Fields, of Maumee, Ohio, was charged with one count of a hate crime resulting in the death of Heather Heyer; 28 counts of hate crime acts causing bodily injury and involving an attempt to kill; and one count of racially motivated violent interference with a federally protected activity, resulting in the death of Heather Heyer, for allegedly driving his car into a crowd of protesters on a downtown street in Charlottesville during the Unite the Right rally.

The federal charges add to 10 state charges of first-degree murder, malicious wounding and aggravated malicious founding and failure to stop at the scene of the crash. He is scheduled to go to trial in Charlottesville Circuit Court in November.

BBM. I'll be watching that trial. Let's hope the good citizens of Charlottesville do their duty and send this guy to prison for a long time.

Attorney for James Fields Jr. Seeking Change of Venue for Charlottesville Trial

A motion for change of venue was filed, requesting Fields' upcoming trial either be moved to another locality, or have jurors brought in from outside the Charlottesville area.

A pretrial motions hearing for Fields is scheduled for Thursday, August 30. A three-week jury trial is set to get underway on November 26.

"The judge in the case of the Ohio man accused of killing counterprotester Heather Heyer has declined the defense's motion for a change of venue, according to the NBC29 TV station in Charlottesville, Virginia....

Fields' attorney, Denise Lunsford, filed a motion Aug. 14 arguing that either the trial should be moved to another jurisdiction or jurors should be brought in from elsewhere.

“Community prejudice against Fields in the City of Charlottesville, the impact of the events on the Charlottesville residents and the widespread publicity this case has received are reasonably certain to prevent a fair and reasonable trial,” the motion reads.

Lunsford presented more than 2,000 pages of news media articles to support her contention. The judge was not swayed....

Fields’ trial is scheduled to start Nov. 26 and is expected to last about three weeks."

DOJ Assigning New Prosecutor for Federal Case Against James Fields Jr.

"CHARLOTTESVILLE, Va. (WVIR) -
The United States is filing a new motion in its federal case against James Alex Fields Junior.

Fields faces 30 federal charges in connection with an event on August 12, 2017 that left one woman dead and dozens injured. The Ohio man is facing additional charges, including first-degree murder, in the City of Charlottesville.

Monday, September 24, the U.S. filed a motion to remove Stephen Curran as an attorney of record for the federal case.

The court filing shows that Curran has left the Department of Justice (DOJ) and that the prosecution plans to replace him with Risa Berkower.

Brian McGinn, a spokesperson for the prosecution, tells NBC29 that this is just a bit of legal wrangling and it will not have much effect on the case itself....

A hearing in a federal courtroom is currently scheduled for December 7. Fields’ jury trial in Charlottesville Circuit Court is set to get underway on November 26."

Charlottesville Circuit Court is taking up pretrial motions related to James Alex Fields Jr.

Attorneys discussed logistics on Thursday for the three-week trial which is expected to draw the largest jury pool in the city's history. The question at had is whether or not the attorneys in the case will find unbiased people....

The jury pool is expected to consist of 360 people and could take three or more days to select. A judge has already declined to grant a defense-requested venue change....

Fields was also indicted on 30 federal hate crimes by a grand jury in June. He is due in federal court for a status hearing in December which will fall in the middle of his three-week trial on the state-level."

"...Attorneys involved in the case against James Alex Fields, Junior are finalizing details for his upcoming trial. They met with Judge Richard Moore behind closed doors at Charlottesville Circuit Court Tuesday, October 9. Fields was present for the meeting, as well....

Following Tuesday's meeting, Judge Moore announced the pretrial conference involved representatives from the Circuit Court Clerk's Office, Charlottesville Sheriff's Office and City Hall.

The judge said the meeting was strictly for administrative and housekeeping items.

Lawyers had also met last week to discuss jury selection and logistics.

A three-week jury trial is scheduled to begin on November 26."

Man charged with running over protester in Charlottesville assaulted in jail

"...Fields was being seen by jail staff in an office Monday morning when Timothy Ray Brown Jr. made his way past a correctional officer and hit Fields “twice on the left side of his body above his shoulders,” Col. Martin Kumer, superintendent of the Albemarle-Charlottesville Regional Jail, said in a news release.

“At no time did Inmate Fields have an opportunity to defend himself or respond in any manner,” the news release said.

A friend of Brown’s told The Associated Press on Friday that Brown was a friend of Heather Heyer, the woman killed in the Aug. 12, 2017, attack, which left dozens more injured.

Fields — who has been described by authorities and others who knew him as an admirer of Adolf Hitler — faces first-degree murder and other charges in Heyer’s death...."

The man accused of driving a car into a crowd of counterdemonstrators in 2017 was back before a Charlottesville judge on Monday.

Prosecutors and attorneys for James Alex Fields Jr. gathered at Charlottesville Circuit Court on Monday afternoon for a motions hearing. Most business was done behind closed doors with Judge Richard Moore, who is expected to issue several orders ahead of the anticipated three-week trial.

Some of the orders expected to be issued by Judge Moore include guidelines for safety and security during the trial. In August, Judge Moore denied a request to move the trial out of Charlottesville by Fields’ attorneys, who claimed there was no chance of an impartial jury in Charlottesville...."

With less than two weeks before the start of Fields’ trial, Charlottesville Circuit Court Judge Richard E. Moore heard arguments on a motion from the defense to prevent jury rehabilitation.

In some cases, a judge may ask a potential juror to ignore a stated bias and base their verdict on the evidence and the law....
The prosecution agreed with the intent of the motion, but asked Moore to take it under advisement since the trial has not begun.

Moore took the motion under advisement, and plans to revisit it when the trial begins....

Both the motion to prevent juror rehabilitation and change the trial location are likely to be revisited when Fields’ three week trial begins on Nov. 26."

This case is coming up so fast now. Only 5 days to go.

Thanks to everyone who has been posting updates thus far.

It seems that whereas it may in some cases be possible for jurors to genuinely and honestly set aside their pre-existing biases, the defense and prosecution lawyers both seem to be in agreement that this is unlikely or even impossible in this case.

My gut/personal instinct is that they're correct but does anyone know how common it is for both 'sides' to agree with a similar motion that no attempt to 'rehabilitate' potential jury members should be made ?
