The last entry was the status check of 9/2/22 but no record of the next court date.

I think the decision on the admissibility of Rivera's 6/2018 statement was clear but the defense must think they have standing to go round two. o_O

Also, I downloaded the 9 pg ruling dated 5/4/2022 -- do you want me to send it to you?

I just reviewed the timeline from the initial appeal and I'm wondering if there is a big delay between the initial motion and further action.

For example, during the prior proceeding -- the court filed notice on 6/9/2021 that the clerk's record was received and filed but no reports were received. Advised the parties if no additional reports, the appellate's brief was due in 30 days.

After the above court notice, there was no activity until 1/20/22 when the defense filed a motion for a copy of all the admitted exhibits.

In other words, there was no status, no updates, and nothing was reported on the docket for the six months in between. I've never followed the appeal docket calendar and especially not in TX so don't know if this is typical or not.
 
@Seattle1 - I have in my notes that her appeal was reinstated on 5/9/22. And then she had the status hearing on 9/2/22 to check on the appeal.

Perhaps the reinstated appeal will be more expeditious than round 1. :)

*Status Check Hearing (on appeal re Injury to Child) (@ 6pm CT) – TX – Jayden Alexander Lopez aka “Little Jacob” (4 yrs) (died Oct. 17-18, 2017, found Oct. 20, 2017, ID’d April 5, 2018, Galveston) – *Rebecca Suzanne Rivera (34/now 38) “mom” arrested (6/19/18) & charged (6/20/18) & indicted (8/7/18) with 1st degree felony offense of “injury to a child by omission causing serious bodily harm”, 2nd degree felony tampering with evidence & fabricating evidence. $500K Cash or Surety Bond.
If convicted, Rivera faces a range of punishment on the child injury charge of five to 99 years or life in prison, and a range of punishment of two to 20 years in prison for the charge of tampering with physical evidence.
Trial began on 1/27/21 with jury selection & trial started 1/27/21. 12 jurors with 2 alternates. 2/3/21: Found guilty of 1st degree child abuse & sentenced to life in prison. Estimate release date 7/18/2118. Tampering with evidence charge was dismissed on 2/12/21.

5/4/22: State's proposed Findings of Fact & Conclusions of Law re Appeal. Rivera contended her statements were in response to custodial interrogation & as such the State must show it complied with the Miranda requirements. Rivera did not allege any statement was involuntary. 5/13/22 Update: Appeal reinstated on 5/9/22. Status hearing on 9/2/22 @ 6pm to check status of appeal.
9/2/22 Update: Next status check hearing re appeal on 11/4/22.
*Dania Sarai Amezquita Gomez (31/now 33) “mom’s GF” – 2/5/21: Took a plea deal & plead guilty. 2/25/21: Child injury: Sentenced to 2 years in prison. Harassment charges: sentenced to 2 years in prison. Also on immigration hold.
