. Because, really, if you believe a woman killed someone who raped and beat her on more than one occasion, could you convict her of murder one? Would you blame her entirely for her actions? I couldn't do it if I truly believed that aspect of her story. Maybe murder two or manslaughter. But not murder one.

Maybe I'm missing some interviews, but to me, the thing that really hung the jurors up were those texts and the possible psychological abuse aspect of the relationship. They also found certain mitigators, like her age and lack of criminal record. So, and this is MOO, since we haven't heard from all the jurors, but to me, it seems they didn't necessarily believe Travis beat her or believe her version of events on June 4th (obviously, since they all voted for premeditation), and even 18 said he doesn't believe it was self defense. But believed it was possible that he did abuse her verbally and emotionally and for them that stopped them from giving her death. This is possibly just based on what they've seen in the texts and the leading her on.

It's sad. He did not abuse her. Ever. In any way. She tormented him and in that final month he was at his wits end becoming more and more frightened of her. He snapped. That's the worst he ever did: call her mean names in response to her pushing him. And we knew the jurors didn't have the full pictures so I don't think we should be necessarily surprised that some of them think this way.

For me, the most telling story, that really outlined and summed up who Travis was, and who Jodi was and what the relationship really was, was the story Sky Hughes told about Travis telling her he couldn't break it off with Jodi because she said she'd kill herself (knowing Jodi, that's is most probably true). Sky laughed and said, "she is not going to kill herself." And Travis said, "you don't know that, and I could never live with myself if she did."

To me, that is the saddest part about cases like this and about this case in particular. When someone like Jodi prays on the innate goodness of someone like Travis and exploits it, then brutally kills them for not giving them enough, no matter how good they were to them. Travis was so good to Jodi, even with the FWB stuff and possible name calling. He gave her a car and loaned her money and didn't pressure her to pay it back, at least not as much as he should have. But it was never enough for her and she couldn't handle that she couldn't win him. And now, in death, she continues to cruelly destroy him, this man that was good and kind to her. That had a good heart. That even while she was killing him, couldn't bring himself to hurt her.

That's why Jodi deserves the death penalty. That's it. She repaid him by killing him like an animal then destroying the one thing he had left: his good name.

That to me is why the hung jury is such a shame. They are believing things about him that aren't true. Maybe some of them will always believe it, maybe some will come around after hearing more information. Juror 16 said people have no right to be angry. I'm not angry and they did what a jury is supposed to do and they have a right to find their own mitigators and believe what they want. But I just think it's sad. That's all. Sad that Jodi was successful in trashing Travis's name and that she takes such glee in it. And sad that the family didn't finally get to close this painful chapter in their lives, right in the home stretch.

If I was forced into slapping the death penalty on to a criminal it would be somebody like Frederick Baer. To me Jodi Arias' crime, although I can appreciate its awful cruelty, does not quite meet the threshold of someone like Baer (multiple victims, child victim, unknown victims - not saying it makes it any better to kill somebody that you know, but in TA and JA's case there had been a worsening of relations etc - and sexual assault prior to murder). I hope that makes sense!

You wouldn't be on a DP case jury if you were honest during voire dire. Second, I'm unclear how a "worsening of relations" reduces the killer's culpability, and third... there was no sexual assault, period, at anytime.

Hi all....reading this thread and the thought just occurred to me...perhaps those 4 jurors considered anal sex as abusive? Somehow forced???

I dunno. I sure can't explain it.

you have a good theory and could be right.

however, if true then I fear the jury system will NEVER be fair nor will justice always be served.

I don't care what one thinks of anal sex or any other form of sex. consensual is consensual and there was ZERO evidence that Jodi was ever not consenting of the sex between the two of them. In fact, it appears based on evidence that she strongly pursued it.

I already fear it (the jury system) is flawed as I mentioned on another thread because all kinds of people get through and put on a jury who really should not be sitting there: liars, mentally unstable people, people lacking the ability to use logic and common sense, the inability to understand what is going on before them, etc ....having someone sit there who personally thinks a certain sex act is only used in cases of rape and uses that in their judgment towards a case is not fit to be judging a trial. IMO, of course.

I still do not have an answer on how to fix the jury system, but I still feel it is flawed.

This subject still brings out the GRRRR in me. Took time off, come back and the feelings are still there. lol

The four jurors who voted for life were reportedly a mix of male and female, but no matter what they say, none voted to spare Arias’ life because of her age. The more likely explanation is that female jurors identified with Arias on some level, maybe because they felt sexually exploited in their own lives, and male jurors who felt titillated when Arias talked about sex would have found it emotionally difficult to execute a woman who submitted herself to the kinds of activities most men only dream about.

Lots of assumptions there, which is standard operating procedure for this particularly biased writer.

