Wednesday, February 12th:
*Trial continues (Day 7) (@ 9am ET) - TN – Evelyn Mae Boswell (15 mos. DOB 11/21/18) (last seen Dec. 10 or 11, 2019 by babysitter, Blountville, Sullivan County, reported missing Feb. 18, 2020 by State of Tenn. Dept. Child Services; Evelyn’s remains were found on Mar. 6, 2020 at a family member’s property at the 500 block of Muddy Creek Road in Sullivan County; officially id’d Mar. 11, 2020). *Megan “Maggie” Boswell (18/now 23) aka Maggie Wood aka Megan Nicole Kys “mother” arrested & originally charged (2/25/20) with 1 count of false reporting. Bond set at $25K. Bond increased (3/9/20) to $150K. [see below for re-charges].
Indicted (5/18/20) & originally charged (5/28/20) with 11 counts of false reporting. Plead not guilty. Bond stays set at $150K. [see below re re-charges].
Re-Charged & indicted (8/19/20) & arraigned (8/28/20) with 3 counts of 1st degree felony murder, 2 counts of aggravated child abuse & neglect, 1 count of tampering with evidence, 12 counts of false reporting [1 count was dismissed on 2/5/25], 1 count of abuse of a corpse & 1 count of failure to report a death suspicious, unusual, or unnatural circumstances. Plead not guilty. $1M bond. Bond reduction denied (12/3/21).
*Charged & arraigned (6/20/24) with 1 count of 1st degree felony murder-premeditated/intentional. Plead not guilty. DA is seeking a life sentence without parole. Sullivan County
Jury Selection began on 2/3/25 & ended on 2/4/25. 12 jurors (8 men & 6 women). Jurors are sequestered.
Trial began on 2/5/25. Court will be in session on Saturdays & President’s Day. Saturday hours 10:30am to 4pm.
Judge James F. Goodwin presiding. Sullivan County Deputy DA William Harper, Prosecutor Amber Massengill & William Harper. Defense attorneys Gene G. Scott, Jr. & C. Brad Sproles.

2/11/25 Tuesday, Trial Day 6: *State witnesses: Christopher Wilhoit, Assistant Special Agent in charge of Criminal Investigations with TBI, employed there since 2001. He assisted the SCSO in the investigation. He spoke with Boswell 2/23/20 after she was interviewed & sat in the lobby of the Sheriff's office. Recorded in writing & audio. Played for jury. FBI Special Agent Paul Durant, employed with the FBI for about 5 & a half years. He's primarily assigned to investigate crimes against children. Digital phone analysis expert. Part of his role was reviewing interviews, notes, digital devices & other documentation to assist in finding Evelyn. Defense wants to quash the cellphone records. Judge Goodwin ruled that Durant would be considered an expert in digital forensics analysis. [Durant extracted information from two cell phones & executed social media search warrant proceeds from Boswell’s Instagram & Facebook accounts]. He read Boswell’s messages.
*Judge Goodwin sent the jury from the courtroom before Durant’s testimony continued. Scott objected to the submission of some evidence the state hoped to present in Durant’s testimony. Massengill argued against him & provided Goodwin with a legal precedent. Judge Goodwin noted that Scott was correct in some respects but ultimately overruled his objection.
*State witnesses continued: Marla Gray, special agent assigned to analysis with the TBI crime lab in Knoxville. An expert in serology (examination of blood serums) & forensic analysis. David Hoover, special agent forensics scientist in the latent print division at the TBI’s Nashville crime lab. An expert witness in the field of latent print identification. Dr. Matrina Schmidt, a forensic pathologist. Dr. Schmidt is an associate medical examiner in Florida. Forensic pathologist Dr. Darinka Mileusnic-Polchan. She is the chief medical examiner in multiple East Tennessee counties.
Trial continues on Wednesday, 2/12/25.

Defense attorneys and prosecutors projected the arguments to come during their opening statements Feb. 5 at the Sullivan County trial, which is expected to last three weeks.

Forensic Patholigist Dr. Matrina Schmidt testified that Baby Evelyn’s body was found with leaves in her hair and her head wrapped in tin foil.

There were also leaves laying around in the play house. Did mb wrap EB up in the play house? Did she bring EB to the play house alive? Guess that's something I will have to wonder about....

The defense motions for acquittal.

Regarding murder, no evidence of premeditation and the ME's couldn't provide a specific cause of death.

No evidence of child abuse, witnesses testified the opposite - that there were never any signs of abuse.

Prosecution state that premeditation is shown through the physical evidence, ie: Evelyn being wrapped and stuffed in a trash can, along with the aluminum foil around her head.

Judge denies the motion with regard to all counts.

Defense says the defendant will not testify.

Megan is sworn in and her attorney asks her questions about her decision not to testify. Megan confirms that she does not want to testify.

Jury is instructed not to consider this statement by the ME yesterday:

Dr. Mileusnic-Polchan said, “She could have been murdered a different way.”

The judge said it is out of the scope of her expertise.

The court is in recess to prepare the charges for the jury and give both sides time to prepare for closing arguments.

Boswell’s attorney, Gene Scott, made a motion for acquittal of charges and went through the charges for Judge Jim Goodwin.

Goodwin was required to address each of the charges that Scott asked for acquittal of as he made his ruling. He said that the way in which Evelyn was found (upside down in a trash can), Boswell’s behavior on social media, the volumes of evidence, Boswell’s different stories about what happened, the professional opinions of the two expert medical examiners were all contributing factors in his decision.

Goodwin ruled that it was for the jury to make a verdict on all of the counts. He denied Scott’s motion for acquittal.

Judge will read the instructions ( later). Then, each side will give their closing argument....today. Will the jury start deliberations today? ( This evening ) Or, will he instruct them tomorrow in court?
