    I think the people that are complaining about Nel's closing presentation, might be forgetting that he already presented the Judge with a written document, in organised outline form, and appropriate citations and case documents. And she already studied that BEFORE he gave his closing statement.

    Because of that, his presentation takes on a very different tone. He is not speaking TO US, but to her. And he does so AFTER he reads Roux's explanations and arguments in defense. So Nel is basically discussing, with the judge, the important points that he knew needed highlighting and clarification.

    The SA closing arguments are NOT like ours in a jury trial. So we should not compare apples to oranges. If we compare oranges to oranges, Nel did a brilliant job, imo. The judge was very engaged and even nodded in agreement a few key times. :judge:

    This case cited by Nel was excellent, and it was confirmed by the Court of Appeal.

    State versus Mlambo

    “Moreover, if an accused deliberately takes the risk of giving false evidence in the hope of being convicted of a less serious crime or even, perchance, escaping conviction altogether and his evidence is declared to be false and irreconcilable with the proved facts a court will, in suitable cases, be fully justified in rejecting an argument that, notwithstanding that the accused did not avail himself of the opportunity to mitigate the gravity of the offence, he should nevertheless receive the same benefits as if he had done so”

    The Mlambo decision (supra) was reaffirmed by the Supreme Court of Appeal in an unanimous judgment per Olivier JA"

    I'm a little confused about what exactly closing arguments are supposed to be if they are not to repeat what's in their written Heads of Argument. I read Nel's Heads last night, and his closing was essentially a near-verbatim recitation of his written argument.

    The death knell :D for putative self-defence.

    “Perhaps the most damning aspect of the accused’s evidence is his inability to back-up his defence by admitting that he fired with the intention to kill or hurt the person/s he allegedly perceived to be attacking him.
    His actions were never intended to protect him against the perceived attack.
    It needs no argument that if he did not aim at the perceived threat then he cannot rely on putative self defence.”

    Is anyone any clearer about whether it is ok to rely on two defences, ie OP didn't intend to shoot and kill anyone that night but, if the court finds he did, then he did it in self-defence? The SA legal expert on the sky news recap last night seemed to be saying it was ok to do that.
