HDM quickly removed the stories relating to the arrest from their SM after (inevitable) speculation about the arrestee's identity.
It’s appalling that The Sun and certain other media outlets are publishing the name before police have named, they’ve learned nothing from the Christopher Jeffries debacle. While we’re pretty sure who it is, naming before any charge is brought could allow any defence to question whether a fair trial is possible.

The only thing confusing me this morning is would his guilty pleas and sentence on the other charges be used in any potential murder trial for Libby? Or would these be withheld as we usually see?

If they would be withheld and jury not informed then why have they waited?

There are likely to be detailed evidential applications as to what can and can't be revealed to the Jury. This is why the fact that he just went down for 8 years is not in the articles

The traditional view is that these kinds of convictions give a risk of propensity reasoning. So PR is "the kind of guy" who would do a sex murder.

Normally you need strong similar fact evidence and a similar kind of offending - which i don't see here

BBM - yes its a very plausible theory I believe thats what happened.

I came here immediately after I seen news about his arrest on Daily Mail (where they named him but avoided any references to previous conviction).

I think LE 100% wanted him convicted of sexual predatory offences first as it will make any potential murder case in the future far more convincing. Evidence proving his character and MO have been gathered and he himself pleaded guilty. More cases lie on his file...

So now LE got that safely sorted and out od way they can focus on Libbys case. In MHO they have been fairly confident it was him from early in the case.

Lets hope a murder charge will stick this time. So far I think LE are handlung case exceptionally well IMOO

I think it is more tactical.

He is now banged up for 8 years and they hope to increase the pressure on him still further when he is psychologically low. Get him to come clean.

I suspect his priors won't be admissible at trial.

Could it be the other way round? Could the arrest for murder have been withheld for a period of time so as not to prejudice his trial for the other charges? I image LE must have been desperate to keep him locked away.

My child told me her friend was on standby to be a witness right up until the guilty plea so I think it was unexpected.

Given the higher profile an arrest for murder gets nationally perhaps LE weren't willing to risk giving his defence any opportunity to claim he wouldn't get a fair trial?

Given the nature of the sentence I wonder however, if his impending arrest for murder was a factor.

I'm with you in thinking that previous convictions couldn't be used in any trial as the jury could only reach a decision based on the evidence in front of them.

I do however wonder whether it's possible that some of the evidence from those convictions might be used in a murder trial. Perhaps the CCTV and other stuff we didn't hear about. Especially if they show planning and forethought which would be pertinent. That would mean they'd crop up during a trial. Someone with legal knowledge would have to unravel that.

How frustrating to get a site outage when the news finally breaks of an arrest for Libbys Murder. You couldnt make it up.

My thoughts, a charge HAS to be forthcoming. Why would they arrest him NOW if they didnt have evidence for a charge when they have had 7 months almost and he is now firmly locked away.
Hoping her family can soon take her home to rest and finally see justice served.

I'd agree a charge seems more likely as time was on LE's side after the conviction for previous offences. Could LE have obtained vital info from his family after he was sent down? Maybe they just wanted the voyeur/indecency trial to play out and he would have been rearrested anyway.

One potential avenue to use his offending against him would be where he claims an innocent explanation for lurking around in his car in the dead of night.

e.g illegal taxi driving. I would not mind betting he has made on the record statements to Police during his original interviews that will be used in Court.

In such a case, the prosecution might be allowed to submit evidence that he was abroad at night with the intention of committing opportunistic sexually motivated offences.

I know? Dreadful. But if they suspected him as most of us did I think, at least they will hopefully see justice for her. I wonder where the evidence came from for the arrest after this time? Specialist forensics from the autopsy maybe?
The very worse of the press (Sun, Mail) are just naming him. The Mirror and Guardian aren't naming him and are referring back to police statements.

They reminded me of the odd things about this case like PM not being released for operational reason. It being a complex case. Many experts being used including search experts, oceanographers and specialist forensics.

The guardian referred to the Croda CCTV.

I guess a lot of that takes time. I guess it's possible they've just got the last bit of the jigsaw.

Yep. That's also my opinion.

There were at least a couple of occasions where LE mentioned trawling through hours of CCTV.

When his trial date was set LE asked for facilities to show CCTV. Which given what we now knew about the mass of forensics seems like overkill unless it was to show his crimes weren't opportunistic.

The judge, who will have had access to that evidence did not accept the opportunistic defence.

I still think the location of his car that night is significant and that he's been there before. I also think that the way spidercam was edited will be significant

Morning - what a time for the site to be down. I cried when I read about the arrest. I always believed he was the man they were looking for. I hope charges follow and I hope there is justice for Libby and her family are able to get her back and lay her to rest.

O.M.G

waiting to see if charge.

Ps

Great timing for WS to be down all day

Wasn't it just! As this was breaking too.

Well, Dale Brook is going to be kept busy for a while.

I wonder what new evidence they had. Obviously they were waiting on the end of the other case to haul him in again.

I believe, as I have been telling anyone who'll listen for the past few weeks, they already had lots of circumstantial evidence against him but not quite enough. I think they were waiting for him to become a convicted predatory sex offender, via the court case last week. And that was the final nail in the coffin in terms of now having enough circumstantial evidence to present a better case to the cps. It also explains why they still haven't released her body after all this time. I strongly believe a charge is imminent.

Woke up wondering how the questioning could have gone. Was hoping for charges by the time we had woken up but I am remaining hopeful and I’m sure they will come in the coming hours!

I agree, what a time for the site to be down ! First thing I tried to do was come here. Just thankful it’s a step in the right direction and we can talk about it today.

Picking up on earlier comments, I have to say I agree regarding police perhaps not taking earlier reports of PRs behaviour seriously (or linking them) but I’m more inclined to think it has to do with the massive funding issues and lack of available officers across all police forces in the UK. I unfortunately had to report something serious to the police regarding my daughter, a statement taken etc ..
Almost four weeks later and we haven’t even had an update. I’ve phoned to be told by another police officer that whereas cases would be passed between them during rest days & heavy case loads, this isn’t the case anymore. He told me there simply aren’t enough officers. Very sad all around.

Love and thoughts to Libby’s family today x

Literally only just seen this news (school hols here)
So now we are talking a "different kettle of fish" being now confirmed a murder investigation..it must have been waiting for his court case that has delayed the release to her family as many of us thought ... presumably they will also release the COD at some point now also

I read a blog by a talented young officer some months back talking about why he quit the force. Essentially the workload was too insane and getting worse so why would a young person keep doing it?

That is the reality of the resourcing cuts - and that means offenders like PR don't get caught soon enough
