Joseph Daniels hearing day 2: Says wife Krystal killed Joe Clyde

The second day of the hearing for Daniels in Dickson County Circuit Court concluded almost exactly three years after Joe Clyde was first announced as missing in Dickson County. A few days later the case evolved into a murder investigation and search for Joe Clyde’s body. In a confession that Daniels has since recanted and insisted was coerced, he told authorities that he struck Joe Clyde, often referred to as “Baby Joe,” with a closed fist until his son was dead on April 4, 2018 at their residence on Garners Creek Road.

During questioning at the hearing Tuesday, Daniels’ attorney, public defender Jake Lockert, asked Tennessee Bureau of Investigation agent Joey Boyd if investigators "were able to find blood belonging to Joe Clyde Daniels anywhere in that residence."

Boyd replied: "Not to my knowledge."

Boyd also stated that investigators were not able to find Joe Clyde’s blood in Daniels’ vehicle.

In a July 1, 2019 recorded conversation, Joseph Daniels talked with his father, Joe Clyde Daniels, Jr. on the phone while in jail. That conversation was played in court.

Daniels also said authorities were not going to find Joe Clyde’s body in Dickson County but rather in Hickman County. He said he didn’t know the exact location.

At the conclusion of the hearing, Dickson County Circuit Judge David Wolfe denied the Lockert’s request for a bond reduction for various reasons including that Joseph Daniels has "confessed to killing this child on three different occasions” and that the trial is scheduled to start in less than two months on June 1.

Joseph Daniels’ father, Joe Clyde Daniels Jr., also took the witness stand. During that time, the state played an audio recording of a phone call between Joseph and his father while Joseph was in jail. During that call Joseph told his father Krystal Daniels, Joe Clyde Daniels’ mother, killed their son with a pillow. He said she then threatened to kill Joseph if he told anyone about the truth.

The next motions hearing will be on May 12. The trial for Joseph Daniels will start on June 1.

During hearing last week, a judge granted two separate trials for Joe Clyde’s parents, Joseph and Krystal Daniels.

Dickson County Circuit Court Clerk Office’s confirmed on Friday that the gag order had been put back on the case over the murder of 5-year-old Joe Clyde. That means attorneys cannot talk publicly about the case outside of the courtroom.

Wednesday, May 12th:
*Motions Hearing for both (@ am ET) – TN – Joseph “Joe Clyde” Daniels III (5) (April 3, 2018, Dickson) – *Joseph Ray Daniels (28/now 31) “father” arrested & charged (4/7/18) & indicted (6/8/18) with 1 count of 1st degree murder, felony murder, aggravated child abuse, filing a false report & tampering with evidence. $1M bond.
Confessed on 4/6/18. Waived rights to Prelim hearing. Joseph Daniels told officers that he beat his son to death after his son urinated on the floor. But recanted his confession saying he was coerced.
Trial set to begin on 6/1/21 for Joseph only. Jury will be sequestered during trial. Will be picked not from Dickson County.

*Krystal Nicole Daniels (27/now 30) “mom” arrested & charged (4/8/18) & indicted (6/8/18) with criminal responsibility aggravated child neglect & filing a false report. Charged (5/26/20) with criminal responsibility aggravated child neglect, accessory after the fact & making false reports to officers. $1M bond.
Trial will be set after Joseph’s trial ends.

