Good morning​

Good morning all,
We are back in Manchester Crown Court for the third week in the trial of Thomas Cashman.
Our Crown Court reporter Adam Everett is in courtroom one, and Crime Reporter Jonathan Humphries is in the media annexe in the building where the case is being livestreamed.
We are expected a later start today, as time has been set aside for the judge and counsel to discuss legal and administrative matters.
We will keep you updated and provide live updates when the jury are called into court.


 

Legal discussions ongoing​

For anyone wondering about the lack of coverage so far today, the judge and counsel remain in discussions about legal and administrative matters in the absence of the jury. As Justice Yip has told the jury on a previous day, these discussions are often necessary in criminals trials to allow things to run smoothly.

Good morning​

We're back in Manchester Crown Court today where proceedings should resume this morning after a day of legal discussions yesterday.
The jury were told their services were not required on Monday, but the prosecution is due to conclude its case today.
Our Crown Court Reporter Adam Everett is back in courtroom one and Crime Reporter Jonathan Humphries is in the media annexe in the building where the case is being livestreamed.
The case is due to resume at some point after 10am.

Judge in court​

Judge Mrs Justice Amanda Yip is back in court.
A reminder, David McLachlan, KC, prosecutes, assisted by junior counsel Henry Riding and Peter Wilson.
Professor John Cooper, KC, defends, assisted by junior counsel Katy Appleton.
Judge Yip is dealing with a legal matter before the jury are invited in.

Alarm malfunction​

An alarm appears to be malfunctioning in the court building.
A tannoy is playing an alarm sound, folllwed by evacuation messages, but it appears this is a glitch. The judge and counsel are awaiting the issue to be resolved.

Case back underway​

The legal and administrative issues have been dealt with and the jury are being brought in now.
Justice Yip tells them that counsel have “sought to deal with everything we need to and are ready to proceed with the evidence”.
The trial will resume with evidence from PSI Caleb Suggitt, who has been recalled to the witness box to help present evidence.

Defence case to begin later today​

Justice Yip tells the jury: “We’ve reached a very significant point.
“You’ve heard the end of the prosecution case now.
“We will move on to the defence case.
“Conventionally, we take a break at this stage.”
The court will resume at 2.15pm to allow for Mr Cooper to have a conference with his client.

Thomas Cashman to give evidence​

Thomas Cashman has been escorted from the dock to the witness box and the jury are being ushered into court.

He is sporting short brown hair and short facial hair and is wearing a knitted blue jumper over a white shirt.

Two security guards are seated either side of him, while another is sat at the entrance to the well of the court.

Court adjourns for the morning​

That is all the court will hear today.
Mr Cooper will continue his questioning in the morning.
The trial is adjourned until 10am on Wednesday.


 
It’s quite difficult to understand what Cashman is talking about some of the time it doesn’t really flow or make sense, but the gist of it seems to be that he is acknowledging He is a drug dealer and that he is owed £25,000 by Paul Russell, Nee’s friend. And he had quite a long term affair with the witness, you can’t be named, and has come up with a ‘plausible’ excuse of why his clothes were in her house. So basically he has tried to undermine her testimony.

It’s such a shame that Nee will not be called as a witness.
 
Seems like the defence's case will be to explain his movements (as outlined by the prosecution) as related to drug dealing and not related to the murder (hence mentioning why he's often going into his sister's house for a few minutes), plus say that PR/unnamed witness are making accusations as they're in large amounts of debt to him and it's easier for him to be out of the picture.

That all said, I think they're gonna have a tough job to overcome the CCTV analysis which seemingly matched the shooter's outfit to his own that day.

Also, the family friendship was already known due to social media but I find it pretty interesting (and perhaps morbid given the charges) that TC says he spent the day prior to the shooting at Nee's house with his mum and brothers.

Good morning all,
After some slight delays due to M62 chaos we are back in at Manchester Crown Court for day 13 of the trial of Thomas Cashman.
Today Cashman, 34, will continue giving evidence after the defence opened its case yesterday afternoon.
Crown Court Reporter Adam Everett is in position in courtroom one and Crime Reporter Jonathan Humphries is in the media annexe in the building where the case is being livestreamed.
Proceedings are due to resume shortly.

Cashman resumes giving evidence​

The jury are back in court and Thomas Cashman is seated in the witness box. He is wearing a navy blue jumper over a shirt and tie, with navy blue trousers.
John Cooper, KC, defending, will resume questioning his client.

Witness 'ruined my life' says Cashman​

Justice Yip: “We are conscious he was quite quietly spoken. I’ve said to keep his voice up, there’s no speaking too loudly in court. If anyone is struggling to hear, give me an indication.”
Mr Cooper asks about the witness who cannot be named for legal reasons, who Cashman has accepted sleeping with.
JC: “Did you know she was pregnant?
TC: “No, I didn’t know.
JC: “Did you know one way or the other whether that child was yours.
TC: “No, I didn’t know.”
Cashman says he became engaged to his partner Kayleeanne Sweeney in 2015.
Mr Cooper asks: “You heard the evidence as far as [witness name] was concerned. She said this. ‘I’m going to ruin you like you ruined my whole life’. She agreed that was her view. She went on to say ‘he had ruined my life, finished my life, he head *advertiser censored**ed me’. She was referring to her relationship with you. When she said I’m going to ruin you, were you surprised to hear her express herself in that way?”
Cashman replies: “Everything she’s said, is what she’s done to me. She’s ruined my life. She’s ruined my partner’s life, she’s ruined my kid’s life. What she said to her mate she had done to me. My life’s been ruined. What she’s saying is a lie. She’s ruined my life. That’s the only thing I can say.”

 
This is an interesting point - where is the cctv from the witness's house for that night ?



DMcLachlan : “Is it the case, on this night you went somewhere to someone who you thought you could trust?”

TCashman : “If that was the case, the CCTV what covers her house. This is the proof what she’s saying is a blatant lie. She’s a total liar. The CCTV covers every angle of her house. They would have got caught on CCTV.
Of all the CCTV yous have took, there’s nobody going to her house because no-one went to her house.
I never went to her house. I would have been caught on CCTV.




 
Justice Yip comments on the courtroom being warm, and says that is a convenient moment to break for the day.

Cashman will resume giving evidence at 10am tomorrow morning.
