Pretrial readiness = just seeing how close each side is to being prepared for trial? Can someone confirm?

I'm surprised she's taking this to trial... She can't expect to win, can she? What's her defense?

Judge Selena Alvarenga set Fieramusca's arraignment hearing for Jan. 31. Her grand jury trial is set to begin on March 13.

In court Wednesday, Alvarenga stated that Fieramusca's case "needs to move" and that "both sides need a resolution."

"Fieramusca has been in custody for 1,119 days," Alvarenga said, also stating, "Fact of the matter is, this is a very old case."

Oh man, so........ they haven't even figured out yet whether she should be brought to trial?? So we are now going to enter 'the beginning of the case'???? Wow. You'd think that should've just been waived????

Although grand juries and trial juries are both made up of average people who were called for jury duty, they serve entirely different purposes. A grand jury helps determine whether charges should be brought against a suspect, while a trial jury renders a verdict at the criminal trial itself. Put differently, a grand jury hands down an indictment at the beginning of a case, while a trial jury decides guilt or innocence at the very end (not counting the appeal process).

She's been in jail for 3 years and it sounds like they're just getting around to having a grand jury decide if there's probable cause that a crime was committed. I don't know anything about TX law, so maybe I'm not understanding the process there.

She's been in jail for 3 years and it sounds like they're just getting around to having a grand jury decide if there's probable cause that a crime was committed. I don't know anything about TX law, so maybe I'm not understanding the process there.
That's exactly what it sounds like. Wow. Well at least the judge seems to now be on them to get this thing moving. Crossing fingers that it moves fast from this point.

Her defense was that LE didn't have the right to go into her home when they did and whatever they found should be excluded. Now that that was denied, FINALLY, by a judge, maybe she'll claim insanity?

By 'resolution', I'm assuming they mean some kind of a 'plea deal'? Would that be like Fieramusca pleads guilty so she doesn't get the death penalty?

Fieramusca herself did not appear because she was placed in a COVID unit at the jail and couldn’t be brought in, according to the court. However, the attorneys still met with the judge to provide updates on the case and reschedule the hearing.

Once the attorneys approached the bench, the judge addressed the fact that Fieramusca has been in custody for over 1,000 days and emphasized the need to move forward with the next steps in the case.

The judge informed the attorneys that if the two parties could not agree on a resolution soon, the case would go to a jury trial this March.

Fieramusca is now scheduled to appear in court on Jan. 31 for her arraignment hearing.

This would have been Fieramusca’s first in-person court appearance since May 2022 when the state and defense attorneys presented arguments regarding the evidence the Texas Rangers obtained when they entered Fieramusca’s Houston home on Dec. 19, 2019.

I am so confused! I thought she’d already been arraigned and pled not guilty. Is there another arraignment? And what’s this about a grand jury trial? Did the reporter mean MF’s jury trial is scheduled to begin in March but mistakenly used the term grand jury?

This link says trial, no mention of grand jury trial - I've never heard the term 'grand jury trial' in any case.

I haven’t either, hence my confusion. But the article I read that was linked in the post I was responding to says:

I'm baffled. How is that they're just now doing the grand jury? This might be unpopular to say, but it seems obvious that the defendant's rights have been violated in a serious manner.

Wow -- this reporting by KVUE is horrendous!

First, there is no such thing as a "grand jury trial."

On Dec 20, 2019-- MF was first arrested for kidnapping and evidence tampering in Harris County and was transferred to Travis County to face charges. She was also arraigned on several traffic violations.

But on Jan 28, 2020, MF was indicted by a GRAND JURY for capital murder for strangling Heidi with a leash and her hands on or about Dec 12, 2019.

Who knows? It's like we have to physically go there and hear it in person for ourselves to get the actual details/truth of what was said? Ridiculous.

The woman accused of killing an Austin friend and kidnapping her 3-week-old baby in December 2019 is expected to enter a guilty plea during her next court appearance on Jan. 31, her attorneys told KXAN Tuesday.

In exchange for the plea agreement, the attorneys for Magen Fieramusca said they expect a sentence of 55 years in prison.
