Wednesday July 29 - Chattanoogan - Hearing Set on Injunction Sought by Siblings of Gail Palmgren

The siblings are asking the chancellor to order that Ms. Palmgren's husband, Matt Palmgren, not be allowed to move the couple's two children out of state.

The court filing asks that the children, who are ages nine and 12, not be moved more than 100 miles from their home in the St. Ives subdivision.

It is also requested that a guardian be named for the children and that the husband not make any "disparaging remarks" about Ms. Palmgren to the children.

WRCB: Judge Moves Up Hearing on Palmgren Restraining Order

A Chancery Court secretary tells Eyewitness News that a Chancery Court judge will hold a hearing on the restraining order requested against Matthew Palmgren by the siblings of Gail Palmgren.

The hearing is scheduled for 1:30 p.m. Wednesday, at the request of Matthew Palmgren.

The siblings of Gail Palmgren had planned to attend a hearing originally scheduled for July 11, but both are currently out of town.

WRCB: Police request evidence two months into missing woman case

According to Durham, Matthew Palmgren installed a high tech security system at the lake house in Wetumpka, Alabama last spring.

Durham claims Gail Palmgren took the hard drive from to the system to a Best Buy store to try to retrieve erased data showing an argument between the couple. She planned to use it as evidence in their divorce. Durham was instructed to pick the hard drive up the same weekend Gail Palmgren was last seen.

"She told me not to give it to anyone but her," said Durham, recalling a conversation with Gail the day before she went missing.

Durham says she notified investigators of the content on the hard drive days after Gail Palmgren went missing, but they did not take an interest in it. Now they want her to turn it over, nearly two months later.

July 11 Hearing Canceled; Case Transferred To Chancellor Atherton

Chancellor Brown said any further proceedings in the case would be heard by Chancellor Jeff Atherton, who was assigned the matter in which Mr. Palmgren sought a legal separation from his wife. That case was later withdrawn.

Chancellor Brown canceled a hearing that had been set for July 11 on the petition by Kevin Nowacki and Diane Nowacki Nichols.

. . . The petition said Ms. Palmgren just prior to her disappearance on April 30 left some jewelry with friends and the jewelry, it is believed, has been given to Mr. Palmgren. It asks for an accounting of a collection of rare coins Ms. Palmgren had gotten from her father and grandfather. Attorney Davis said the coins had been missing, but were found in a safety deposit box.

With Video - Short Phone Interview with Diane Nowacki Nichols

Chancellor Frank Brown says the legal guidelines weren't met by the attorneys representing Diane Nowacki Nichols and Kevin Nowacki.

Chancellor Brown added "This is not a divorce case."

Because the issues brought up in the case are similar to a legal separation Matthew Palmgren had previously filed, Chancellor Brown says another judge will have to hear future motions on the case.

Channel 9 WTVC: Group: Search for Missing Mother Losing Steam

Saturday, her community released balloons at the Signal Point National Park. They also sang and prayed for the missing mother of two's safe return.

Clive Bonnick planned the gathering. It's not the first one he's spearheaded. But Saturday, he used balloons to spread information. About 20 people attached messages of hope to each balloon before letting them go. Each note included a humble plea for help and information leading to Palmgren.

But Bonnick says amid that hope is deep worry. "I'm horribly afraid that something is wrong and she's not going to come home"...

Chatt Times Free Press: TBI Reviewing Case

The Tennessee Bureau of Investigation is reviewing the case of a missing Signal Mountain woman at the request of the Hamilton County District Attorney’s Office.

Gail Palmgren, 44, of Signal Mountain, has not been seen since April 30. Her sister, Diane Nichols of New York, contacted the district attorney’s office, asking for a review.

“We have been asked to take a look at the case and see if we have any suggestions,” said TBI Special Agent in Charge Jerri Powell in Nashville.

The Hamilton County Sheriff’s Office still is leading the investigation into Palmgren’s disappearance.

Times Free Press July 7: Sheriffs Investigators Complete Last Three Local Searches

About Julanne Palmgren's Apartment:
The search was similar to one conducted at the Palmgrens’ home in St. Ives subdivision at 40 Ridgerock Drive on June 23. In that search, investigators used an alternate light source looking for body fluids, photographed the area and conducted a general search.
Investigators also previously searched a storage unit in Red Bank. They have yet to search the couple’s two properties in Alabama.

Times Free Press July 8: Missing Palmgren computers turned over to defense attorney
Davis said in an interview Thursday that the computer hard drives have been sent to technicians to see if any files or history can be recovered that might lead to Gail Palmgren.
“We’ve sent them off to see what’s on them,” he said. “Obviously, if files have been deleted, they’ve been deleted.”

Times Free Press July 10: Two Months Missing, No Foul Play
Quote from Wesley Oliver, an associate law professor at Widener University
However, Oliver pointed out that, in this case, Gail Palmgren’s husband, Matt, most likely holds the most information about his wife that could lead to authorities locating her, and a search warrant might not be the right tack to take at this point.
“Until it’s clear he’s not going to cooperate, the husband is the best ally in finding this missing woman,” Oliver said. “As long as possible, they don’t want an adversarial edge. A search warrant says, ‘We’re suspicious of you.’ They want to avoid that as long as possible.”

Statement of Janice Atkinson of Hamilton County Sheriffs Office
"If it is a criminal case it's going to end up in court one day," said Atkinson, "and you don't want anything you do or say to come back and impact the outcome of the case."
Statement from Attorney Brian Hoss:
"From day one, we have provided both the Signal Mountain Police and the Hamilton County Sheriff's Department with physical evidence, investigative leads, financial information, personal information, DNA samples, access to all of Palmgren's real property and face to face meetings with his investigator, Mike Mathis. As his attorneys, both Lee (Davis) and I have met with law enforcement and been in constant contact with them throughout this process. We will continue to assist and cooperate in the missing person investigation of Gail Palmgren."

Chatt. Times Free Press: FBI Will Assist in Palmgren Case

The FBI is not taking a lead role in the investigation, Galloway said, but is offering technical support and letting local authorities access its lab to process any evidence collected in the case.

"We'll help in any way we can and lend any assets," he said.

The federal agency also is reviewing the case along with Tennessee Bureau of Investigation, which came onboard earlier this month.
