HOUSTON, Texas (KTRK) -- Forty-one men and women have been qualified to be potential jurors in A.J. Armstrong's third capital murder case, three weeks into jury selection. By the end of the week, Judge Kelli Johnson hopes to have closer to 50 people before the final jury is picked on May 31.

HOUSTON – The court heard from more than 200 potential jurors from three separate panels this month. Attorneys made it down to 48 potential jurors. This group will return on May 31 for the final part of the voir dire process, where 12 jurors plus alternates are selected.

On Thursday, the court called for one prospective juror to return Friday. The courtroom bailiff said the juror called her to make her aware that her boss talked about the case when referencing her kids, stating they attended Kinkaid High School, the same school as Antonio Armstrong Jr. but not at the same time.

Prosecutor John Jordan raised concerns about the discussion.

“The issue is there’s clearly a conversation,” Jordan said. “There’s no way to get to Kinkaid [High School] without perjury…[I’m] not accusing her of perjury. I’m not saying that. I think it’s violating the courts order.”

Attorneys will ask the potential juror more about the conversation on Friday.

3-week, pre-jury selection in AJ Armstrong murder trial nears end with 48 potential jurors

HOUSTON, Texas (KTRK) -- After 13 days and more than 150 hours of questioning potential jurors individually, there is a pool of nearly 50 men and women who could decide A.J. Armstrong's fate in his third capital murder trial.

If convicted, Armstrong, now 23, would be automatically sentenced to life in prison with the possibility of parole after 40 years.

But even in the final days of the in-depth selection process, outside influence continues to be an issue.

[---]

Over the past three weeks, 204 potential jurors were summoned for Armstrong's case. After 13 days of questioning, there is a pool of 48 people left. Of those 48, 12 jurors will be picked, plus alternates.

This intense, exhaustive selection process usually only happens in a death penalty case because of the heavy life or death consequence jurors weigh. But, Johnson ruled for individual interviews in Armstrong's case because of the nationwide media exposure.

The final eight potential jurors were interviewed Thursday, and of them, seven remained in the jury pool, including a middle school teacher, engineer, hairdresser, and engineer.

What's expected to be the final day of individual interviews happens on Friday. One panelist, already interviewed, will return to court to answer questions about possibly being exposed to background information about Armstrong.

Prosecutor claims a juror in Antoinio Armstrong Jr.’s Trial is being ‘purposely invasive’ and ‘deceptive’
Prosecutor claims a juror in Antoinio Armstrong Jr.’s trial is being ‘purposely invasive’ and ‘deceptive’

Houston – Two jurors were called back to court Friday for questioning on what they heard dealing with the Antonio Armstrong Jr. trial.

Prosecutors accuse Armstrong Jr. of killing his mother, Dawn, and father, Antonio Sr., when he was 16 years old.

The first juror called into question is an ethics and human resource manager. The juror contacted the court about information she heard from her boss and coworker.

“I wanted to make sure I disclosed that. I don’t know anyone in this case,” the juror told the court.

Judge Kelli Johnson asked the juror what she remembers about the conversations.

The juror shared before being selected for jury service on the third panel that her boss, a chief ethics officer, brought the case up.

The juror said the boss told her, “‘Hopefully, you don’t get pulled for that case.”

A total of 48 jurors were also expected to return on May 31.

Judge Johnson gave attorneys more information about alternate jurors. In addition to the 12 jurors who have yet to be picked, there will be four alternates in case something happens to the original dozen.

The first juror called into question is an ethics & human resource manager. The juror contacted the court about information she heard from her boss & coworker. The juror claims that she learned the defendant went to Kinkaid High School Friday in court, but the bailiff, who was not present in court, shared with the judge that the juror told her she learned that her boss’ children went to the Kinkaid School with him. Prosecutor John Jordan wants to remove the juror because his team believes she is being, ‘purposely invasive” & “deceptive.” Defense attorney Rick Detoto argued she has twice qualified herself for the jury in front of the court. This juror will come back on May 31. In the meantime, the court will hear from the bailiff under oath about what was said during the initial phone call dealing with the school.

“I’m being handcuffed,” prosecutors voice an issue in Antonio Armstrong Jr case

HOUSTON – Questions surrounding two potential jurors in Harris County’s case against Antonio Armstrong Jr. came to a halt Tuesday.

Armstrong is being tried for a third time for the murder of his parents, Dawn and Antonio Armstrong Sr., in 2016.

[...]

The morning wrapped up with testing the courtroom hearing impaired system. One potential juror has a problem hearing Jordan’s voice because of his tonal pitch.

During the past two weeks, Judge Johnson worked with county staff to make the system was adequate for the juror if he is selected.

[...]

Jordan was asked to move around the courtroom to test the microphones using various tones. The juror wouldn’t say he could hear 100 percent of what Jordan was saying because the system got louder after the first initial words.

The state played videos of ASMR whispers and phone calls to see if they were something the juror could hear, to which the juror replied, “Absolutely.”

“This is very helpful,” the juror told the judge. " I was able to follow along.”

Outside of the juror’s presence, Jordan moved to strike the juror. He told the judge he would have to reevaluate how he would try the case based on the microphone system.

“I’m being handcuffed,” Jordan said. “One side is being disadvantaged because of a disability.”

Judge Johnson asked if both sides would like to hear the audio recordings during the testing adding, “It’s much better than both sides thinks it is.”

Johnson denied the motion and continued telling both parties “plan on where to put the microphones.”

The court will resume with the 48 potential jurors selected from three panels on May 31st. That is the day the court will acknowledge the 12 jurors plus four alternates for the trial against Armstrong Jr.
