Wednesday, June 17th:
*Arraignment Hearing (@ 3pm CT) – TX – 4 malnourished children found in 3x2 dog cage; 2 smeared w/excrement in barn; 5 yr. old boy, 4 yr. old girl, 3 yr. old boy & 1 yr. old boy, Feb. 2019, near Rhome) – only for *Paige Isabow Harkings (24) charged & arraigned (2/13/19) with 4 counts of of injury to a child by knowingly causing serious mental/deficiency/impairment/injury. $75K bond. $30K Surety, out on bond (3/12/19).
Fabila is father of 1 child; Harkings is mother of all 4. Children transferred to Cook Children’s in Fort Worth & released to CPS.
*Andrew Joseph Fabila (24) charged & arraigned (2/13/19) & indicted (5/14/20) with 4 counts of injury to a child by knowingly causing serious mental deficiency/impairment/injury. $60K bond ($15K for each count). Out on bond (2/19/19).
The judge also announced that new bond conditions on Fabila prohibit him from having any contact with the children at this time.
2/13/19 Arraignment hearing. A court hearing will be held later this month to determine what happens next with the children.
2/27/19 Update: Both were at the Child Protective Services hearing at the Wise County Courthouse Wednesday morning. Judge Alyce Bondurant ordered that the children remain in foster care while investigators continue to see if there is a suitable relative that can care for the children. Another hearing will be held next month to revisit the issue. Bondurant said she expected both Fabila & Harkings to participate in a drug treatment program, which will be part of the service plan that will be included in the court’s order at the March hearing.
5/14/20 Update: Both indicted on 4 counts of injury to a child by knowingly causing serious mental deficiency/impairment/injury. The charge is a first degree felony offense, punishable by 5 to 99 years or life in prison. Indictment pending. For Harkings: Arraignment hearing on 6/17/20. Nothing for Fabila as of 6/17/20.
