An Amber Alert was issued Feb. 19 by the Tennessee Bureau of Investigation, which had been notified the day before that the baby was missing.

But the detail that stunned law enforcement, and would captivate people around the world, was the fact that Evelyn had been missing for two months by the time someone contacted authorities.

And it was Evelyn's own grandfather who contacted children's services in February, saying no one in his family had laid eyes on the baby since Thanksgiving.

The Tennessee Bureau of Investigation issued an AMBER Alert for 15-month-old Evelyn Boswell on February 19, after she was reported missing on February 18. She had not been seen since December 2019.

CBS affiliate WJHL reported that Evelyn’s grandfather, Tommy Boswell Sr., launched the investigation by calling the Department of Children’s Services.

February 20, 2020

On February 20, the Tennessee Bureau of Investigation released another photograph of Evelyn, hoping to reach more people.

February 21, 2020

On February 21, the Tennessee Bureau of Investigation reported that investigators were seeking information about a gray BMW, and that the individuals traveling in it were connected to Evelyn.

Sheriff Jeff Cassidy told the media that his office received conflicting reports about when Evelyn disappeared. He said one report indicated that Evelyn was last seen on December 26. However, Sheriff Cassidy told media that a babysitter claimed to have seen her on December 10 or 11 and those dates were more accurate.

More than one year later, Evelyn Boswell still grips the hearts of people in the community. The baby girl's AMBER Alert ended with police finding her body on family property.

"It was a tragic story," said TB. "It was here in our community and we just hope it never happens again. She was a cute, little baby girl from the pictures. I never met her." Yet, Barnes helped organize a memorial ride last year and decided to do it again Sunday afternoon.

Attorneys are still awaiting analysis of two pieces of forensic evidence from the Tennessee Bureau of Investigation. However, both Boswell’s attorney, Brad Sproles, and state prosecutors would not say exactly what those pieces of evidence are.

Sproles told News Channel 11 that he could possibly still file additional motions at the September hearing.

Sproles said if the case against Boswell goes to trial, he would not expect a trial date before 2022.

Evelyn's Law now in effect, requires parents to report missing child within 24 hours

SULLIVAN COUNTY, Tenn--More than 30 new state laws will go into effect on July 1st in Tennessee, including a first-of-its kind law, that will protect children in honor of baby Evelyn Boswell.

"We definitely needed this law," said Sullivan County Sheriff Jeff Cassidy.

Evelyn's law requires parents to report their child's disappearance within 24 hours of them missing.

It's a tool that Sheriff Cassidy believes could have helped them in their investigation.

"This right here will hold individuals who have disregard for the safety of their children, and hold them accountable," he said.

Evelyn Boswell was reported missing in February 2020, even though she hadn't been seen since December.

"We were behind the eight ball in the entire investigation....not knowing the exact timeline of when Evelyn went missing," said Sheriff Cassidy.

The law was approved in the Tennessee House and Senate, and then signed by Governor Bill Lee.

Brad Sproles, Boswell’s attorney, also announced that he filed two motions on Sept. 29 — one requesting to reduce her bond, which is set at $1 million, and the other asking for the judge to separate her indictments for a possibility of two trials.

“We are asking to sever some of the counts in the indictment from the other counts and provide her with two separate trials,” Sproles said. “There is a specific rule in the Tennessee rules of criminal procedure about severing offenses, and we believe that this case fits that.”

Officials set aside other dates in 2022 — a motion day on April 7 at 1:30 p.m. and a pre-trial motion day on July 28. Judge Goodwin also set a motion deadline and jury questionnaire deadline for March 1, 2022.

Goodwin set the deadline for a negotiated settlement on June 1, 2022. This will give Boswell the opportunity to change her plea. She has pled not guilty to all charges.

Boswell is scheduled to appear in court next for a bond motion on Dec. 3 at 1:30 p.m.

The January appearance will entail Boswell’s attorney’s request to lower her bond, which is set at $1 million. Another request filed on Sept. 29 calls for two separate trials.

Evelyn Boswell's Death and Disappearance Still Shrouded in Mystery 2 Years Later | Inside Edition
It has been two long years since a Tennessee toddler named Evelyn Boswell was reported missing by her grandfather, who told authorities he had not seen the child for months and feared for her safety.

On Feb. 19, 2020, an Amber Alert was issued for the 15-month-old with big blue eyes and blonde hair that was frequently pulled back with a bow. But it was already too late. Days later, her tiny body was found hidden in her grandfather's shed, accompanied by her toys, clothing and diapers.

Because the case is now filed under seal, law enforcement and trial participants are prohibited from discussing evidence that has been submitted to the court.

But there are thousands of photos and documents connected with the case, according to court proceedings. Prosecutors have said they've turned over 87,000 images, 57 hours of video footage, 18 hours of audio footage, 28,000 text messages, and more than 24,000 pages of social media to the defense.

The trial judge is expected to rule in April on the defense's motion for a change of venue.

In response, Sproles filed a motion to preserve the defendant’s objections to the state’s evidence.

“The images of where the child’s body was recovered and the images of the child’s autopsy are heartbreaking,” Sproles said. “Our position is that any person who sees those images is going to have an emotional response and we don’t want that emotional response to influence their judgment and their logical thinking about the evidence presented in the case.”

Along with thousands of images, the massive amount of discovery includes videos, audio files, text messages, and social media.

“There are thousands of images here involving this case some of which are very graphic, very disturbing and my thinking is the state will want to present as much of those as they can and we want to limit the amount of those images the state can show to the jury,” Sproles said.
