GUILTY TX - Cayley Mandadi, 19, suspicious death, Luling, 29 Oct 2017

10 high-profile trials expected in 2022

A retrial for Mark Howerton was expected to take place in 2021 but his attorneys filed a motion to bar his retrial, citing prosecutor misconduct and double jeopardy after his 2019 trial ended in a hung jury.

The judge on this case has yet to rule on this motion but will probably do so in 2022.

I just saw this case for the first time- could not believe mistrial, but could also not believe the defense tried to get this case kicked via "double jeopardy"-- what??? tells you how badly they are afraid of another trial. I looked on Google to see if there is another trial date and didn't see one.

A retrial for Mark Howerton was expected to take place in 2021 but his attorneys filed a motion to bar his retrial, citing prosecutor misconduct and double jeopardy after his 2019 trial ended in a hung jury.

This year the Fourth Court of Appeals ordered the retrial to take place, which is why we could like see it take place in 2023. Right now a potential date for the retrial is late spring.

Howerton is accused of the death of Trinity University cheerleader Cayley Mandadi.

Judge Mery listened carefully to Howerton's statement, but after taking a short break for a few minutes of review, he returned to the bench and assessed Howerton a 20-year sentence, a fine of $10,000, court costs and restitution to Cayley's parents and stepparents.

He went on to issue a permanent no-contact order for everyone in the extended family as well as those who reached out to the court in support of the Mandadi family. In all, more than 20 people were named who Howerton is banned from contacting whether by in-person, mail or social-media means, including after he's released from prison.

Well worth the read, moo. From the article:

Steele called her daughter's death "an unfamiliar evil we were all caught off guard by."

Steele said fighting to establish the CLEAR Alert system in Texas was one way she worked to honor her daughter's life. Similar to an AMBER Alert for abducted children, the program provides a way to help protect vulnerable adults. [...]

The law applies to adults ages 18 to 65 who are determined by law enforcement to be in imminent danger. [...]

Another friend read a letter to Cayley, saying, "Your life was like a beacon of light and your absence is a void that can never be filled. I whisper prayers in the night to hear your voice one more time." [...]

Mandadi’s mother, Alison Steele, was instrumental in getting the legislation passed after her daughter’s death in 2017.

Mandadi, a 19-year-old Trinity sophomore, went missing Halloween weekend. She was later located with severe injuries and died. Her boyfriend, Mark Howerton, was charged with murder, sexual assault and kidnapping in her death.

At the time of Mandadi’s disappearance, there was no program in place for law enforcement to broadcast information about missing adults ages 18-64. Nineteen, Mandadi did not qualify for the AMBER alert program, which notifies the public of missing children 17 and younger. The only other alert system in Texas at the time, the Silver alert program, was for missing adults 65 years of age or older with a mental condition.

Mandadi’s mother created the CLEAR Alert program in her daughter’s memory. To support the program, Steele formed the nonprofit Cayley’s Calling, which provides presentations to law enforcement agencies and other groups about best practices for implementing the CLEAR Alert.

After 19-year-old Cayley Mandadi was unconscious in a hospital bed covered in bruises and on life support, suspicions quickly turned to her sometime boyfriend, Mark Howerton. Two years after her death, his trial began. https://cbsn.ws/3tREkhJ

Will the parents' investigation be a game-changer for Mark Howerton's second trial? "For the Love of Cayley Mandadi," airs Saturday, Jan. 20 at 10/9c on CBS.
