Anything less than a life sentence
doesn’t seem like adequate justice
for the crime(s), imo.
As far as negotiating with (iow rewarding) MF for a guilty plea, I think 55 years is plenty lenient. Even without the possibility of parole, 55 yrs would still be generous & merciful given the hellacious acts she has committed. MOO
We know she perpetrated these heinous acts. She admits it. I really do wonder what direction we’re headed in as a country when this vicious crime isn’t enough to draw a most severe penalty.

I truly hope the Broussard and Carey families are satisfied with the outcome. That’s what really matters is that they feel justice is served. MOO

MF not only betrayed a friend but she came between a mother and her three-week-old infant. The idea of Heidi, an undisputed momma bear, going to her death while trying to protect her baby girl makes me sick.

I can't find any mercy for MF knowing she strangled the life out of Heidi while her baby was probably in her car seat near her. :eek:

And let’s not forget that many people accused the Baby’s Dad, Shane, of being the killer. I hope he received lots of support. She could have brought closure to this for this reason alone.
She ,the Killer also hinted/pointed at at Shane,even saying things were bad between Shane and Hedi.

It is not just the Broussards and Careys. There are many victims' families who are unhappy with sentencing. It is the DAs policy that began in 2021. Do a search on this or any variation of these terms:

Thanks for the tip. Now I do have a better understanding of how/why this unbelievable bargain was made for MF.:mad:I’m appalled by what all I’ve just learned about garza and what he’s been up to! It’s hard to believe he hasn’t been relieved of his duties!

IMO, garza shouldn’t have even had the chance to wreak havoc in Heidi’s case, if our system was at all efficient. She was found deceased in MF’s trunk on Dec.19, 2019. José Garza was elected Travis County District Attorney on November 3, 2020.

I understand and can even agree with the implied benefit of a 55-year sentence with no appeal rights.

However, the problem I have with this specific plea deal is that capital murder has a specific statutory guideline for eligibility for parole release and it appears to me that this is being ignored by DA Garza.

However, if she is deemed convicted of capital murder, the statute provides she is not eligible for parole until serving 40 years.

Inmates convicted of capital murder (Penal Code 19.03) are only eligible for parole after serving 40 years in jail.

IMO, there's a big difference between MF serving 40 years in jail before being eligible for release compared to 50% of the sentence or only 27.5 years.

I find DA Garza's carefully worded press announcement (i.e, 55 years and no appeal) misleading and think he should be held accountable to explain why the deal was sweetened for the worst kind of killer.

Seriously, who, after being present at the births of her children, strangles their best friend with a dog leash, and leaves her kids motherless?

How can 27.5 years be a rightful sentence for such a heinous crime. Garza has a lot to answer for imo.

I hope this is only happening with approval from Heidi's family. Perhaps they've requested the peace that comes from accepting what's happened, knowing who did it, and avoiding the pain and upheaval of trial.

I hope her family is healing.

Fieramusca was charged with capital murder in January 2020 in the death of Heidi Broussard.

Broussard’s mother, Tammy, confirmed that she was told about the sentence and will be in court on Jan. 31.

Broussard said she still doesn’t know why Magen killed her daughter, she said the two were supposed to be friends.

“I have a big portrait of Heidi and Shane and the kids and I am bringing that and hopefully they will let me put it in the courtroom so that she can see what she has done, something that will remind her of what she has done,” Broussard said. “I don’t have any ill feelings towards her, God has set me at peace, and we just have to get this done.”

“I imagine many have questions that will never be adequately answered, nevertheless, I hope that this plea brings some closure to this family’s great loss,” Fieramusca’s attorney wrote in a statement.

In exchange for the plea agreement, the attorneys for Magen Fieramusca said they expect a sentence of 55 years in prison.

Unfortunately she may not serve all of it.

WTH- why would she ever be eligible for parole- I have to tell you I am beginning to despise our justice system. Why should she not serve every day of 55 years? what good is a sentence of that length if she will be paroled, probably sooner than 27 years- for "good behavior"--- I am livid.

*Plea Hearing (@ 1:15pm CT) - TX - Heidi Elizabeth Broussard (33) & Margo(t) Elizabeth Carey (2 weeks) (missing on Dec. 12, 2019, Austin; found Dec. 19, 2019, Heidi deceased inside trunk of car (2015 Nissan Versa) owned by Magen at Jersey Village near Houston; baby Margo(t) alive & healthy). *Magen Rose Fieramusca (33/now 37) aka Maygen Humphrey, Magan (& Magen) Rose Humphrey, Maygen Fieramusca, May Humphrey & May Fieramusca arrested (12/19/19) & charged, arraigned (12/20/19) & indicted (1/28/20) with 2 counts of 3rd degree kidnapping & 1 count of 2nd degree tampering with a human corpse. Plead not guilty. $600K bond.
Indicted & recharged & arraigned (1/28/20) with 1 count of capital murder by terror threat & 2 counts of 3rd degree kidnapping (Margo(t)) & 1 count of tampering with evidence. Plead not guilty. $1M bond (on murder). \
Trial was set to begin 3/13/23 was cancelled due to plea agreement.

1/11/23 Update: Fieramusca herself did not appear because she was placed in a COVID unit at the jail * couldn’t be brought in, according to the court. However, the attorneys still met with the judge to provide updates on the case & rescheduled the hearing. Fieramusca has been in custody for over 1,000 days & emphasized the need to move forward with the next steps in the case. The judge informed the attorneys that if the two parties could not agree on a resolution soon, the case would go to a jury trial this March (3/13/23). Judge Selena Alvarenga set Fieramusca's pretrial hearing for 1/31/23. Her jury trial is set to begin on 3/13/23.
1/24/23 Update: Fieramusca is expected to enter a guilty plea during her next court appearance on 1/31/23 her attorneys told KXAN Tuesday. In exchange for the plea agreement, that includes Fieramusca waiving her right to appeal, the attorneys for Fieramusca said they expect a sentence of 55 years in prison. She will be eligible for parole after serving 27 ½ years.

Both Travis County Criminal and Civil/Family Courts are closed today, due to icy weather conditions. No in-person or virtual hearings will take place.
Magen Fieramusca was expected to plead guilty in death of friend today. That will happen at a later date.