Unless you are a liar (when filling out the form, etc), you never would have been chosen to sit on this jury or any death penalty trial. Never. So consider yourself lucky ;)

Next, there was ZERO evidence of any abuse towards Jodi from Travis. Zero. It was never ever ever ever EVER presented by anyone. Jodi claimed it. Jodi. You know that chic who is a pathological liar and even admitted to her lies? So why anyone would believe anything that ever came from her mouth, has bought into her manipulation hook line and sinker. One has been 100% manipulated if they believe she was abused and sexually assaulted by Travis, as there is zero evidence. Just the liars word.

As far as no criminal convictions. lol Ummm, what does that have to do with the price in China? Nothing. She actually did engage in criminal activity over and over and over. She just didn't get caught and charged by law enforcement. She physically assaulted an animal, her mother and who knows who else that was too chicken to call police. She partook in illegal drugs. She stalked Travis which is against the law. She slashed his tires which is against the law. She stole things such as a gun from her grandparents, which is against the law. She perjured herself over and over. She has a nice long record of criminal activity. That is FACT. Lack of arrest or conviction means absolutely nothing!

I am sorry that anyone feels that the life of Travis just was not bad enough. The fact his throat was slit, and he was stabbed over and over resulting in the absolute slaughter of his body. That is truly heartbreaking to him and his family. Travis just didn't meet the threshold. He just didn't matter enough.
 
We can try to analyze every statement a juror makes. But remember, these people are not always able to clearly articulate their motives, when answering a reporter's question off the cuff.

I'll step out on a limb and state what I believe is the obvious rationale among the lifers, whether or not they are willing or able to clearly articulate it. Despite what some here seem to believe, there is no strong reason to believe that Arias is some psychotic person with a general impulse to kill. She is not a serial thrill-killer, or compulsive child slayer. She is also not someone who killed for money--as in robbing a bank or trying to collect on a life insurance policy on a husband. Prior to this event, she lived an essentially law-abiding ordinary life. She was capable of maintaining longer-term relationships, as with MM and DB, and remains friendly with them to this day. There is reason to believe that her toxic relationship with Travis was unique, and that if she had never met him she would likely have gone on with her ordinary and imperfect life, and never killed anyone. But for whatever reason she went all Fatal Attraction and snapped, even if it happened a week before the killing and it was therefore premeditated.

You can disagree with the above, or some of it, and that's fine. But it is certainly not an unreasonable position for an observer to adopt. And if you do adopt such a viewpoint, a life sentence might seem to be appropriate and just.

The above should not be assumed to reflect my personal viewpoint. I honestly go back and forth between this reasoning, and another line of reasoning which would justify the DP. That's what happens when you have seen all of the trial and almost every other piece of information associated with this case, while trying to keep an open mind. It makes you more humble with the complexity of this unfortunate saga...

You are soo right. Jodi has man hands. She is not the shrinking violet she pretends to be. I completely believe she could overtake Travis once she had him in a vulnerable position.

It seems they are running out of questions to ask the jurors.

Juror No. 1 - Church Lady

She is a white female in her 60s and sits closest to the witness stand. She doesn't look at Arias often during her testimony. People in the gallery observed her yawning once during an emotional part of Arias' testimony.

This lady looks absolutely disgusted the whole time. I never once saw her look in the direction of JA. Not ONCE. She either stares straight forward or looks at JM.

Juror No. 2 - Trump

He is a white male in his 50s. He takes few notes and usually has his head cupped in his hands as he listens to testimony.

I called this guy "Comb Over" he had his head resting on his hand almost the whole time. He also never looks at JA. He seemed to be paying attention, but also seemed bored.

Sorry Juror 2, I know it's your real hair! His voice was strongest on those YES's w/ verdicts. I love him.

Juror No. 3 - Housewife
Was crying when mistrial was announced.

She is a white female in her 40s. She takes a lot of notes and often watches prosecutor Juan Martinez as he moves around the courtroom. She has been seen submitting questions.

Interesting different view today. I called her the "Angry Neighbor Lady" Lol. I wrote that she follows along, but has a constant "sour puss". I don't know if it's just "her look" or what, but she seemed to be frowning every time I looked at her.

She became my foreperson pick after CEO was bumped. Tons of notes, attentive. I didn't really see her as anger as much as very attentive.

Juror No. 4 - Grandpa

He is a white male in his 60s, and he takes few notes.

I also named this man Grandpa. He does have a sweet face and seems the "calm" type.

Juror No. 5 - tri color
Dismissed. Identified herself as 38 year old Meliha Omanovic.

She is a married, white female in her 30s. She sits on the edge of her seat and is the most visible juror from the gallery because she has a “unique hair style.”

This is the only one I remembered Anita's name for because her hair stood out, Lol. She reminded me of my best friend. She probably gave more facial expressions than any of the others. She is very engaged and took a fair amount of notes.

Juror No. 6 - Nancy Reagan
Has identified herself as Diane Schwartz.
Was crying when mistrial was announced. Mouthed "I'm so sorry" to the Alexander family.

