Yes @altojack -- the States typically revert to standard time about a week prior to UK time change. (Always had to remind dad when I was at Univ so he wouldn't phone as usual on Sunday morning and wake my housemates)! :)

Sorry for late thank you! Nothing worse than getting a call on that first Sunday morning when the caller hadn't changed their clocks. I remember it well.

I didn't get to see today's court sitting but will catch it tomorrow morning. Not too early.

Wednesday is the deadline for a negotiated settlement in the trial of Megan Boswell, the Sullivan County woman accused of killing her 15-month-old daughter Evelyn Boswell.

Boswell faces 19 charges, including two counts of felony murder.

While she is not expected to appear in court Wednesday, the negotiated settlement deadline gives Boswell the opportunity to change her plea. She has pleaded not guilty to all charges.

Attorneys meet before Megan Boswell motions hearing Monday

Megan Boswell’s defense attorney Thursday met with the district attorney as well as the judge in the case to discuss the agenda for her court appearance on Monday.

“On Monday, after consulting with the district attorney and judge in the case, we’ve determined that we are only going to hear a motion to continue the trial. It’s going to be based on my – the defense’s – need for expert testimony that we have to procure based on evidence that was recently provided to us by the state,” defense attorney Brad Sproles told News Channel 11.

According to District Attorney General Barry Staubus, that will be the only topic of discussion Monday following the several-hour-long meeting Thursday morning.

“On Monday, we – the state doesn’t intend to file any motions or hear any motions, but I expect that we will hear some at a later date. After talking to counsel for the defense, my understanding is they’re going to file a motion to ask to have an expert to review some of the findings from our fingerprint evidence from the TBI,” Staubus said.

Boswell is currently scheduled to stand trial on September 26, but that date and the venue could possibly change.

“We filed the routine motions in that we’ve asked for what’s called reciprocal discovery,” Staubus said. “The defense asked for information from us. We ask them to reciprocate, provide whatever state law provides that they have to and we will. We filed a motion regarding the introduction of photographs at trial that will be heard at a later date. And those are the outstanding motions we have, and we also have the motion to change by the defense to change venue of renown. That hasn’t been heard, that’s premature, he’ll wait closer to trial to have that motion heard.”

District attorney Barry Staubus told News 5 he anticipates the defendant will file a motion to retain an expert to review the results of the TBI latent print examination reports.

Her attorney has already asked for severance, meaning he wants her false reporting charges to go to trial separately from her murder and child abuse charges. The state argues they should be all tried together.

Monday's court appearance is set for 9 a.m. We plan to stream the hearing here on our website and on our Facebook page.

3/16/22 Update: The prosecution has filed a motion to allow photos of the remains of baby Evelyn to be admitted in the upcoming trial. In response, defense attorney Sproles filed a motion to preserve the defendant’s objections to the state’s evidence. “The images of where the child’s body was recovered & the images of the child’s autopsy are heartbreaking,” Sproles said. “Our position is that any person who sees those images is going to have an emotional response & we don’t want that emotional response to influence their judgment & their logical thinking about the evidence presented in the case.” Next motions hearing on 4/7/22 re change of venue due to all the publicity & a motions hearing on 6/24/22 & 7/28/22.
4/7/22 Update: Boswell appeared in court for a motions hearing Thursday. The two major items discussed were the questionnaire that will be presented to a jury pool for the upcoming trial & a motion to split Boswell’s charges into two separate trials. Tennessee Bureau of Investigations Special Agent David Gratz testified in court that Boswell told him Evelyn died after her boyfriend rolled over onto the child while they were sleeping. Gratz also testified about previously unreleased information that Evelyn's body was discovered in an old playhouse that was originally built for Boswell to play in when she was a child. The TBI continues to wait on test results from evidence collected at the scene. Gratz revealed that the TBI collected nearly a terabyte of digital evidence surrounding the case, including texts & direct messages. Boswell is scheduled for a mental evaluation. Next hearing 6/24/22. Defense attorney Brad Sproles wants severance for false reporting charges, which would mean separate trials for the more serious charges, including murder. The prosecution called a special agent with the Tennessee Bureau of Investigation to the stand to discuss the false reporting charges. No rulings on any motions were made Thursday. Boswell's next court appearance was set for a motions hearing on 6/24/22. There is also a motions hearing scheduled for 7/28/22.

Defense atty said the last TBI report they received in discovery requires them to hire their own expert which is the main reason they need to extend the trial date. The judge asked about the testing and defense attorney said it's concerning fingerprint evidence.

The sound is really bad but sounds like trial has been moved to Feb 6 @ 8:30 a.m. Motions hearing Sept 23 and I believe another one on Sept 16. Super hard to hear! :(

Megan Boswell appeared in Sullivan County General Sessions Court at 9 a.m., where her legal counsel, Brad Sproles, requested the trial get pushed back to February as fingerprints have been found on a “crucial” piece of evidence.

The nature of the evidence was not revealed.

Judge Jim Goodwin reset the trial, originally scheduled for Sept. 26, to take place on Feb. 6, 2023.

Judge acknowledged that if he forced the trial in September, and if MB was subsequently convicted, they’d just have to retry. He also said that TBI has taken “months and months and months” to get lab results back. Motion hearing 6/24 is cancelled. Need motion for photographs? Any new motions besides fingerprint motion must be filed no later than 9/6/22.

Next motions hearing 9/23/22 @1:30 pm
Change of venire scheduled for 12/16/22 @1:30 pm

Here we go! The last time I recall a defense asking for a trial delay for their own expert to examine evidence, translated to another 15+ months delay when the defense was required to go to the supreme court, arguing for the state to pay for the defendant's expert and investigator! o_O

Sproles told News Channel 11 that he believes the large amount of coverage surrounding the murder case will move the trial outside the area.

“I feel like that it ultimately will be changed,” he said. “I think the judge will make us jump through some hoops to try to get a jury seated here in Sullivan County, but my opinion is there’s just been so much coverage…it’s going to be hard.”

He also touched based on picture evidence provided to the defense by the state.

“…There are over half of them that I do object to, so we’re going to have to ask the judge to determine whether the prejudicial effect of those pictures outweighs their probative value,” Sproles said.

Brad Sproles, attorney for Megan Boswell, had requested the trial be pushed back due to fingerprints being found. He said this was considered a "crucial" piece of evidence, but did not share where the prints were located.

"There was a fingerprint analysis that was just provided to us about a month ago, it's very important, and it has affected the way we will present our defense."

Second District Attorney Barry Staubus was in agreement the lab results on the print needed more time.

"Because of the length we anticipate this case to be, we would not want to have to try this case again. I think the defense had a legitimate request to have that piece of evidence analyzed by an expert."

Sullivan County Judge James Goodwin rescheduled the trial from Sept. 26 to Feb. 6 after a motion by Boswell's defense attorney cited "months and months and months" of delay in receiving test results from the state crime lab.

In the two-plus years since Megan Boswell's arrest, Sproles has sought to separate the charge of filing false reports from the murder trial, in effect having a separate trial for those charges. Boswell is scheduled to be back in court in September for the hearing on separating her charges.

Sproles also has asked to change the location of the trial. That hearing is scheduled for mid-December.
