Jury is being sent to the hotel for the evening in TN v. Megan Boswell. The state may have opened the door to the defense bringing out in front of the jury that the defendant said her boyfriend rolled over on Evelyn and killed her. Judge has to review the TWO-HOUR interview in chambers.

2:06 p.m. update- Court is still in recess, the jury has not been brought back in. The defense wants to cross-examine agent Fraley about a statement Megan made to him that he brought up.

Prosecutors argued saying that information was not something submitted in evidence. Goodwin says the court is taking time to review the law to see if the request is legit.

More than two years later, a special agent revealed during a court hearing that Boswell had told police that she knew the child was dead more than a week before the toddler’s body was found.

On Feb. 25, the narrative changed, according to Gratz.
Evelyn was dead, Boswell allegedly told authorities.
“This was when [Boswell] did say she was aware that Evelyn was dead; however, she told the story that it was resulted from either her or [her boyfriend] rolling over the child while sleeping, but she did not know the location of Evelyn’s body,” Gratz said.

Seems the parties working double time now to both move trial forward and also appropriately preserve the defendants appeal rights. IMO, I think the defense interpretation that this was a "confession" by MB an overreach at best but I've seen worse. Better for the Court to get this challenge out of the way early...

Still wondering why prosecution waited until today to dismiss this charge??

Question? I have not seen who the defense attorney was that gave opening statements. Was it Gene Scott? TIA! :)

She said she knew EB was dead. Rolled over in bed by mb or her boyfriend but didn't know where EB's body was. Obviously nonsense and just another of mb's lies. If she knew EB was dead why wouldn't she know where the body was. I'm sick of this person and the trial is barely under way........

When the court convened on Wednesday around 8:45 a.m., prosecutors began by stating they needed to dismiss Count 18 against Boswell, one of the many counts of false reports against her. Judge Jim Goodwin dismissed the charge.

The prosecution then asked that the defense not present any evidence on that count since it would be hearsay without Boswell’s testimony.

According to the presentment of charges against Boswell, Count 18 alleged that Boswell made a false report to Sullivan County detectives and a Tennessee Bureau of Investigation by claiming either she or another person rolled over onto Evelyn while sleeping, resulting in her death.

At trial, Boswell is facing 19 charges, including:

  • First-degree murder
  • 2 counts of felony murder
  • Aggravated child abuse
  • Aggravated child neglect
  • Tampering with evidence
  • 11 counts of false report
  • Abuse of a corpse
  • Failure to report a death under suspicious, unusual or unnatural circumstances
The presentment alleges that one of Boswell’s felony murder charges stems from her killing of Evelyn “in the perpetration of or attempt to perpetrate the felony crime Aggravated Child Abuse,” while the other was allegedly done in the perpetration or attempt of aggravated child neglect.

Confirming it was Gene Scott at the podium delivering the opening for the defense.

Boswell’s attorney Gene Scott then took to the podium but was interrupted when Goodwin asked everyone to please stand and called a photographer whose flash went off forward. He said if he saw the flash again, the photographer would be held in jail for 10 days.

just a thought, but could the missing "material witness" that just showed up have something to do with this. Guess time will tell.

During jury selection on Tuesday, Boswell’s attorney, Gene Scott told jurors that they had “one chance” to get it right for Boswell.

“I submit to you that Megan Boswell has already had her chance,” Massengill said. “She was gifted with a beautiful child. A healthy, vibrant little girl. Evelyn was perfect. Megan Boswell already had her chance. Today is Evelyn’s chance. Today is our chance to get it right, not Megan’s.”

I've not seen any MSM identify this party nor did I hear the prosecution or the Court identify the party when discussing the subject material witness bond that would be issued for no-show (served Jan 13) and also confirming a subpoena was in fact issued.

Judge recounted a situation he personally experienced where a witness twice started crying when police showed up with a warrant and said she never received a subpoena -- and after checking the file, it was true!

Per the prosecution, witness was suppose to contact the State or appear on Monday, Feb 3, and did neither. Court ordered Deputies to produce the witness before the court.

ETA: I'll try to listen to the usual Trial Day 1 analysis this eve and see if any hosts picked up on the material witness. MOO

They said the last time Evelyn was seen alive was shortly after her first birthday and that several months passed without anyone seeing her.

The continued by saying Megan put Evelyn’s body in a kitchen trash can before hiding it in her own childhood playhouse on her family’s property. They added that Boswell spent months lying about where her daughter was while building a new life

The best I could get on the the State's material witness was his name -- "Austin Feller" but nobody seems to know the who/what about him!

The Court has ordered him to be present everyday M-Sat at 9AM until dismissed as a witness or his $500 bond will be revoked and he will be held in the Sullivan County Jail.

Relative to the dismissed charge #18 for MB false statement citing MB and/or the bf rolling over EB while they were sleeping, I recall this person was named Hunter Wood and not AF so I don't see AF connected to Charge 18 dismissed on Wednesday.

Also, Wood stated he only dated EB for a few weeks in December and never saw EB because she was supposedly staying with her father who was home on leave for Christmas during the time they were dating. I think this would eliminate HW from rolling over EB in bed. IMO, MB had already sacrificed her child to have a boyfriend with his own 'Chicken Shack.'

Please ref. live trial video of 2/5/25 at about the 3:15:00 hour mark (outside of the presence of the Jurors at break for lunch) for info on Austin Feller and his bond.

What is defense attorney Scott trying to say here? What does he want Jurors to get right for MB, the mother who wrapped her child's head in aluminum foil, a blanket, a garbage bag, and dumped her little body head first in a rubbish bin? This statement by the defense just makes my blood boil! :eek:

DOB 11/21/18) (last seen Dec. 10 or 11, 2019 by babysitter, Blountville, Sullivan County, reported missing Feb. 18, 2020 by State of Tenn. Dept. Child Services; Evelyn’s remains were found on Mar. 6, 2020 at a family member’s property at the 500 block of Muddy Creek Road in Sullivan County; officially id’d Mar. 11, 2020). *Megan “Maggie” Boswell (18/now 23) aka Maggie Wood aka Megan Nicole Kys “mother” arrested & originally charged (2/25/20) with 1 count of false reporting. 2/5/25 Wednesday, Trial Day 1: *The State has dropped one of the false reports charges [Count 18 alleged that Boswell made a false report to Sullivan County detectives & a Tennessee Bureau of Investigation by claiming either she or another person rolled over onto Evelyn while sleeping, resulting in her death]. Judge Goodwin dismissed the charge. Judge saw a light flash from some dummy that took a photo. He had to clear the jury out for a recess while he gave the person a dressing down.

*State witness:
TBI Agent Brian Fraley. [Crime scene photos being entered into evidence. First photo is of the playhouse with door closed. Next is with door open, shows the trash can where Evelyn’s body was found. Garbage is packed in the playhouse, stacked high, maybe 5 feet in some areas. Some items appear to have been there for a while].
Trial continues on Thursday, 2/6/25.

OK, another thought about the reluctant, material state witness, Austin Feller, Johnson City, TN.

We learned during opening statements on Weds that MB lied to the soldier, EP --that he was Evelyn's father.

I'm going to take a wild guess that AF may have been the father of baby Evelyn.

And this is just a hypothetical consideration, but I have a feeling that if AF had a daughter today, she might easily pass as Evelyn's sister. JMO...