4/1/21 Update: Krystal was present via Zoom. Joseph in courtroom. Several motions were heard during Thursday's hearing in the Joe Clyde case. New revelations & never-before-seen video are expected to be part of the hearings. Circuit Court Judge David D. Wolfe also lifted the gag order in the case, meaning attorneys may now comment publicly about the case. Other motions challenging evidence, including the father's confession, will also likely be heard during the hearing. They will be back in court to continue the motions hearing on April 6th. They are still hearing the motion on the confession and have several other motions to hear. One of the motions will be the motion for Krystals bond reduction. The trials have been severed. They also will be bringing in a jury from outside the area for Joseph Daniels's trial which starts on 6/1/21 & Krystal’s will be set at a later date.
4/6/21 Update: Joseph's case will be heard by a sequestered jury brought in from outside Dickson County. No damaging statements from Joseph’s wife Krystal can be used against him at trial. She is also charged with child neglect & had told the TBI she saw her husband beating the boy the night he disappeared. A recorded phone call from Riverbend Prison was played in open court where Joseph tells his father Big Joe that Krystal smothered Joe Clyde to death with a pillow & then she threatened to kill him if he told anyone. The prosecution says Joseph confessed several times (3 times) & is steadfast in prosecuting him & not his wife for murder. No lie detector tests will be admitted-he failed them. Joseph’s attorney got the TBI to admit no physical evidence was found of a murder in the home... no blood. Nothing. Not even any DNA from Joe Clyde. But District Attorney Ray Crouch says no evidence was found in the home because Joseph scrubbed the place clean before calling police to report his son missing. Joseph’s attorney asked the judge to lower his one million dollar bond. Bond request denied. Next motions hearing on 5/12/21. Judge Wolfe at the hearing next month will consider whether or not the confession will be allowed to be used as evidence in the trial. He's expected to issue a written ruling on the matter.
5/6/21: New development: just weeks before trial is set to begin, a crucial new witness has surfaced. She will be under subpoena & her testimony will raise new questions about what happened to the missing little boy. This lead appears to have been buried under the reams of evidence collected in the case. Scenario: "We find a lady whose child, within a day or two, came in to say there is a little boy out front in dirty pajamas," said Jake Lockert, defense attorney. Could this be a second witness to see the child in the hours after he disappeared? Lockert only recently found the report filed with the Humphreys County sheriff three years ago. A woman called to say her 5-year-old daughter was outside the day or two after Joe Clyde disappeared & encountered a small boy. The little girl said she spoke with the boy & only later mentioned his odd responses to her mother. "She asked him what his name was & he said five," said Lockert. "Those aren't logical responses, but you essentially have an autistic child who is nonverbal." Joe Clyde's grandfather said the boy often referred to himself as five, his age, instead of using his name. 5/7/21 Update: Judge re-instates gag order.

MORE LEGAL WRANGLING BEFORE THE JOE CLYDE DANIELS TRIAL.
The first of several days of new motions hearings in the case against Joseph Daniels got underway today.
The hearings could run through the end of the week.
Joseph Daniels is charged in the death of his missing son, Joe Clyde, who disappeared from his Dickson County, Tennessee home on April 4, 2018.
Daniels initially confessed to killing the boy, but later recanted that confession.
His attorney, Jake Lockert, says he was coerced.
The confession is at the heart of these legal arguments.
Lockert says not only was the confession coerced ... but there is no evidence to support the confession.
No body, no blood, no eyewitnesses — there is no proof Joe Clyde is even dead.
A confession alone is not enough.
There must be some evidence supporting it as true.
The prosecution will argue the confession was not coerced.
But beyond that I don’t know what they have to back it up.
Either way, I highly doubt the judge will rule to exclude the confession.
My guess is he will leave it to the jury at trial to decide if it is legitimate or not.
Most of the other motions being heard this week will determine whether or not certain witness/expert testimony will be allowed at trial.
The trial is set to begin the first week in June.
A jury will be brought in from elsewhere — my guess is either Chattanooga or Knoxville.

5/12/21 Update: No info yet from hearing which continues on 5/13/21. Motions hearings will probably last all week.

On Friday, the gag order in the case was reinstated just weeks before the high-profile trial is scheduled to begin.

Judge Wolfe lifted the gag order back in April during a motions hearing. During that same hearing, prosecutors and defense attorneys agreed to sever the cases of Joseph and Krystal Daniels into two trials. Joseph Daniels is set to stand trial first on June 1.

She says her daughter had asked the boy's name and that he responded "5" – something defense attorneys claim to be significant given Baby Joe had autism. Baby Joe's grandfather previously said that his grandson sometimes responded with his age when asked his name.

Judge rules two pieces of evidence will not be admitted in Joe Clyde Daniels trial

Those pieces of evidence include a police report filed by a woman who said her daughter talked with a boy some people believe to be Joe Clyde before he went missing. The other piece of evidence is a transcript interview with a neighbor, Matthew Ledford, who may have also seen Joe Clyde while in his driveway.

I'm roughly almost 100 miles from here. Where are you located? Did you see these headlines? Were you aware they were searching for this baby for 4 days?!!
So this woman never, ever called LE back and said Hey, have you turned on the news?? Can you at least come check it out and maybe put a couple cars in the area?
Is Lockert grasping? Or is LE slacking? Thats what its getting down to.

Friday marked the last day of motions hearing before the Joe Clyde Daniels trial, which will start June 1.

A cell phone data expert also testified on Friday whether Joseph Daniels’ phone moved the night Baby Joe went missing. Judge Wolf ruled that data and other Google data will be allowed in trial.
