New trial date set for Tyler Enix murder case - July

The state revealed Friday morning it wants life without parole for a Knoxville man charged with the first-degree murder of his wife at her Fountain City Home.

The defense for Tyler Enix asked for more time based on the complexity of the case.

A judge set a new trial date for Feb. 6, 2017.

Memorial yard sale raises money for Kimberly Enix

In October 2015, Kimberly Enix was murdered. One year later, her friends and family are still trying to give her a proper burial.

Kimberly’s grave doesn’t have a headstone. To help raise money for one, they held a memorial garage sale on Saturday. Their goal was $2,000.

With the help from friends, family and strangers that goal was reached.

Judge to decide whether toddler who witnessed mom's death can take stand

In a hearing Thursday, an attorney for the grandparents, who now have custody, asked Judge Steve Sword to shield the girl from taking the stand.

"This child has some recollection of the events but not necessarily subject to questioning or available without interpretation (by her therapist)," said Michael DeBusk, a Knoxville attorney representing the grandparents. "More importantly is that this child could suffer traumatic setbacks in terms of therapy and PTSD if she is called as a witness and simply being called to court."

Assistant District Attorney Kevin Allen said the girl had made comments days after the murder in her interviews with investigators that "daddy made mommy fall down and mommy threw up," that the "throw up was red," that "mommy made a mess and the mess got on me" and that "daddy pushed her down."

Knox County Public Defender Mark Stephens, who is representing Enix, argued that the girl should not be allowed to take the stand. The quotes related by the prosecution was not a cohesive narrative, but rather the answers to "highly leading and suggestive questions" over an "extended period of time."

Judge Steve Sword said he would listen to the interview tapes with the girl and issue a ruling Friday.

Which set of grandparents have custody of the little girl? Is it the paternal side or the maternal side? If its the maternal side or the deceased's parents, then both sides don't want the child to testify.

Its confusing.

Update - she won't have to testify.

He also ruled*the state could not use incest-oriented pornographic websites found by the FBI on Tyler Enix's phone, much of it involving fathers and daughters.*

Ugh, just ugh.

Knox County Public Defender Mark Stephens acknowledged the*evidence places Enix at the scene, and because of that, he indicated the defense would show that Kimberly Enix was the aggressor in the case.*

Good luck with that one, buddy.

“Just before the police intercepted him, we were at a stop sign, and she (Brooklynne) waved at me,” Adams told the USA TODAY NETWORK-Tennessee in 2015. “It was like she knew I was there to help her.”

She was so lucky to have this alert bystander. Love seeing Amber alerts work!

I can't find who has custody, but the paternal grandparents were fighting for it at one point:

Two others are also fighting for the 2-year-old: the mother and father of Tyler Enix, who police say killed Kimberly Enix. They are now divorced.

Enix Trial Day 1: Prosecutors lay out their case in ex-wife's killing

http://www.wbir.com/news/crime/enix-trial-day-1-state-lays-out-its-case/478554815

The state said it will show the jury notes that Enix wrote on his phone detailing the times that he claims Kimberly threatened him and physically abused him. Prosecutors said Enix is just using that to create his own defense.

The state also said it will show text messages between Tyler and Kimberly Enix that investigators recovered after they were deleted.

The state said investigators will testify to the physical evidence of the case, such as finding Tyler Enix’s DNA under Kimberly Enix’s fingernails.

Testimony begins in Knoxville murder, kidnapping trial

The state and defense argued two competing theories to the jury. The state told jurors that Tyler Enix was violent and abusive, arguing that he planned out Kimberly Enix’s murder just months after their divorce. The defense paints a different narrative, saying Kimberly Enix was the real abuser in their relationship, going on to say she’s the one who attacked Tyler Enix with a knife before he turned the knife around on her.

“She’s got a knife. It’s over her head and she’s coming at him. He grabs her arm. And what happens after that, sadly we know from the pictures. Tyler just lost it,” said defense attorney John Halstead.

Defense: Enix stabbed to death ex-wife, but it wasn't premeditated

The jury listened to the 911 tapes of concerned co-worker, Libby Guy, who twice called 911 requesting a welfare check on Kimberly Enix the morning she was killed.

Guy testified that Kimberly told her if she ever didn’t show up for work then something would be wrong. She said Enix threatened Kimberly by telling her she would “end up in a body bag” if she ever left him.

Kimberly Enix’s ex-husband, Chris Morrison, testified Tuesday. The two were married in 2000, separated for good by 2006 and divorced by 2008. Morrison had filed order of protections against both Tyler and Kimberly and had worked out a visiting schedule for he and Kimberly’s two daughters.

Morrison said he and Kimberly would get into fights, and admitted that sometimes they got physical, where she would throw things, kick him and hit him.

“But she was never homicidal towards me … never picked up a knife or a gun. I never felt like she was going to kill me,” Morrison said.

A judge has sentenced a Knox County man convicted of killing his ex-wife to life in prison with the possibility of parole after 51 years.

Judge Sword declared a mistrial on the sentencing only and discharged the jury. After Tyler Enix serves 51 years in prison, there is a possibility of parole. He has served 2 of those years already.

A sentencing date on the especially aggravated robbery charge is set for Nov. 30. The state has said they will ask the judge to make those consecutive sentences.

Jurors in Knox County Criminal Court on Friday found Enix guilty of first-degree murder in Kimberly Enix's 2015 killing.

Judge adds 25 years to life term for man who stabbed ex-wife 47 times in front of daughter

Knox County Criminal Court Judge Steve Sword on Thursday ruled – at the behest of prosecutors Molly Martin and Kevin Allen – Enix’s crimes after the slaying merited additional punishment.

“This was a situation where you have a brutal murder with a child there … stolen away (by Enix) from the family that loves her,” Sword said. “What is significant to me … is (he) takes this child and jeopardizes her life.”

Sword sentenced Enix to an additional 25 years for especially aggravated robbery. That sentence guarantees Enix, who has been jailed since his capture in 2015, likely will die behind bars before he is eligible for a parole hearing.
