5/5/21 Update: Tarrant County Assistant District Attorney Kim D’Avignon filed the State’s waiver of a death penalty on Thursday in the case of McCurley. The Tarrant County district attorney’s office has filed documents seeking life imprisonment without parole for McCurley. Trial has been set to begin on 8/19/21. Next pretrial hearing on 6/16/21.
6/16/21 Update: State witness: Fort Worth PD Officer Leah Wagner. Portions of the 4-hour interview were played in court. His confession on the tape was not played in court. McCurley plead not guilty. Judge Elizabeth Beach ruled the DA can use McCurley’s recorded interviews where he confession in trial. DNA experts testified for several hours Wed. but the defense team requested another week to work on a brief to state its position on having the DNA evidence thrown out of court, arguing the forensic technology is new & not certified by Texas. Judge also denied a defense motion regarding another interview of McCurley from Sept. This was conducted by KRLD journalist Andrew Greenstein, who testified Wed. also. Next pretrial hearing on 7/9/21.

“NBC 5 learned on Tuesday that DNA evidence recovered from clothing and a bra worn by Walker on the night she was killed was sent to Othram, a private lab in The Woodlands which uncovers genetic identities "through DNA, rootless hair and decades-old bones." Using a new process, detectives said the company was able to develop, for the first time, in this case, a full DNA profile of a potential suspect.”

Opening Statements in Carla Jan Walker Murder Trial Expected to Begin Friday

Jury selection began Thursday in the capital murder trial for Glen Samuel McCurley, the man accused in the 1974 kidnapping and murder of 17-year-old Western Hills High School junior Carla Jan Walker.

Prosecutors announced in May they were seeking life behind bars for the 78-year-old suspect instead of the death penalty. According to the court coordinator, opening statements in the trial are expected to begin sometime Friday.