Of all the jurors, I'd say she had the hardest time not showing emotions.

He does look like Paul Rudd, but with shorter hair. He's a good looking young man.

I always thought he looked like Adam Levine. The trial did look to wear on him as he looked to me like he lost weight and was drawn toward the end.

I called this guy "The Dad". He looks nothing like my dad, Lol, but for whatever reason... I got a fatherly feel from him.

Juror No. 9 - Willie Nelson

He is a white male in his 60s. He wears denim on most days and sits at the end of the jury box. He sits close to the first row of the gallery where Alexander's family sits.

This guy looked PIZZED the whole time. He seemed to be staring towards the media lady or just into the corner. I only saw him look at JM or JA maybe once.

He has this long white ponytail but dresses kinda like a golfer. He often went in the front door alone or sat outside on a bench. He was a really hard read for me but rarely took notes.

I called this lady "Plain Jane" She was very hard to see from where I was, but I could tell she was taking notes quite a bit.

Attentive, more and more toward the end looked out toward the family. Very serious. Looks professional.

He is a Hispanic male in his late 20s to early 30s. He dresses casually and sometimes slouches so far down in his chair that he is hardly visible to the gallery. He does not appear to be taking notes.

I called him "Paco" He was hard to see too, but mostly because he was slouched down in his seat I thought he'd fall off Lol. At one point he was bent over instead of slouching, but still very hard to see.

Juror No. 12 - Neil

He is a white male in his 40s.

I called this guy "Jim" I wrote "very hard to read".

He concerned me at first, I don't know why. But toward the end I had great confidence in him. His face gets red when strong emotional things discussed.

He is a white male in his late 20s or early 30s. He appears to be the youngest member of the jury and takes very few notes. He smiled when Martinez asked Arias if she could predict the future.

I called this guy "The Jock" He reminded me a little of Oz on American Pie (Chris Klein).

He was extremely attentive in mitigation phase. So much so that I thought he could have been foreperson.

Juror No. 14 - CPA

He is a white male in his early 60s who often swivels in his chair. He does not appear to be taking notes.

I called this guy Sleepy. He swiveled in his chair a lot and fell asleep at least twice. He was also slouched down in his chair.

He is a white male in his late 60s to early 70s. He wears an audio-enhancing headset provided by the court. He does takes notes.

I called him "Captain" He has a very intense gaze. It's hard to describe but he gives off a stubborn and no bs vibe. Maybe ex military or something?

Was crying after mistrial was announced.

She is a white female in her 40s and also takes lots of notes. She swiveled her chair toward Arias during her testimony.

I called her The Secretary. She took a lot of notes and had a "polished" look to her. She had her whole body turned facing Jodi. I barely saw her look at JM. She was the only one that really made me feel nervous at all.

I really want to hear from her. Seemed bonded w/ Ponytail. She asked questions, very attentive. Some said she looks like Jodi's mother. Kinda but not really. Same hair color/length. She always had navel intelligence toward the witnesses.

She is a married, white female in her 30s. She takes a lot of notes. She does not look at Arias during testimony. She tends to look straight ahead or down at her notes.

I called her frumpy lady. Not in a rude way... it's just the word that came to mind. Very plain. She took a lot of notes.

She wore different hairstyles often, long bangs, ponytail, down, up. Often in very high heels, jeans, sparkly tops. Of course now we love her. And I think she's super cute but have seen more pics of her by now.

He is a white male in his 70s and is married. He has a tattoo on his right arm. He rarely is seen taking notes. He sits the furthest away from the witness.

This guy also had a very intense gaze. He took some notes. He rubbed his face and tapped his fingers to his lips a lot. He wasn't the only one doing stuff like that.

His gait was what gave away his age. He walks like he has some pain but of course that's my job to assess things like that.

Thank you so much, this is exactly what I wanted this thread for when I made it. There was a lot of lost people when the jurors started speaking.

I know we are disappointed in the decision but when the Jury speaks it shows the majority did not go with the few and many of them were as disappointing about the ending as we were (if not more) but we can not change the way a person feels or a decision they make. We can only try to understand the reasons of them all.

Thank you for allowing this thread mods and please keep posting links people. Even if it was something posted the day of the decision, lets get as many links of the Jury speaking together as we can.

I had to take a breather and step away. Too much anger inside myself, now I feel I can listen to them all with less anger and more understanding. I am enjoying getting to know these people, most of them seem like very down to earth good hearted people.

These may already be posted, my apologies if they are. They are from the first few days and then I decided to get off the board for a bit but maybe they can be of some help.

Anyone have a favorite yet? No matter what decision they made, just someone you felt you connected with or felt did their job exceptionally well...
So far for me it's Juror #6 Diane Schwartz.

I was really interested in hearing from one of those who was too sick to continue. Paquito Mas, Juror #11 Has he come out and spoken? I can understand if some just want to go on with their lives I just don't know right now who all has spoken.
